Me, 13 11 25 a Commissioner 6j210_si moved adoption of the following Resolution- BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. PLANNED UNIT DEVELOPMENT PLAN FOR ARROWHEAD AT VAIL WHEREAS, pursuant to §2.06.13 of the Eagle County Land Use Regulations, 1982, as amended, and §24 -67 -101, et seq., C.R.S., the Board of County Commissioners of the County of Eagle, State of Colorado (the "Board "), did, on June 30, 1983, adopt Resolution No. 83 -52 which approved the Planned Unit Development Plan for Arrowhead at Vail (the "Developer ") as recorded in Book 362 at Page 852 of the Real Property records of the County of Eagle, State of Colorado, and did adopt Resolution No. 83 -56 which approved the Administrative Amendment to the Planned Unit Development Plan for Arrowhead at Vail as recorded in Book 364 at Page 999 of the said Real Property records, and WHEREAS, the Board, at the request of the Developer, desires to amend the Planned Unit Development Plan for Arrowhead at Vail in order to change the building height in the following Development Areas: Development Area C The "MAXIMUM BUILDING HEIGHT: 20 or 25 feet, consult Design Guidelines for specific provisions" is changed to "MAXIMUM BUILDING HEIGHT: 30 or 35 feet, consult Design Guidelines for specific provisions" 7 Development Area E The "MAXIMUM BUILDING HEIGHT 20 or 25 feet: consult Design Guidelines for specific provisions" is changed to "MAXIMUM BUILDING HEIGHT: 30 or 35 feet, consult Design Guidelines for specific provisions" Development Area J The "MAXIMUM BUILDING HEIGHT: 20 feet" is changed to "MAXIMUM BUILDING HEIGHT, 30 or 35 feet, consult Design Guidelines for specific provisions ". NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the "Planned Unit Development Plan for Arrowhead at Vail" is hereby amended by the deletion of Pages 11, 13 and 15 thereof, and in its place and stead, the insertion therein of new Pages 11, 13 and 15 as set forth in Exhibit A attached hereto and incorporated herein by this reference. THAT, the aforesaid amendments shall be effective upon the recording of this Resolution in the Real Property records of the County of Eagle, State of Colorado. THAT, Resolution 83 -52 and Resolution 83 -56, as herein amended, are hereby readopted. THAT, the aforesaid amendment and readoption of Resolution No. 83 -52 and Resolution No. 83 -56 shall not constitute nor be construed as a waiver of any violations existing at the time of adoption of this Resolution. THAT, should any section, clause, provision, sentence, or word of Resolution No. 83 -52 and Resolution No. 83 -56, as amended by this Resolution and Exhibit A attached hereto, be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the aforementioned documents as a whole, or any parts thereof, -2- other than the part so declared to be invalid. For this purpose, the aforementioned documents are declared to be severable. No lot shall have more than two dwelling units constructed upon it and where two units are constructed, they shall be attached. The total buildig square footage on a lot shall not exceed 6,000 s.f., and when two units occur on a lot, one unit shall be less than 2,000 s.f. This review shall be processed according to the schedule imposed upon Type III applications, as described in section 2.25.03(3) of the Eagle County Land Use Resolution, and shall be to insure consistency with the intent and provisions of the approved Arrowhead at Vail Preliminary Plan, the P.U.D. Guide, and Arrowhead at Vail Declaration of Protective Covenants. (k) DEVELOPMENT AREA K USES: (aa) Winter and summer recreation including golf, ski touring, and bike and pedestrian trails.
