HomeMy WebLinkAboutR1976-11 Department of Health - Shenandoah Trailer Park near Basalt • • BOARD OF COUNTY COMMISSIONERS EAGLE COUNTY, COLORADO WHEREAS, the resolution enacted 26 February 1976 by the Board of County Commissioners, a true copy of which is attached hereto as Exhibit "A" , and incorporated by reference, was enacted pursuant to the recommendation of County Attorney Robert J. Stemwedel, Jr. ; and WHEREAS, the County Attorney has in the interum requested the Executive Director of the Department of Health to proceed in the matter; NOW, THEREFORE, IT IS RESOLVED THAT the said resolution enacted 26 February 1976 is hereby declared null and void. • Approved this 1st day of March, 1976 Dale F. Kopri ikar, Commissioner Oflo444#5:oner Attest: titi,e�� r5JI1; Maxwell Ba z, C unty Clerk and corder X11tb� • BOARD OF COUNTY COMMISSIONERS EAGLE COUNTY, COLORADO WHEREAS, Dr. Thomas Steinberg has been serving in the function and capacity of Public Health Officer for Eagle County, Colorado; and WHEREAS, the District Attorney's Office has after amicable informal discussion with the County Commissioners, the County Health Officer and the County Attorney agreed that legal action against Eagle County health and sanitation violations (state and county) particularly those violations occurring at a place known as the Shenandoah Trailer Park should be acted upon by special counsel employed by the County Public Health Officer and approved by the Board of County Commissioners; and • WHEREAS, the County Attorney, Robert J. Stemwedel, Jr. is 111 amenable to appointment as "special counsel" as defined by CRS 25- 1-512 1973 as amended and for the purpose of proceeding against violation of any and all public health and sanitation laws that have or are occurring at a place known as the Shenandoah Trailer Park near Basalt, Colorado and in the County of Eagle; NOW, THEREFORE, IT IS RESOLVED THAT Dr. Thomas Steinberg is designated Public Health Officer of and for Eagle County, Colorado. IT IS FURTHER RESOLVED THAT Robert J. Stemwedel, Jr. is ap- proved as special counsel to be employed by the Public Health Officer and to initiate and prosecute legal proceedings against 411 any and all violations of public health and sanitation laws en- forceable by the County which have or may be occurring at a lo- cation in Eagle County known as the Shenandoah Trailer Court. •o Approved this 26th day of Febr ry 1976 \lr Glt2, Da .
