installed as specified. Eagle County does not perform final

issued until our office receives this certification.

the information you set us regarding the construction of the ISDS for the Eagle County
Road and Bridge Department Northwest Shop Building, near McCoy.
According tc�..Ahe invoi e, one 1000 gallon septic tank, and one 1500 gallon septic tank were
delivered to the site or approximately December 21, 1995. Our design Ietter recommended a
500 gallon tank for tht grease/sand trap for the floor drain, and a 1500 gallon septic tank for

Dear Mr. Merry:
We have been requested by B & B Plumbing. to comment on the wastewater system for: the
proposed Eagle County Road and Bridge Northwest Shop. We understand that the county
does not wish to construct a conventional individual ,sewage disposal system for the site, but',
would rather construct a wastewater holding tank. We. also understand that the only usage at
the .site will' be ,by three employees who will only occupy the building intermittently. We
have been told that the county is proposing a 1500 gallon potable water supply cistern and a
_1500 gallon wastewater holding tank, both of which will be located adjacent to the westerly
side of the proposed building. In addition, a 500 gallon wastewater holding tank is planned
to be located inside the building to accommodate the floor, drain(s).
The three employees should have water usage similar to the CDOH "ISDS regulations
- category of "factories and plants, showers provided", which indicates 35 gallons per person,
per shift. In -this case, however, the employees would most likely not be in the building for
a full shift, and would be more careful with water consumption, since they would probably
be responsible for hauling it in to fill the cistern. Thus, we suggest that 20 gallons per,
person per day might be a better estimate. In that case, a 1500 gallon supply of water would
last approximately a month. Filling and emptying the tanks on'a monthly basis is probably
reasonable.

Construction and location, of the vaults will need to comply with the Eagle County ISDS.
Regulations, specifically, Section 4.0902, which requires- a signal device to indicate when
pumping is necessary, as well �as the sections which require tank access to be within 8" of.
finish grade, proper backfilling, setback distances from potable water; supply cisterns, as well
as other applicable sections. Consideration should also be given to the possibility of
installing an absorption area in the future. The impacts of surface drainage, setbacks,, future.
traffic, and storage -areas should all be evaluated.
However, we still question whether it might not be better to install a small ISDS, since the
shop, ocation is rather remote, and a licensed septic -tank pumper would probably have to,
make a special trip to the site to empty the wastewater holding tank. In contrast, _the.county.
likely already has the equipment necessary to haul waterto, the cistern, and an outside
contractor would not be required.

SUBJECT TO those rights for buried telephone line purposes as have been
granted to Eagle Telecommunications, Inc., its successors and assigns, by
right-of-way Colorado 27649 under the Act of February 15, 1901, as amended
(43 U.S.C. 959 (1988)) across lot 2 of section 9. T. 2 S., R. 84 W., Sixth
Principal Meridian, Colorado. The right-of-way is a valid existing right
unaffected by the partial repeal on October 21, 1976, of its authorizing Act

States if any such portion has been used for solid waste disposal or for any
other purpose which may result in the disposal, placement, or release of any
hazardous substance.

portion of the land not used for the purposes) specified in the application
and approved plan of development, the patentee shall pay the Bureau of Land
Management the fair market value, as determined by the authorized officer,
of the transferred.portion as of the date of transfer, including the value
of any improvements thereon.
Eagle Counter, its successors or assigns, assumes all liability for and shall
defend, indemnify, and save harmless the United States and its officers,
agents, representatives, and employees (hereinafter referred to in this
clause as the United States), from all claims, loss, damage, actions, causes
of action, expense, and liability (hereinafter referred to in this clause as
claims) resulting from, brought for, or on account of, any personal injury,
threat of personal injury, or property damage received or sustained by any
person or persons (including the patentee's employees) or property growing
out of, occurring, or attributable directly or indirectly, to the disposal
of solid waste on, or the release of hazardous substances from lot 2 of
section 9, T. 2 S., R. 84 W., Sixth Principal Meridian., Colorado, regardless
of whether such claims shall be attributable to: (1) the concurrent,
contributory, or partial fault, failure, or negligence of the United States,
or r2) the sole fault, failure, or negligence of the United States.

the information you sent us regarding the construction of the ISDS' for the Eagle County

According to the invoice, one 1000 gallon septic tank, and one 1500 gallon septic tank were
delivered to the site on approximately December 21, 1995. Our design letter recommended a
