the following Resolution:

WHEREAS, the Board of County Commissioners of the County of
Eagle, State of Colorado (hereinafter referred to as the "County "),
has a statutory interest in the annexation of the Town of Gypsum
(hereinafter the "Town "); and
WHEREAS, the Town is in the process of annexing property in
the Eagle County School District located at the eastern edge of Gypsum;
and
WHEREAS, pursuant to § 31 -12- 108.5, C.R.S., when a municipality
desires to annex an area of ten acres or more, it is required to
submit an impact report unless the municipality and the board of
county commissioners governing the area proposed to be annexed agree
that the report may be waived; and
WHEREAS, pursuant to § 31- 12- 108.5, C.R.S., the County desires
to waive the annexation for the impact report normally required for
the Town of Gypsum's annexation.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the County hereby waives the annexation impact report
for the Town of Gypsum's annexation of Eagle County School District
property.
THAT, the Board finds, determines and declares that this
Resolution is necessary for the public health, safety and welfare
of the citizens of the County of Eagle, State of Colorado.
