RESOLUTION NO. 89- `a,q
RESOLUTION RE: APPOINTING A USAGE COMMITTEE FOR
THE GOLDEN EAGLE SENIOR CENTER
WHEREAS, the Board of County Commissioners of Eagle County
(hereinafter referred to as "the County "), desires to establish a
Usage Committee for the Golden Eagle Senior Center (hereinafter
referred to as "the Center "), for the purpose of interpreting the
rules and regulations of the Center as will apply to persons who
rent the Center; and
WHEREAS, the Usage Committee's duties will include interpreting
and enforcing the rules and regulations as set forth in Exhibit A;
and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board does hereby establish a Usage Committee for
the Golden Eagle Senior Center with the following members:

Members will serve until commencing March 13, 1989 and ending
at the first regular meeting in 1990.
THAT, the Usage Committee will interpret and enforce the rules
and regulations to those who rent the Center, as established by
the Board.
THAT, the Board finds, determines and declares that this
Resolution is necessary for the public health, safety and welfare
of the citizens of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the Count of Eagle, State of Colorado, at its regular meeting

Usage Statement The Eagle County Golden Eagle Senior Center was built
to provide a location for Eagle County Seniors to
Socialize, hold meetings, community activities, and
classes.
RULES AND REGULATIONS:
Smoking
- Smoking is not permitted in the Center.
Opening /Closing
- All use of the Center must end and all participants be
out of the Center by 10:00 P.M. The Center will open
for use no earlier than 7:00 a.m. Unless arrangements
have been made with the Eagle County Buildings &
Grounds department.
occupancy
- According to the Uniform Building Code no more than 96
people shall occupy the interior space of the Center
at one time.
Alcohol -
Alcohol is not permitted in the Center.
Cleanup & Damage -
With respect to damage or injuries that may result by
reason of the use of the Center, the user agrees to
the following:
A. That (he /she) shall be solely responsible for any
cleanup or trash removal necessitated by its use.
Rule of thumb, leave it better than you found it.
B. That (he /she) shall be responsible for putting
tables and chairs as they were found or back into
the storage room.
C. That (he /she) shall be solely responsible for any
and all damages to the premises that occur by
reason of its use and shall immediately on demand
reimburse Eagle County for any cost for repairing
or replacing damaged property.
D. That (he /she) shall be solely responsible for any
and all injuries that occur by reason of its use,
and (he /she) shall hold Eagle County harmless.
Use of Kitchen - The Kitchen area and its equipment may not be used, or
rented out. However, groups wishing to have a meal
catered by the Eagle County Seniors should contact the
Seniors Usage Committee by calling Margie Gates or
Mike Bradley at 328 -7311.

On -Going Use - The Center may be'scheduled for on -going usage
(classes, workshop, etc.). Fees for this type of use
will be negotiated with the Usage Committee.
Booking - All requests for booking the Center can be made by
calling or by written request to:

Requests must be made at least 30 days ahead of the
requested date.
Request for private parties must be made in writing.
Eagle County will normally take bookings first come
first serve. However, in the event of a conflict, the
County will see Senior events with a higher priority.
Eagle County reserves the right to reject any request
for space usage for any reason.
Daily Use - When the Center is staffed with a volunteer, the
Center will be open to "drop in use" by Eagle County
Seniors. The Center hours will be posted.
RATES
Key Deposit - A key deposit of $50.00 will be required of all
parties using the Center, duplication of keys is
prohibited.
Damage & Cleaning Deposit - Damage and cleaning deposit is $75.00. All
cleanup must be completed within 10 hours of
the completion of an event, or before the next
scheduled event, which ever comes first.
note: The above two deposits will be returned after keys are returned
and the Center is cleaned as outlined in Cleanup & Damage.
Under no circumstances may the above deposits be waved

Center Rental - Categories:
A. Government functions, community, educational, cultural or
civic gatherings conducted by a nonprofit organization that
are open to the public without a charge.
NO CHARGE
B. Community, educational, cultural, or civic organization open
to the public with a charge.
$8.00 per hour or $50.00 per day
C. Community organizations, individuals, and special interest
groups requesting the use for private use such as parties,
wedding receptions, meetings, etc. where no admission is
charged.
RESIDENTS
$8.00 per hour or $50.00 per day
NON COUNTY RESIDENTS
$16.00 per hour or $100.00 per day
D. The Eagle County Golden Eagle Senior Center may not be used
for religious worship services, or commercial endeavors.
note: All deposits and rental charges must be paid in advance. Payment
may be made by cash or check: make checks payable to
Eagle County Treasurer. Deposits must be made with a separate
check from the rental check.
In the event of cancellation of Center rental by a group, notice
must be given within 10 days prior to the event, Eagle County
reserves the right to retain the security deposit (key deposit, and
damage and cleaning deposit).

Rental Agreement
THIS AGREEMENT is made and entered into this day of
, 1989, by and between the County of Eagle,
State of Colorado, by and through its Board of County Commissioners
(hereinafter the "Lessor ") and
(hereinafter "Lessee "); and
WHEREAS, Lessee desires use of the Eagle County Golden Eagle
Senior Center located in the Town of Eagle, State of Colorado, for
the period of (Date)

for the purpose of

WHEREAS, the Lessor is willing to lease a portion of the interior
center facility together with such rights and privileges as are set
forth in this agreement; and
NOW, THEREFORE, for and in consideration of mutual terms,
covenants and conditions the parties agree as follows:
1. Scope of Services
The Lessor agrees to lease a portion of the interior center
facility together with such rights and privileges are set forth in
this agreement.
2. Compensation
The Lessor agrees to lease a portion of the interior center
facility for a fee of $
3. Damage Deposit
Lessee agrees to pay a damage and key deposit of:
$50.00 key deposit
$75.00 damage deposit
3.1 The Lessor has the option to increase the amount of damage
deposit based on the nature of the particular event.

4. Miscellaneous Provisions
The Lessee agrees to defend, hold harmless and indemnify the
County, and any of its officers, agents, or employees from any and
all losses, liability or expenses that may be incurred by reason of
any accident, injury, damage, or misadventure (or claim thereof)
resulting from any event occurring on the leased premises during the
term of the lease. The Lessee specifically agrees to hold harmless
and indemnify the County from any and all loss, liability or expense
that may be incurred by reason of any injury suffered by Lessee or
invitee of the Lessee while on the premises.
4.1 The Lessee agrees to follow and obey all rules and
regulations as outlines in the Eagle County Golden Eagle Senior
Center Rules and regulations.
