BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 33-
VACATION OF TWO PORTIONS OF EXISTING EASEMENTS FOR
LOT 55, BLOCS: 1, EAGLE -VAIL FILING NO. 1
WHEREAS, pursuant to Section 43 -2 -301, et se q., C.R.S., and
Section 2.22 of the Eagle County Land Use Regulations, 1982, as
amended, the Board of County Commissioners of the County of
Eagle, State of Colorado (hereinafter the "Board"), has the power
and authority to vacate any public right -of -way Or easement
located entirely within the County of Eagle, State of Colorado:
and
WHEREAS, the Board recently received a request to vacate two
Portions Of existing easements for Lot 55, Block 1, Eagle -Vail
Filing No. 1 to allow for clear title to the property; and
WHEREAS, the County desires to abandon and vacate two
Portions of easements more particularly described in Exhibit A
attached hereto and incorporated herein by reference, said
portion no longer being necessary as part Of the County; and
WHEREAS, notice of the public hearings before the Eagle
County Planning Commission and the Board to consider the proposed
vacation of the subject easement was duly published in the Eagle
Valley Enterprise, and all affected governmental agencies
adjacent property Owners and public and private utilities Were
notified of the proposed vacation.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board finds that the proposed vacat ions will not
have a negative effect On the future use Of the easement, nor on
the use of any adjacent properties.
THAT, Upon the recording of this Resolution aIld the attached
Exhibits the Board hereby divests, relinquishes and vacates an`.•'
and all right's the public may have in the public easement
described in this Resolution and the attached Exhibit A.
THAT, the aforesaid vacation of the easem=- described in
EYhibit A shall not be construed as affecting In any Way
Whatsoever any and all existing recorded DrivaLe easements
necessary for Utilities or cther public services.

Beginning at a point on the southerly line of said Stone Creek Easement
whence the most easterly corner of Lot 55, Block 1 said Eagle -Vail Filing
No. 1 bears N 75 10'05"E 51.91 feet, said point of beginning also being a
point on the outline of an existing house; thence departing said easement
line 2 courses along said house outline .1) N20 31'00 "W 0.33 feet 2) S69
29'00 "W 0.30 feet to said easement line; thence departing said house
outline along said easement line S62 26'16 "E 0.45 feet to the point of
beginning containing .05 square feet more or less.

Easement whence the most southerly corner of said Lot 55 bears S15 01'31 "E
38.55 feet, said point of beginning also being a point on the outline of an
existing house; thence departing said easement line 3 courses along said
house outline 1) S69 29'00 "W 3.07 feet 2) N20 31'00 "W 20.40 feet 3) N69
5 29'00"E I'02 feet to said easement line; thence departing said house
outline along said easement line S26 14'33 "E 20.50 feet to the point of
beginning containing 42 square feet more or less.
