I believe that I have shown the following items have been met with the site plan. 1)The access is provided already off Brush Creek Road with the current driveway. 2) Town of Eagle water will be provided. 3) With the addition of a new septic, the current system of disposal of waste water has been solved. 4)The location provides adequate space from the creek, water easement, and current structures. 5)And lastly the location provides 2 additional parking spaces for this unit. RECEIVED MAR 15 2006 1) To Officially petition the Town of Eagle for completion of my 2/3 water tap that I purchased in November 1999 for my caretakers unit. 2) To officially request the Town of Eagle to abandon the current water easement through my property at 2821 Brush Creek Road. 3) To dedicate a new water easement 10 feet wide that would fall concurrent with Brush Creek Road and be within the Is' 10 feet of the 50' improvements setback off Brush Creek Road. Water Tap History: In November 1999, I requested a building permit from the County to build a caretakers unit. My request was granted pending an additional water tap from the Town of Eagle. In petitioning the Town for my additional water tap, both Willie Powell and Larry Mackenzie suggested I would only need to purchase a 2/3's water tap since my caretakers unit was limited to 850 sq feet and fell under the multi family residential unit application. At their suggestion, I purchased a 2/3's water tap at a price of $1600 plus other misc. fees. A full water tap at that time was, I believe, $2400. Current: That decision has now come back to haunt me. I wish to subdivide my property of 3.83 acres into 2 parcels. My immediate neighbors (current owners along Brush Creek Road excluding Eagle Ranch) have all given me an OK to subdivide (Please see the attached letter, Scott Skelton will be submitting a letter shortly, Kraig Kinney did not submit a letter due to possible conflict of interest) I have also had a verbal ok from the County but will have to go through the process of subdivision. The process necessitates securing the water first. So my 2/3's water tap is now holding me up. I must have 2 full water taps to complete my basic water needs with the county. So I am formally requesting 1/3 water tap to complete my current 1 and 2/3 water taps. If necessary, I will complete that water tap at current price levels. Concerns: I appreciate your consideration of my request. I also understand your possible concerns with setting a precedence for future subdivisions along Brush Creek Road. However, there are 4 reasons that I believe should help convince you to grant me my request. 1) I should not currently be penalized from future development of my property within County parameters based on a decision I made 6 V2 years ago. That decision was totally based on a recommendation from Town Staff to purchase a 2/3 or incomplete tap. 2) I have in the past and continue to pay the same monthly amount for water for a 2/3 tap that I do for my full tap on the same piece of property. My water needs are usually the monthly minimum fees for water for both taps from their inception. Seems inappropriate that equal usage and billing would not create equality for the taps. 3) I do not wish to be annexed to the town at this time. I believe that you have the ability to grant me the 1 /3 water tap based on the above information with out making annexation an issue. I see no benefit to me outside the water tap and certainly see no benefit to the town. I am a separate property on a county road and it would require trash pickup, plowing, and town services to be provided to me in the middle of other county properties. 4) And lastly and probably the most compelling is that my current situation is basically a different scenario than other current owners along Brush Creek Road. I do not need a new water tap. I only need to complete the tap that I already own. By granting me an additional 1 /3 water tap now, you would, in effect, be housekeeping, or completing a tap that could have been or should have been a full tap when granted 6 %2 years ago. Because of these reasons, and the technicality they created, I believe that you would have the ability to protect your right to not set a precedence selling new water taps. That is until and if, you so choose to allow future property development by smaller owners that are county and not town along Brush Creek Road.
