A. Nielsen Construction Company FILE NO: - ZS- 214 -85 -A WHEREAS, Bruce Nielsen did file an application to amend the existing special use permit approved November 28, 1984 , File No. ZS- 214 -84, with the Eagle County Department of Community Development on or about June 13, 1985 , within the Resource Zone District; and WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on July 23 , 1985; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was provided as re- quired by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That the proposed amendment to Special Use Permit No. ZS- 214 -84 conforms to the requirements of Section 2.09 of the Eagle County Land Use Regulations. 3. That the proposed land use will be compatible with existing uses in the area. 4. That for the above - stated and other reasons, the proposed zoning is in the best interest of the health, safety, morals, convenience, order, pro- sperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of the County of Eagle, State of Colorado: That the application of R. A. Nielsen Construction Company , File No. ZS- 214 -85 -A for amendment to Special Use Permit ZS- 214 -84 to allow a temporary caretaker's unit at the previously permitted sawmill within the Resource Zone District in the following described unincorporated area of Eagle County be approved: See Attached THAT the following conditions shall be placed upon this amendment and that violations of any condition shall be the basis for revocation of the permit or the amendment: 1) The caretaker's unit be of a temporary nature only, and if a permanent structure is to be built on the site, you would need further approval from the Board of County Commissioners. 2) That a County approved and permitted well and septic system be installed by July 1, 1986. 3) Any expansion or additional activity on this site will require a request for a formal amendment. THAT the Board of County Commissioners directs the Department of Community Development to provide a copy of this Resolution to the applicant.
