HomeMy WebLinkAboutR88-070 Expenditure for Unanticipated ContingenciesCommissioner - d! 6 A moved adoption of the foilowinv Resolution: BOARD OF COUNTY COMaISSIOMEa3 COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. @S.-___70 RESOLUTION AUTHORIZING THE EXPENDITURE FROM THE CONTINGENCY FUND FOR THE PAYMENT Or UNANTICIPATED CONTINGENCIES WHEREAS. the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter the Koard"), is involved in the following lawsuit in fiscal year 1982: Taylor V. Hisara, at al. U. s. _,ourz Civil Action No. S7 Cv 24 Professional Services to date: S8,168.91 WHEREAS, on May 14, 1988, the Board was notified of a re-bill regarding deposition of Robert V Taylor in the abov- mentioned lawsuit in the amount of one Hundran Fifty Three Dollars (8153.00) ; and WHEREAS, on April 12 balance due regarding legal lawsuit rendered by Greengard amount of Eight Thousand Rift and 1983. the Board was notified of a services for the above mentioned & Senter Atcorneys at Law in the aen Dollars and 91!100 (S8,015.91j; WHEREAS, the Board has determined that payment of Professional services of the aforementioned lawsuit require the expenditure of funds from the county's Contingency Fund TO cover such unanticipated expenses; and WHEREAS, the Board finds, deternin•s and declares that such expenditures could not have been reasonably foreseen and have unduly burdened the budgets of the Board of County Commis- sioners and the Attorney's office to the extent that with other anticipated expenditures it is not possible for said budgets to absorb the costs of the aforementioned unforeseen expenditures; and WHEREAS. the Board and budgeted and appropriated expenditures caused by an act some contingency that could not he time of,the adoption of the established the Contingency Fund, funds therein, to provide for Of God. or the public enemy, ol- have been reasonably foreseen at budge ,• and WHEREAS, the Board further finds, determines and declares that the aforementioned expenditures comply with the intent of the Contingency Fund and the provisions of Section 29- 1-114f 29-1-115 and 30-25-107, respectively, C•R•S.; and NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby authorizes the expenditure in the amount of Eight Thousand one Hundred Siyty-eight and 01/100 dollars (SS,i68.9!) from the Councy's Contingency Fund for the payment of the ampenses SPEcified heroin. THAT, pursuant to Section 29-1-114, 107 respectively, C.R.S., this Resolution, as 7ublisied in full one time in a newspa circulation within tho territorial limits Eagle, State of Colorado. 29-1-115 and 30-25- proposedl has been per having general of the County of THAT, the Eagle County Administrative Services Director is hereby requested ant directed to immediately transmit an original Cr certified copy of this Resolution to t he affected spending agencies and the officer Cr employee of the County of Eagle whose duty in is zo draw warrants Cr orders for the payment of money. THAT, the Eagle County Administrative Serv!Ceg Director is hereby further requested and directed to file an original or certified copy of this Resolution with the Division of Local Governments in the Department of Local Affairs. THAT, this Resolution is necessary for the public health, safety, and welfare of the County of Eagle, State of Colorado.
