VACATION OF RIGHT-OF-WAY
COUNTY ROAD s
STATE OF r: RAD
WHEREAS, pursuant to § 43 -2 -301, et seq., C.R.S., and § 2.22
of the Eagle County Land Use Regulations, 1982, as amended, the Board
of County Commissioners of the County of Eagle, state of Colorado
(hereinafter the "Board "), has the power and authority to vacate
any public right -of -way or easement located entirely within the County
of Eagle, State of Colorado; and
WHEREAS, Eagle County Road S -3A is bounded on both sides by
property owned by Mr. Floyd Crawford, and the road right -of -way is
bounded on the west by Highway 82 and on the east by El Jebel Road
(Eagle County Road 5 -13).
WHEREAS, the County desires to abandon the current right -of-
way as the present road is not located in the right -of -way.
WHEREAS, notice of the public hearings before the Eagle County
Planning Commission and the Board to consider the proposed vacation
of the subject public right -of -way was duly published in the Eagle
Valley Enterprise and all affected governmental agencies, adjacent
property owners and public and private utilities were notified of
the proposed vacation.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board finds that the subject right -of -way is located
entirely within the County of Eagle and is not within the limits
of any city or town, and, further, that said right -of -way is no longer
necessary as part of the County road system.
THAT, upon the recording of this Resolution and the attached
Exhibit, the Board hereby divests, relinquishes and vacates any and
all rights it may have in the public right -of -way described in this
Resolution and the attached Exhibit A.

THAT, aforesaid vacation of the right -of -way described in Exhibit
A shall not be construed as affecting in any way whatsoever any and
all existing recorded easements necessary for utilities or other
public services.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County,of Eagle, State of Colorado, at its regular meeting

Legal Description
Vacation of County Road 3 -A
A parcel of land located in Tract 43, Section 3, Township 8
South, Range 87 West of the Sixth Principal Meridian, Eagle'County,
Colorado, according to the Independent Resurvey of said Township and
Range as approved by the U.S. Surveyor General in Denver, Colorado on
August 25, 1927; said parcel being more particularly described as
follows:
Beginning at a point on the Easterly boundary line of a private
parcel as described in Book 372 at Page 353 of the Eagle County
Records from which an aluminum cap and rebar re- establishing Corner
No. 1 of Tract 43 bears N.18 "21'23 "E. 109.12 feet distant; thence
along said private parcel the following three (3) courses:
1) N.09 0 51'00 "W. 30.00 feet, more or less
2) N.52 0 00 1 00 "W. 90.50 feet
3) N.89 "W. 270.00 feet, more or less
to a point on the Northeasterly Right -of -Way boundary of Colorado
State Highway No. 82; thence along said Northeasterly Right -of -Way
N.67 0 25'03 "W. 22.76 feet, more less; thence departing said
Northeasterly Right -of -Way N.89 0 47'00 "E. 368.98 feet, more or less,
to a point on the Westerly Right -of -Way boundary of Eagle County Road
S -13; thence along said Westerly Right -of -Way S.00 0 54'01 "W. 95.59
feet, more or less, to the point of beginning.
Said parcel contains 0.13 of an acre, more or less.

survey, and is not to be -used for conveyance purposes.
