ZONE DISTRICT AMENDMENT - Shepard Minor P.U.D.

WHEREAS, Terrill I {night for Suzanne Shepard did file
an application with the Eagle County Department of Community
De.velopment on or about December 1, 1986, to rezone the herein
described property in Eagle County from Resource Zone District
to Planned Unit Development Zone District; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado,
on march 30, 1987; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the piaster Plan for the unincorporated areas of Eagle
County, comments of the Eagle County Department of Community
Development, comments of public officials and agencies, the
recommendation of the Eagle County Planning Commission, and
comments from all interested parties, the Board of County
Commissioners of the County of Eagle, State of Colorado, finds
as follows:

1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commission and the Board of County Commissioners.
2. That the proposed zoning is consistent with
the Eagle County ?Master Plan.
3. That the area in question possesses the geo-
logical, physical, and other environmental conditions
compatible with the characteristics of the use requested.
4. That the advantages of the use requested
outweigh the disadvantages.
5. That the area for which the rezoning is
requested has changed or is changing to such a degree that
it is in the public interest to encourage a new use or
density in the area.
6. That the proposed rezoning is necessary in
order to provide land for a demonstrated community need.
7. That for the above stated reasons, the proposed
zoning is in the best interest of the health, safety,
convenience, order, prosperity and welfare of the citizens
of Eagle County, Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of
County Commissioners of the County of Eagle, State of
Colorado:
THAT the petition of Terrill Knight, for Suzanne
Shepard, file number PD- 265 -86 -P, for a zoning amendment to
change from Resource Zone District to Planned Unit
Development Zone District be and is hereby approved
for the following described property located in the
unincorporated area of Eagle County:
See attached legal description.
THAT the Board of County Commissioners directs
the Director of the Department of Community Development
to enter this amendment on the appropriate page of the
Official District Map and record the change in the office
of the Eagle County Clerk and Recorder.
MOVED, READ AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado,

SHEPARD MINOR PLANNED UNIT DEVELOPMENT
LEGAL DESCRIPTION
A parcel of land in Lot 7, Section 2 and Tract 37, Sections 1 and 2,
Township 5 South, Range 83 West of the Sixth Principal Meridian, Eagle County,
Colorado according to the Independent Resurvey of said Township and Range
approved by the U.S. Surveyor General in Denver, Colorado on June 20, 1922,
said parcel being more particularly described as follows, to wit:
Beginning at Corner No. 2 of Tract 37, said Township and Range; thence along
the Northerly line of Tract 37 to its intersection with the Northwesterly
Right- of -Wav line of Eagle County Road No. S-23A; thence along said
Right -of -Way in a Southwesterly direction to the intersection with the
Northwesterly Right -of -Way line of Eagle County Road No. S -23B; thence along
said Right -of -Way in a Southwesterly direction to the intersection with the
South line of Lot 7; thence along the Southerly line of Lot 7 to the Southwest'
Corner of Lot 7; thence along the West line of Lot 7 to the Northwest Corner;
thence along the North line of Lot 7 to the intersection with the West line of
Tract 37; thence along the West line of Tract 37 to Corner No. 2 of Tract 37;
the point of beginning.
