HomeMy WebLinkAboutR1972-20 Vacation of Roadways Buffer Creek - Resubdivision/ T • • • RESOLUTION OF THE BOARD 410 • WHEREAS , Colorado Revised Statutes , 120-14-3 , 1963 provides for the vacation of roadways situated in any county, but not within the limits of any city or town, by the Board of County Commissioners of the County; and WHEREAS, the Board of County Commissioners of Eagle County has found and determined that the public use, convenience and necessity do not require that a certain described portion of Buffer Creek Road be used as a public roadway; now therefore, BE IT ENACTED BY THE BOARD OF COUNTY COMMISSIONERS OF EAGLE COUNTY, COLORADO: Section 1. That the following described portion of Buffer Creek Road in the County of Eagle, State of Colorado, to wit: A parcel of land situate in the subdivision on record in the office of the Eagle County Clerk and Recorder under the name "Resubdivision of Buffer Creek - Resubdivision of Parts of Section 11 and 12, Township 5 South, Range 81 West of the 6th Principal Meridian, County of Eagle, State of Colorado" , being more particularly de- scribed as : Beginning at a point on the easterly 111 line of Buffer Creek Road whence the NW corner of Lot 20 of Resubdivision of Buffer Creek bears N 20°38' 43" W 25. 03 feet; thence S 20°38 ' 43" E 46. 22 feet along said easterly line of Buffer Creek Road; thence S 82029 ' 09" W 10. 50 feet; thence N 07°30 ' 51" W 45. 01 feet to the point of beginning, containing 236. 30 square feet or . 0054 acres , more or less. The bearings in this descrip- tion originate from the call of East (for the North line of Resubdivision of Buffer Creek) existing in the dedication legal description on the recorded plat of Resubdivision of Buffer Creek, be and the same is hereby vacated and declared vacated. Section 2. The Board finds this Resolution is necessary for the immediate preservation of the public safety, and deter- mines that it shall take effect immediately upon its final passage. •
