BOARD OF COUNTY COMMISSIONERS
I COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 89 - , ?7
ZONE DISTRICT AMENDMENT - Oak Grove Townhomes
FILE NO. - PD- 256 -88 -P
WHEREAS, Basalt Trade Associates did file an application with the
_Eagle County Department of Community Development on or about August 23, 1988
to rezone the herein described property in Eagle County from Industrial to
Planned Unit Development Zone District, and;
WHEREAS, a public hearing was held by the Board of County Commissioners
of the County of Eagle, State of Colorado, on October 25, 1988 and;
WHEREAS, based on the evidence, testimony, exhibits, study of the
Master Plan for the unincorporated areas of Eagle County, comments of the
Eagle County Department of Community Development, comments of public
officials and agencies, the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, the Board of County
Commissioners of the County of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was provided as required
by law for the hearing before the Planning Commission and the
Board of County Commissioners.
2. That the proposed zoning is consistent with the Master Plan.
3. That the area in question possesses the geological, physical
and other environmental conditions compatible with the
characteristics of the use requested.
4. That the advantages of the use requested outweigh the
disadvantages.
5. That the area for which the rezoning is requested has changed
or is changing to such a degree that it is in the public
interest to encourage a new use or density in the area.
6. That the proposed rezoning is necessary in order to provide
land for a demonstrated community need.

7. That for the above stated reasons, the proposed zoning is in the
best interest of the health, safety, convenience, order,
prosperity and welfare of the citizens of Eagle County, Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of the County of Eagle, State of Colorado:
THAT the petition of Basalt Trade Associates file number PD- 256 -88 -P
for a zoning amendment to change from Industrial Zone District to
Planned Unit Development Zone District be and is hereby approved for the
following described property located in the unincorporated area of
Eagle County:
See attached legal description.
THAT the Board of County Commissioners directs the Director of the
Department of Community Development to enter this amendment on the
appropriate page of the Official District Map and record the change in
the office of the Eagle County Clerk and Recorder.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its meeting held the

KNCW ALL MEN BY THESE PRESENTS that Basalt Trade Associates, a
general partnership, and Duroux - Benboe, a limited partnership, owners
in fee simple, mortgagee or lienholder of all that real property situ-
ated in Eagle County, Colorado, described as follows:
A parcel of land situate in Tracts 52 and 58, Section 11, Township 8
South, Range 87 West of the 6th Principal Meridian being more particu-
larly described as follows:
Beginning at a point whence the witness corner to AP 3 of said Tract 52
bears S 44 °47 W 2129.56 feet; thence S 89 0 44'47" E 405.51 feet
along the south boundary of a tract of land described in Book 217 of
Page 986 of the records of the Clerk and Recorder of Eagle County,

containing 19.322 acres more or less, have by these present laid out,
platted and subdivided the same into lots and blocs as shown on this
Final Plat under the name and style of Basalt Industrial Park, Filing
No. 2, in the County of Eagle; and does hereby accept the
responsibility for the completion of required improvements; and does
hereby dedicate and set apart all of the public roads and other public
improvements and places as shown on the accompanying plat to the use of
the public forever; and does hereby dedicate those portions of said
real property which are indicated as easement on the accompanying plat
as easements for the purpose shown hereon; and does hereby grant the
right to install acid maintain necessary structures to the entity
responsible for providing the services for which the easements are
