RESOLUTION
OF THE
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 88-
FILE NO. ZS- 266 -88 -J
APPROVAL OF SPECIAL USE PERMIT - Eagle County Daycare Association
and Darlene Pena did file an
application with the Eagle County Department of Community Development on
or about March 1, 1988 within the PD Zone District; and
WHEREAS, after proper publication and public notice, a Public
Hearing was held by the Board of County Commissioners on April 26, 1988;
WHEREAS, based on the evidence, testimony, exhibits, study of the
Master Plan for the unincorporated areas of Eagle County, comments of
the Eagle County Department of Community Development, comments of the
Eagle County Planning Commission, and comments from all interested
parties, the Board of County Commissioners of the County of Eagle,
State of Colorado, finds as follows:
1. That proper publication and public notice was provided as
required by law for the hearing before the Planning Commission
and the Board of County Commissioners.
2. That the proposed special use conforms to the requirements
of Section 2.09 of the Eagle County Land Use Regulations.
3. That the proposed land use will be compatible with existing
uses in the area.
4. That for the above stated and other reasons, the proposed
zoning is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of the County of Eagle, State of Colorado:

That the application of The Eagle County Daycare Association
and Darlene Pena
File No. ZS- 266 -88 -J , for approval of a special use of a daycare
home within the PD Zone District in the following described
unincorporated area of Eagle County:
1782 Tahoe, Eagle County, Colorado
THAT the following conditions shall be placed upon this approval
and that violation of any condition shall be the basis for revocation
of the permit:
1. The permittee must be licensed by the State of Colorado through
the Eagle County Department of Social Services.
2. The permittee must keep the State license current or the
permit will expire.
3. The permit is valid only for the Eagle County Daycare
Association and Darlene Pena ,
at 1782 Tahoe, Eagle County, Colorado
A change in location or permittee will cause this permit
to expire.
THAT the Board of County Commissioners directs the Department of
Community Development to Provide a copy of this Resolution to the
applicant.
MOVED, READ AND ADOPTED by the Board of County Commissioners of
the County of Eagle, State of Colorado, at its meeting held on the
— day of 1988.
