APPROVAL OF SPECIAL USE PERMIT - Holy Cross Electric Association
115 KV Sub - Transmission Line
from Beaver Creek Substation to
the Avon Substation
FILE NO: - ZS- 247 -86
WHEREAS, Holy Cross Electric Association did file an
application with the Eagle County Department of Community
Development on or about December 24, 1986, within the Resource
and Commercial General Zone Districts; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado,
on April 14, 1987; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of Eagle
County, comments of the Eagle County Department of Community
Development, comments of public officials and agencies, the
recommendation of the Eagle County Planning Commission, and
comments from all interested parties, the Board of County
Commissioners of the County of Eagle, State of Colorado, finds
as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the Planning
Commission and the Board of County Commissioners.
2. That the proposed special use conforms to the
requirements of Section 2.09 of the Eagle County Land Use
Regulations.
3. That the proposed land use will be compatible
with existing uses in the area.

4. That for the above - stated and other reasons,
the proposed zoning is in the best interest of the health,
safety, morals, convenience, order, prosperity and welfare of
the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners of the County of Eagle, State of Colorado:
That the application of Holy Cross Electric
Association, File No: ZS- 247 -86, for approval of a special use
of a 115 KV Sub - Transmission Line within the Resource and
Commercial General Zone Districts in the following described
unincorporated area of Eagle County be approved:
See Attached Legal Description - Exhibit A
THAT the following conditions shall be placed upon
this approval and that violation of any condition shall be the
basis for revocation of the permit:
1. The applicant must provide Eagle County with a
written statement from the United States Forest Service which
grants the applicant permission to proceed with the county
permit on National Forest land.
2. The mitigation defined in the United States
Forest Service Environmental Assessment must be implemented.
3. The applicant must provide Eagle County with a
signed copy of the agreement with the Nottingham Ranch Co.
THAT the Board of County Commissioners directs the
Department of Community Development to provide a copy of this
Resolution to the applicant.

A 115 KV transmission line easement one hundred (100) feet in
width located in Sections 5, 6, 8, 9, and 16, Township 5 South,
Range 81 West of the 6th P.M., the centerline for said easement
is more particularly described as follows:
Beginning at a point on the west line of said Section 6, said
line is also the easterly boundary of the Town of Avon, from
which point the southwest corner of said Section 6 bears S000161E
a distance 609 feet, more or less; thence S59 °561E a distance
1077 feet, more or less, to a point 50 feet north of the south
line of said Section 6; thence N880491E a distance 4983 feet,
more or less, to a point 100 feet southwest of an existing 115KV
transmission line centerline; thence S650451E parallel to and 100
feet southwesterly of the existing 115 KV transmission line
centerline a distance 3984 feet, more or less; thence S610561E
parallel to and 100 feet southwesterly of the existing 115 KV
transmission line centerline a distance 4892 feet, more or less
thence, departing said existing 115 KV transmission line
centerline S580171W a distance 805 feet, more or less; thence
S510561W a distance 2136 feet more or less; thence S100031W a
distance 795 feet, more or less, to a point on the north property
line of Holy Cross Electric's Substation property, from which
point the northwest corner of said Section 16 bears N26 °231W a
distance 968 feet, more or less.
