HomeMy WebLinkAboutR87-22 Amendment to Beaver Creek PUDa y Commissioner 6JL7,CN moved adoption of the following Resolution: COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 87 IN RE THE MATTER OF THE APPLICATION OF VAIL ASSOCIATES, INC., FOR AMENDMENT OF THE BEAVER CREEK PLANNED UNIT DEVELOPMENT - FILE NO. PD- 100- 87 -A4. WHEREAS, on or about January 19, 1987, the County of Eagle, State of Colorado, accepted for filing an application submitted by Vail Associates, Inc. (hereinafter "Applicant ") for amendment of the Beaver Creek Planned Unit Development (hereinafter the "P.U.D. "), File No. PD- 100- 87 -A4; and WHEREAS, the Applicant requested the amendment of the P.U.D. for the purposes of: a) permitting the creation of the Eleventh Filing, Tract U, as a new Resort Commercial Tract; b) changing the use of Tract E, Fifth Filing, from Residen- tial Medium Density to Resort Commercial; c) changing the use of Tract G, Fifth Filing, from Residential Low Density to Resort Commercial; and d) changing the use of Tract R, Fifth Filing, from Resort Services to Resort Commercial; and WHEREAS, notice was duly published in a newspaper of general circulation throughout the County on January 22, 1987, concerning the subject matter of the application and setting forth the dates and times of hearings for consideration of this matter by the Eagle County Planning Commission and the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter the "Board "); and WHEREAS, notice of said hearings was also mailed to all property owners and adjacent property owners of the P.U.D.; and WHEREAS, at its public hearing of February 18, 1987, the Planning Commission, based upon its findings, recommended approval of the proposed P.U.D. amendment; and WHEREAS, at its regular hearing of February 24, 1987, the Board considered the Application as well as evidence in the form of sworn testimony and exhibits introduced and admitted into the record. t Based on the evidence before it, THE BOARD FINDS AS FOLLOWS: 1. The proposed amendment to the Beaver Creek P.U.D., File No. PD- 100- 87 -A4, is consistent with the Eagle County Master Plan. 2. The areas in question possess the geological, physical and other environmental conditions compatible with the charac- teristics of the requested use. 3. The advantages of the requested use outweigh its disadvantages. 4. The land has access to and can be serviced with appropriate water and sewage disposal systems. 5. The area for which the amendment is requested has changed or is changing to such a degree that it is in the public interest to encourage a new use for diversity in the area. 6. The proposed amendment is necessary in order to provide land for a demonstrated community need. 7. The proposed amendment conforms to the Eagle County Land Use Regulations subject to a plat restriction being placed on Tract R for the purpose of limiting its use as resort commer- cial to the construction and development of an international art center. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application of Vail Associates, Inc., for amendment to the Beaver Creek Planned Unit Development, File No. PD- 100- 87 -A4, be approved subject to the plat restriction on Tract R described below. THAT, the creation of the Eleventh Filing, Tract U, as a new resort commercial tract be and is hereby approved. THAT, the change of use of Tract E, Fifth Filing, from residential medium density to resort commercial be and is hereby approved. THAT, the change of use of Tract G, Fifth Filing, from residential low density to resort commercial be and is hereby approved. THAT, the change of use of Tract R, Fifth Filing, from resort services to resort commercial is approved subject to -2- the placement of a plat restriction on Tract R requiring that the land may only be used for an international art center. THAT, the Board finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
