APPROVAL OF SPECIAL USE PERMIT - Michael Walck DBA as
K -W Partnership
FILE NO: - ZS- 246 -86
WHEREAS, Michael Walck DBA K -W Partnership did file
an application with the Eagle County Department of Community
Development on or about October 14, 1986, within the Resource
Zone District; and
WIiEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado,
on December 22, 1986; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of Eagle
County, comments of the Eagle County Department of Community
Development, comments of public officials and agencies, the
recommendation of the Eagle County Planning Commission, and
comments from all interested parties, the Board of County
Commissioners of the County of Eagle, State of Colorado, finds
as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the Planning
Commission and the Board of County Commissioners.
2. That the proposed special use conforms to the
requirements of Section 2.09 of the Eagle County Land Use
Regulations.
3. That the proposed land use will be compatible
with existing uses in the area.

4. That for the above stated and other reasons, the
Proposed zoning is in the best interest of the health, safety,
morals, convenience,; order, prosperity and welfare of the
citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT the application of Michael Walck DBA D -W Partnership,
File No: ZS- 246 -86„ for approval of a special use of land
application of stabilized sewage sludge within the Resource Zone
District in the following described unincorporated area of Eagle
County be approved:
See attached Exhibit C for Legal Description.
THAT the following conditions shall be placed upon this
approval and that violation of any condition shall be the basis
for revocation of the permit:
Prior to spreading stabilized sewage sludge on this
site, the following information and conditions must be addressed:
1. A drainage plan must show that sludge leachate will
not discharge off the site.
2. Clarification of the yearly sludge spreading plan.
This plan must describe the sludge spreading and irrigation
schedule on a month to month basis.
3. Implementation of a special drinking water monitoring
program for the Green Acres P:Iobile Home Park. This monitoring
program should be developed and coordinated with the Colorado
Department of Health.
4. Colorado Department of Health, Water Quality Control
Division approval must be granted prior to sludge spreading.
5. A 2,000 foot buffer must be maintained between the
application site and the nearing Town of Eagle boundary.
6. Land application of stabilized sewage sludge must
be applied so as not to cause a public nuisance.
7. The annual review must be conducted with a public
hearing.

THAT the Board of County Commissioners directs the
Department of Community Development to provide a copy of this
Resolution to the applicant.
