BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 88- 6 6
APPROVAL OF SPECIAL USE PERMIT - MOBILE PREMIX
File No. 271 -88
WHEREAS, Mobile Premix did file with the Eagle County
Department of Community Development, on or about June 1, 1988, an
application for a Special Use Permit for operation of an asphalt
plant within the Resource Zone District; and
WHEREAS, based on the evidence, testimony, exhibits, study of
the Master Plan for the unincorporated areas of Eagle County,
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, the recommendation of
the Eagle County Planning Commission, and comments from all
interested parties, the Board of County Commissioners of the County
of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was provided
as required by law for the hearing before the Planning Commission
and the Board of County Commissioners.
2. That the proposed special use conforms to the
requirements of Section 2.09 of the Eagle County Land Use
Regulations.
3. That the neighborhood surrounding the existing gravel pit
which is proposed as the site for an asphalt plant will be
subjected to increased truck traffic, noise and dust during the
construction of Highway 82.
4. That the Blue Lake Gravel Pit will supply the necessary
gravel for asphalt paving to be completed on the Highway 82
regardless of where the asphalt plant is located.

5. By locating the asphalt plant within the gravel77Xpit,
efficiencies in noise, dust and truck traffic can be accomplished,
thereby reducing the impact of the highway construction project on
the neighborhood and other existing uses in the area.
6. Due to the temporary increase in noise, dust and truck
traffic during construction, the location of the asphalt plant
within the gravel pit is a use compatible with other uses in the
area during the highway construction project.
7. Access to and from the gravel pit is adequate. Location
of the asphalt plant at the gravel pit will minimize damage to
public roads caused by traffic related to the highway construction
project.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT the application of Mobile Premix, File No. ZS 271 -88.
within the Resource Zone District in the following described
unincorporated area of Eagle County be approved:
A parcel of land located in Lot 5 and in the
Northwest One - Quarter of the Southeast One - Quarter (NW-
1/4 SE 1/4) of Section 33, Township 7 South, Range 87
West of the Sixth Principal Meridian, Eagle County,
Colorado, being more particularly described as follows,
to wit:
Beginning at a point on the Northerly right -of -way
line of State Highway No. 82 whence a brass cap found in
place and properly marked for the Southeast Corner of
said Section 33 bears S50 059158" E. 2280.85 feet; thence
N00° 00101" 1515.00 feet; thence S 86 016151" E. 200.42
feet; thence S641 58' 59" E. 413.82 feet; thence 5220 04' 04"
E. 159.70 feet; thence S 40 050101" E. 214.11 feet; thence
5900 0010011 E. 35.00 feet; thence 5450 00'0011 E. 113.14
feet; thence S220 24119" E. 616.54 feet; thence 721.27
feet on the arc of a curve to the left having a radius
of 1018.00 feet, the chord of which bears S30 042123" W.
711.66 feet to the northerly right -of -way line of State
Highway No. 82; thence N72 010133" W. 800.00 feet along
said Northerly right -of -way to the point of beginning.
Said parcel of land contains 31.408 acres, more or less.

THAT the following conditions shall be placed upon this
approval and that violation of any condition shall be the basis for
revocation of the permit:
1. The term of the permit shall be limited to
three weeks' paving, beginning with the first day of
paving and ending no later than October 31, 1988.
2. The hours of operation are limited to 7:00 a.m.
to 7:00 p.m., Monday through Friday.
3. An environmental inspection must be performed
by the Eagle County Environmental Health Officer prior
to operations of the asphalt plant.
4. The applicant will notify thepl657XEnvironmental
Health Officer prior to commencement of construction.
5. During operations, noise and air quality tests
should be done.
THAT the Board of County Commissioners directs the Department
of Community Development to provide a copy of this Resolution to
the applicant.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the Count of Eagle, State of Colorado, at its regular meeting
held the day of July, 1988.
