Lamm DEPARTMENT OF LOCAL AFFAIRS Betty Miller Governor 1550 Lincoln St., Room 208, Denver, Colorado 80203 Executive Director 303-892-2771 July 2, 1975 TO: All County Commissioners: Introduction The purpose of this letter is to indicate as clearly as possible what is required for continued participation in the H.B. 1041 program. Department policies for 1975-76 will place stronger emphasis on city, county, regional cooperation and continue to emphasize closer liaison between municipal and county work efforts. The Department continues to stress that the identification and designation program be coordinated with comprehensive planning programs of local governments, and that identification program information be included within local comprehensive plans. Revised Technical Bulletin No. 4 is being forwarded to your County Land Use Administrator. It will be used by the Department of Local Affairs to continue monitoring local work programs and to provide assistance leading to performance of work efforts. Participation in H.B. 1041 Program Each county must submit a resolution indicating its desire to continue activities under H.B. 1041 (see enclosed sample resolution) by August 8, 1975. The 1974-75 work plan should be modified to indicate 1975-76 work activities in accordance with this letter and Revised Technical Bulletin No. 4. Work programs are to be submitted by August 30, 1975. Each county will receive a base grant of $25,000 in two phases as follows: $5,000 upon receipt by the Department of Local Affairs of an acceptable county resolution indicating agreement of the county to continue participation in the H.B. 1041 program. $20,000 upon receipt by the Department of Local Affairs of an acceptable updated work plan outlining county H.B. 1041 program activities based on requirements in this letter and Revised Technical Bulletin No. 4. -2- Use of Base Funding and Budget It should be understood that moneys received under H.B. 1041 may not be used simply for ordinary administrative expenses by local govern- ments. The basic appropriation can be utilized for: a. Salaries of personnel directly involved with the perfor- • mance of H.B. 1041 activities (only for time expended on 1041 activities). b. Day-to-day office and operating expenses for H.B. 1041 purposes. c. H.B. 1041 capital outlay expenditures not to exceed $500. Basic capital outlay needs should have been met in 1974-75. If capital outlay expenses exceed $500, they must be approved by the Department of Local Affairs. d. Travel not to exceed five percent of the basic grant for H.B. 1041 efforts unless there are unique locational or work effort factors in relationship to Denver or COG regional offices. e. For the identification/designation program of the county and municipalities, integration of the identification program with local planning programs and H.B. 1041 related comprehensive planning activities. This includes con- sulting fees for specialized services including legal fees, and contractual arrangements with regions or other governmental entities, leading to implementation of the program. A detailed budget based on local governmental budget laws must be sub- mitted in the updated work plan for the use of the base funding. The budget and work plan must specify whether the funds, or any portion of them, will be transmitted to a regional organization and whether funds will be used for county planning staff, municipal staff or consultants. Minimum Work Requirements for 1975-76 Each county must accomplish the following work by June 30, 1976: • • -3- a. Identification of all potential matters of State interest in immediate development pressure areas must be completed. The Department of Local Affairs encourages local governments to pursue their respective identification priorities, but continues to stress the identification of floodplain, wildfire and geological hazard areas, and • mineral resource areas. A new requirement for 1975-76 will be to conduct a preliminary inventory of the adequacy of solid waste disposal sites. b. Regulations relative to the management of flood hazard, geological and wildfire hazard areas and mineral resource areas must be adopted or incorporated into existing local regulations. If these regulations are not applicable to or appropriate for a jurisdiction, documentation must be provided stating the reasons for such. The Department will require submission of one copy of maps, resolutions or other documentation of completed work elements for 1975-76. The H.B. 1041 field representative assigned to your county under the Department of Local Affairs will be available to assist in updating your work plan. "Land Use Supplemental Planning, The Appropriation of General Fund Moneys is contingent upon being matched by local government funds or new in-kind efforts of equal amounts. The combined funds shall be used to purchase supplemental planning services by any local government providing the matching funds. In the event that less than $500,000 of local funds are made available, the general fund amount shall be reduced accordingly. " 37/ "Further funding of any county is contingent upon adopting, by June 30, 1976, regulations relative to flood- plain hazards, geological hazards, wildfire hazards, and mineral resources, where appropriate and also, con- ducting a preliminary inventory of the adequacy of solid waste disposal sites. " 11,4 . • • (SAMPLE) BEFORE THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF • STATE OF COLORADO • WHEREAS, this Board has received a letter dated July 2, 1975, from the Executive Director, Department of Local Affairs, setting forth requirements of counties for eligibility for financial assistance pursuant to H.B . 1041 (1974), and WHEREAS, this county will continuo to participate in the program and to fully comply with the requirements of H.B. 1041 to effectuate proper planning within this county. NOW, THEREFORE, BE IT RESOLVED that: • 1 . This County will make the program of identification and designation of appropriate matters of state interest a part of this county's comprehensive planning program. 2. This County will meet and continue to pursue standards established by the Department of Local Affairs relative to scope, detail, accuracy and comparability and to meet deadlines in accordance with • the work program. 3. This County will submit a detailed, updated work plan in compliance with the requirements of said letter and Revised Technical Bulletin No. 4 indicating how financial and technical assistance will be used for identification and designation of matters of state interest within the territory of the county, including all municipalities. ***This Resolution should be returned to the Department of Local Affairs, Room 208, 1550 Lincoln, Denver, Colorado 80203, after Commissioner's signature.
