HomeMy WebLinkAboutR1965-07 Service Plan for Vail Metropolitan Recreation District RESOLUTION Dated October 5, 1965 4111 RESOLUTION OF BOARD OF COUNTY COMMISSIONERS IN AND FOR THE COUNTY OF EAGLE, STATE OF COLORADO, APPROVING THE SERVICE PLAN FOR THE PROPOSED VAIL METROPOLITAN RECREATION DISTRICT PURSUANT TO THE AUTHORITY CONTAINED IN HOUSE BILL NO. 1056 PASSED BY THE 45th GENERAL ASSEMBLY, SESSION LAWS, RELATING TO THE FORMATION OF LOCAL IMPROVEMENT AND SERVICE DISTRICTS UNDER CHAPTER 89 , COLORADO REVISED STATUTES, 1963, AND REFERRED TO AS THE "SPECIAL DISTRICT CONTROL ACT". WHEREAS, a service plan as defined in the captioned act was heretofore filed with the Board of County Commissioners by the petitioners of the proposed Vail Metropolitan Recreation District in accordance with the provisions of the Special District Control Act, and which boundaries of said proposed district being entirely within the County of Eagle and State of Colorado, and . WHEREAS, the Board of County Commissioners, upon the filing of the service plan, provided written notice in accordance with the provisions of the Special District Control Act, and published legal notice of the date, time, location and purpose of such hearing in a newspaper of general circulation within the County of Eagle once each week for a period of three successive weeks by three publications, the first of which was at least 20 ys prior to the date of hearing, and WHEREAS, a public hearing was held by the Board of County Commissio ers on October 5, 1965, which hearing was open to the public and a transcript of proceedings was made, and WHEREAS, at such public hearing all interested parties as defined in the Special District Control Act were afforded an opportunity to be heard, and all testimony or evidence relevant to the formation of the proposed district was considered, and WHEREAS, at such public hearing the County Planning 4 411 Commission, having studied such service plan, through its repre- sentative presented its recommendations to the Board of County Commissioners, and 411 WHEREAS, evidence and testimony was presented to the Board of County Commissioners, NOW THEREFORE, the Board of County Commissioners makes the following findings based solely upon the service plan and evidence presented. at the hearing by the petitioners, County Planning Commission, and all interested parties: 1. There is sufficient existing and projected need for organized services in the area to be serviced by the proposed district. 2. The existing service in the area to be served by the oposed district is inadequate for present and projected needs. 3. Adequate service is not now, nor will it be, available to the area through municipal annexation by other existing municipal or quasi-municipal corporations within a reasonable time and on a comparable basis. 4. The proposed special district is capable of providing economic and sufficient service to the area within its proposed boundaries. 5. The area to be included in the proposed district has or will have the financial ability to discharge the proposed in- debtedness on a reasonable basis. 6. The facility and service standards of the proposed • district are comparable with the facility and service standards of adjacent municipalities and special districts. THEREFORE BE IT RESOLVED, that the service plan filed with the Board of County Commissioners and attached hereto as { Addendum "A" , is hereby approved without condition or modification.
