The system was entir4ly in place, including the Infiltrator units, the 1250 gallon septic tank, and. the connections to the house and the barn. The system was sized in accordance with recommendations from Eagle County personnel. The sizing was based on a design flow of 900 gallons per day .� ith a soil loading rate of 1.2 gallons per day per square foot, for a gross absorption area of 750 square feet. The number of Infiltrator units was calculated two different ways yielding 21 units, or 24 units. Then, 22 units was recommended. 'There were 22 units in place, I in each trench. i Mr. Banes indicated 'hat you were concerned about the depth of cover over the Infiltrator units, and the evidence of groundwater in the trenches. We discussed the planned finish grading for the area, and Mr. Bones noted that he was planning on a short retaining wall in front of the house. therefore, 1 noted that he could increase the height of this wall a little, and regrade in front of the house a little, and could then limit the height of cover over the Infiltrator units to a maximum of five feet. We also discussed the fact that the location of the trenches could be. a 1¢w area and collect water unless the final grading were properly performed. In additim, berms and/or swales will be necessary to divert irrigation water from the field area and the/ storm runoff from the parking area, away from the trench area. HCE personnel will obse{e the final grading described above, and make a report to the county. Regarding the groundwater issue, we observed the trenches and the water borne deposits in the soils. It appeared to lus that the deposits were heavier in the upper levels, and then decreased with depth. This int icated that the deposits could be from irrigation water. Therefore, a large amount of water could have run through this ground in past years. As a further ch;k of this hypothesis, it was noted that Blue Lake is situated nearly directly across the highway from this property. We located some aerial topography and looked at the relative elevations of the property and the water surface of the lake. It appears that the water surface level of the lake should be quite similar, if not the same as the general groundwater table in tt a area. The elevation of the ground surface near the trenches is approximately 6403, apd the water surface elevation of Blue Lake is approximately 6392. Therefore, it is our opinion that there should be in excess of the required four feet from the bottom of the trenches! to groundwater. Box 179 500 Broadway Eagle, Colorado 81631-0179 I want to advise you in writing that the Board of County Commissioners has approved the issuance of a Special Use Permit for your Home Business, subject to a number of conditions. A resolution which formalizes the action will be presented to the Board for approval within the next few weeks.. Once the resolution is approved, a recorded copy will be provided to you. In the meantime, a draft resolution is enclosed. I have advised the Eagle County Building Official of the Board's action on the Special Use Permit application. I understand that you will be hearing from the Building Division soon regarding the building permit for the accessory building. By a copy of this letter, I am also advising the Environmental Health Division of the requirement to expand the Individual Sewage Disposal System (ISDS) on this site. As you are aware, requirements for both a water well permit and an adequately sized ISDS are conditions of approval of the Special Use Permit. Both will also be required before the building permit can be issued and the Limited Review on the accessory building can be acted on. The burden is on you to secure evidence that your water well is fully legal and permitted by the Colorado Division of Water Resources, and that you ISDS has been adequately sized. The County Attorney continues to rely on indications from me and other staff that you are continuing to act in good faith. Please proceed with these matters and provide appropriate evidence that both have been completed to me, the Building Division (Terri Biersdorfer), and the Environmental Health Division (Janet Kohl) (ISDS only). The Applicants meet all applicable building code requirements and obtain a Certificate of Occupancy for the accessory building. 3. The Applicants obtain a Limited Review Permit for the accessory dwelling unit or remove the unit. 4. The Applicants properly size the accessory dwelling unit to conform with the maximum size requirements provided in the Land Use Regulations. 5. The Applicants increase the capacity of the Individual Sewage Disposal System as needed to meet or exceed current regulatory requirements for all uses on the site. 3 6. The Applicants demonstrate in the building permit application for the accessory dwelling unit (a) that the General Standards and the Design Standards of the Land Use Regulations (Sections 4-130 and 4-140, respectively) regarding parking and loading areas will be satisfied and (b) where on the site the required parking and loading areas are located. 7. The Applicants provide in the building permit application for the accessory building a sufficient soils report to determine that potential impacts from geologic hazards have been adequately mitigated. The Applicants store all hazardous and non -hazardous materials in a manner consistent with the requirements of OSHA and the Basalt and Rural Fire Protection District. 9. This Special Use Permit be subject to Staff review from time to time to confirm that the site and activities related to this Special Use Permit, including but not limited to off-street parking and loading standards, illumination standards, maximum number of persons conducting the business but living off -premises, and storage of hazardous and non -hazardous materials, continue to be consistent with the intent and in compliance with the applicable provisions of the Land Use Regulations and the conditions of this Special Use Permit. 10. On January 26, 2000 High Country Engineering, Inc. (HCE) received information indicating that the existing system had been permitted forth= `% bedrooms via 22 Infiltrator units in a trench configuration providing an absorption area of 792 sf. This area was originally calculated using an Infiltrator absorption area of approximately 18.0 sf per unit. Present regulations only allow for an absorption area of 15.5 sf per unit, which would reduce the existing. effective absorption area to 682 sf. Therefore, under present regulations, three additional units would be required to meet present demand. Using site plan information provided by Mr. Bones, it appears that it may not be possible to install a third trench on the site. Since the existing system functions properly under existing conditions, HCE recommends that the trench absorption system be expanded by=severe Infiltrator` units (the number of units required to serve one additional bedroom under present design standards).
