HomeMy WebLinkAboutR23-064 Resolution Supporting Ballot Issue 1A - Retaining Excess 2023 Lodging Tax Revenue DocuSign Envelope ID: 1519E41 F-3187-4B8A-9DE4-83861 D79BD50 Commissioner McQueeney moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2023- 064 A RESOLUTION SUPPORTING BALLOT ISSUE 1A—RETAIN EXCESS 2023 LODGING TAX REVENUE TO SUPPORT LOCAL WORKFORCE WHEREAS,the Board of County Commissioners for Eagle County("Board") is authorized by section 1-45-117(1)(b)(III)(A)to pass a resolution taking a position of advocacy on any local ballot issue; and WHEREAS, Eagle County faces a persistent and severe lack of quality and affordable childcare and housing for our local workforce; and WHEREAS, quality childcare and affordable housing are consistently identified as high priority needs in community surveys from our residents and business owners alike; and WHEREAS,Eagle County addressed these high priority needs by asking voters in 2022 to approve a two percent(2%) lodging excise tax on short-term rentals for the purposes of supporting our local workforce and quality of life by providing additional childcare programs and affordable housing opportunities; and WHEREAS,voters approved the 2022 question by a wide margin,providing a dedicated revenue stream to support our local workforce without having this tax borne by the same workforce. Instead, this tax would be paid by out-of-town visitors using short-term lodging in order to offset the impacts caused by a tourism-based economy; and WHEREAS,Article X, Section 20 of the Colorado Constitution requires ballot questions to state the first-year estimate revenue for any tax increase; and WHEREAS,the 2022 question authorized Eagle County to collect$3,000,000 commencing January 1, 2023, and whatever additional amounts are raised annually thereafter from this lodging tax on short-term rentals; and WHEREAS,Eagle County now anticipates collecting more than the estimated $3,000,000 in 2023 and desires to follow voter-intent by retaining and spending any additional amounts collected above the $3,000,000 estimate for the same purposes of supporting our local workforce and quality of life; and WHEREAS,the Board placed Ballot Issue lA on the November 7, 2023 ballot as part of the county's continuing efforts to provide more quality childcare and affordable housing opportunities by utilizing ALL revenue derived from this tax towards these efforts; and DocuSign Envelope ID: 1519E41F-3187-4B8A-9DE4-83861D79BD50 WHEREAS,Ballot Issue lA does not impose any new taxes or increase any existing tax. Rather, it allows Eagle County to retain all 2023 revenue collected from the 2%lodging tax on short-term rentals already passed by the voters in 2022; and WHEREAS,all but one of our local municipalities currently have their own lodging tax in place, including Avon,Basalt, Eagle, Minturn,Red Cliff, and Vail. The County's lodging tax does not apply in municipalities already collecting their own lodging tax; and WHEREAS,the Board supports continued efforts to assist those who live and work in Eagle County; and WHEREAS,the Board supports utilizing ALL 2023 revenue from the prior-approved lodging tax to help alleviate and mitigate the impacts to our local workforce. NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS FOR EAGLE COUNTY: THAT,the Board hereby supports and encourages voters to approve Ballot Issue 1A.
