COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 89- 33
CONCERNING SERVICE PLAN FOR THE EAGLE VALLEY
TV METROPOLITAN DISTRICT, EAGLE COUNTY, COLORADO
WHEREAS, a Service Plan, supplemental documents and a
processing fee has been filed relating to the proposed Eagle Valley
TV Metropolitan District in Eagle County, Colorado (hereinafter
"District "); and
WHEREAS, the provisions of Part 2 of the Special District Act
require that a public hearing be called and held within thirty (30)
days concerning the adequacy of the Service Plan; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
Section 1. That the Board of County Commissioners hereby
acknowledges that the District filed the Service Plan on March 2,
1989.
Section 2. That a public hearing on the Service Plan, as
filed, for the District, be called and the same is hereby set for
3:15 p.m. at the Eagle County Courthouse in Eagle, Colorado, the
regular meeting place for the Board of County Commissioners, on
Monday the 10th day of April, 1989.
Section 3. That the Clerk of this Board is hereby directed
to cause a notice of hearing to be published in the Eagle Valley
Enterprise, a newspaper of general circulation within the proposed
District, once each week for a period of three successive weeks,
by three publications, the first of which shall be at least twenty
(20) days prior to the date of hearing.
Section 9. That the Clerk is hereby further directed to
provide written notice of the hearing to the petitioners and to the
governing body of any existing municipality or special district
which is levied an ad valorem within the next precedingitax year
and which has boi.uhdaries within the radius of three (3) miles of
the proposed district.
Section 5. That said Notice shall be in substantially the
following form:

NOTICE OF HEARING
PUBLIC NOTICE IS HEREBY GIVEN that there were filed with
the County Clerk and Recorder of Eagle County, Colorado (the
"County "), a Service Plan and related documents for the proposed
Eagle Valley TV Metropolitan District (the "District "). The
service Plan and related documents are now on file in the office
of the County Clerk and Recorder and are available for public
inspection.
NOTICE IS FURTHER GIVEN that, by order of the Board of
County Commissioners of Eagle County, Colorado, a public hearing
on said Service Plan and related documents will be held at the
Eagle County Courthouse, 551 Broadway, Eagle, Colorado, at 3:15
p.m.,.on Monday, the 10th day of April, 1989.
The purpose of the hearing shall be to consider the
adequacy of the service Plan of the proposed District and to form
a basis. for adopting a resolution approving, conditionally
approving, or disapproving the Service Plan.
The proposed District is located entirely within the
County and generally includes all of that portion of Eagle County
along Interstate 70 and the Eagle River from Gypsum to East Vail
and the towns of Red Cliff and Minturn. The District is more
particularly described as follows:
BOUNDARIES OF THE EAGLE VALLEY TV METROPOLITAN DISTRICT
A parcel of land lying within Township 4
South, Ranges 82, 83, 84 and 85 West; and in
Township 5 South, Ranges 79, 80, 81, 82, 83,
84, and 85 West, and in Township 6 South, Range
80 and 81 West of the Sixth Principal Meridian,
Eagle County, Colorado, more particularly
described as follows:
Beginning at the Northeast corner ... ^_.f
Section 7, Tewnship 5 South, Range 79 West of
the Sixth Principal Meridian: thence southerly
along the East section lines of Section 7 and
18 to the southeast corner of said Section 18;
thence westerly along the south line of said
Section 18 to the southwest corner of said
Section 18, said corner being on the rangeline
between Ranges 79 West and 80 West; thence
continuing westerly along the south line of
Section 13, Township 5 South, Range 80 West to
the southwest corner of said Section 13; thence
northerly along the west line of Section 13 to
the section corner common to sections 11, 12,
13 and 14; thence westerly along the south line
of Sections 11, 10, 9, 8 and 7 to the southwest
corner of said Section 7, said corner being on
the rangeline between Ranges 80 West and 81
West; thence southerly along the rangeline
between Ranges 80 and 81 West to the southeast
corner of section 36, Township 5 South, Range
81 West, said corner being on the township line
between Townships 5 South and 6 South; thence
easterly along the north line of Section 1,
Township 6 South, Range 81 West to the
northeast corner of said Section 1; thence
southerly along the rangeline between Ranges
80 West and 81 West to the southeast corner of

Section 12, Township 5 South, Range 80 West,
said corner being on. the rangeline between
Range 80 and 79 West; thence continuing
easterly along the north line of Section 7 to
the northeast corner of Section 7, Township 5
South, Range 79 West of the Sixth Principal
Meridian and the Point of Beginning, containing
197.5 square miles, more or less.
Pursuant to Section 32 -1 -203 (3.5) , Colorado Revised
Statutes, as amended, any person owning property in the proposed
District may file a request that his property be excluded from the
proposed District prior to approval of the Service Plan. Such a
request must be submitted to the Board of County Commissioners no
later than ten (10) days prior to the day fixed for the public
hearing on the Service Plan.
Pursuant to Section 32 -1 -305 (3), Colorado Revised
Statutes, as amended, the owner of real property within the
proposed District may file a petition with the District Court in
and for Eagle County, requesting that such real property be
excluded from the proposed District. Such petition may be filed
any time after the petition for the organization of the District
is filed with District court, but not later than ten (10) days
before the day fixed for the hearing on the organizational
petition.

Section 6. That the Petitioners are hereby directed to
provide postcard notification of the hearing in accordance. with
Section 32 -1 -204 (1.5), C.P..S., to property owners within the
proposed District, as listed on the records of the County Assessor.
Section 7: That the Clerk is hereby further directed to
deliver a copy of the Service Plan to the County Planning
Commission, with the direction that the Commission shall study the
Service Plan and that a representative thereof shall present its
recommendations to the Board of County Commissioners.
Section 8: That all resolutions, or parts thereof, in
conflict with provisions hereof, be and the same are hereby
repealed.

Section 9. That this Resolution immediately upon its
passage, shall be recorded in the Book of Resolutions of the County
kept for that purpose and shall be authenticated by the signatures
of the Chairman of the.Board of County Commissioners and the County
Clerk and Recorder.
