**CONDITIONS:

Disposal System Regulations, adopted pursuant to authority granted in 25-10-104,
C.R.S. 1973, as amended.
2. This permit is valid only for connection to structures which have fully complied
with County zoning and building requirements. Connection to or use with any

automatically be a violation of a requirement of the permit and cause for both
legal action and revocation of the permit.
3. Section III, 3.21 requires any person who constructs, alters, or installs an

After receiving and reviewing additional information pertaining
to the individual sewage disposal systems located at Rancho Del
Rio, I have come to the conclusion that site application through
the Colorado Department of Health Water Quality Division will be
necessary. It will be the responsibility of Rancho Del Rio to
contact Jim Chubrilo with State Water Quality Division for site
application procedures pertaining to wastewater disposal
alternatives. In addition, they will need to inquire into the
status of their well water.
This decision was a result of two situations occurring on this
site...
1. The existing ISDS (installed approx. 2 years ago) is
grossly undersized for the current usage, and because it is used
for a "commercial" operation, a Registered Professional Engineer
must re -design its capacity. Had this system been sized
adequately, we would have been inclined to document it as a pre-
existing system, and conditioned any repair or addition to go
through the proper channels.
2. In addition, according to the Water Quality policies for
site application...
-Arty site where the combined design capacities of the
systems exceeds 2,000 gpd, irrespective of whether the systems
were constructed at the same time or at different times, the site
will be subjected to the site application process.
*This site will most definitely exceed the 2,OOOgpd design
requirement.
**My suggestion to Rancho Del Rio is to hire a Registered
Professional Engineer to determine the exact proposed design
flows. (It would be wise if they considered the future proposed
systems for the cabins, so they only have to apply once)
This Registered Professional Engineer should be familiar with the
site application process, in order to expedite the process. They
will then need to contact Jim Chubrilo (CDH-Water Quality
Division) concerning site application and the condition of their
well water.

I'm Jeff Gibson and co-owner of Rancho Del Rio. I'm writing
this letter in regards to the land use violation, that Rancho was sited for.
While I admit that I was wrong and without trying to make excuses, I
would like explain my actions.
Six years ago, ► was involved in the reopening of State Bridge.
Vicki Dively, owner of State Bridge, applied for a building permit to
remodel the porch, roof and to replace the old septic system. I was
working directly with the building inspector, Eric Adean, as well as the
builders.
The plan I devised for the septic system was a basic gravity
flow system. Eric Adean didn't advocate the gravity system, believing
there wasn't enough space. He also believed that the system wasn't
sophisticated enough for State Bridge's needs. Eric wanted a pump and
grinding system. This dual system would propel the sewage by gravity
flow, to the pump and then, the sewage would be grinded. After the
grinding process, the sewage would be pumped uphill to a cement septic
tank. I was totally against sewage being pumped uphill and expressed my
reservations to Eric. However, Eric was adamant about his position.
Ultimately, the final decision was Vicki's to make. The lack of a septic
system, was the only obstacle, preventing her from opening State Bridge.
To facilitate opening the lodge, Vicki agreed to the pump and grinder
system. Before I surrendered my position, I inquired Eric about the
grinders capability of tearing up a tampon. Eric's response was, "This
grinder would tear up a full wet roll of toilet paper."
On State Bridge Lodge's opening day, the septic alarm went off
arcl the grinder was jammed. I shut down the system and pulled the
grinder, I discovered a tampon caught 1n it. After my findings, I
telephoned the manufacturer, who informed me, that the system wasn't
designed for heavy sewage and definitely wasn't equipped to grind a
tan'Ipon. Since day one, State Bridge has experienced nothing but problems
with the pump and grinder system, . It was unfortunate,that Vicki didn't
have the tittle, to reject that system.

Newly built ISDS
1. The soil absorption and characteristics must be determined
via a percolation test and soil profile hole examination. This
will also determine if groundwater or bedrock is present in the
absorption area. In addition, a permit for this system must be
obtained.
2. The size of the ISDS must be determined. They can supply me
with invoices, photos, etc. Utilizing information from the
percolation test and waste water flows, I will calculate whether
this ISDS is of adequate size/capacity to handle the design flow
of waste water presently loading the system.
3. The photo lab chemicals should not be disposed of via the
septic system. If ground water analysis demonstrates chemical
contamination, they could be held liable for the entire cost of
ground water cleanup. This can become very costly.
Old ISDS
4. The new house should not be hooked up to the old septic
system, unless they can prove its location, capacity, condition,
soil absorption, and the absence of ground water and bedrock.
The apparent location of the old ISDS leads me to believe this
task to be impossible. Therefor, another ISDS must be installed
to accommodate the new house.
5. Before installing the new ISDS they must obtain a permit,
percolation test, soil profile examination, and determination of
design flows.
Retail Market
6. The grocery store should be dealt with as a retail market -
subject to state regulations and inspection fees. The square
footage and operation dates of the store should be submitted to
this office by phone or letter.

The Environmental Health Division would like to notify you to
make a formal request to extend your Individual Sewage Disposal
System(ISDS) Permit nto the 1996 construction year. The
Environmental Health Division discontinued percolation tests on
November 15, 1995 and final inspections on December 2, 1995 due
to climatic conditions.
ISDS permits are active for 120 days after the date of issue if
no Building Permit has been issued for the same property. If a
Building Permit has been issued for the same property the ISDS
will expire at the same time as the building permit.
If you still plan to apply for a Building Permit this year or in
the early months of 1996 you will need to have a percolation test
conducted before your Building Permit will be released. You will
have to contact a Registered Professional Engineering(RPE) firm
to conduct your percolation test.
If you have had your permit issued and have not had your final
inspection completed, but plan on constructing the system in the
next few weeks, please give our office a call and we will
evaluate your permit on a case by case situation.

3. PLAN FOR AUGMENTATION
A. Water rights to be used for Augmentaton. The applicant
herein is applying for a contract for use of Green
Mountain Water, in the amount of 1 acre-foot, to cover
all out -of -priority depletions associated with this
plan.
B. Rancho Del Rio has been a hunting, fishing, camping at;-4
rafting resort on the Colorado River since th early
1900's, which offers seasonal cabins (none of the
cabins currently have water), campground , as well a� a
small convience store. The owners now wish to expand
this historic use to include five 16' x 20' cabins and 6
RV hookup sites, which will include water.
C. Statement of Plan, covering all applicable matters under
CRS 37-92-103(9), 3020 )(2) and 305(8).
The owners of Rancho believe their historic use from
well permit no. 133940-A has been covered by
releases from Green Mountain in that the uses existed
well before 1977. Historically, the resort has had two

The applicants now propose to add 5 cabins with a
,1:1hower, toilet and kitchen sink and 6 R.V. sites. The
water requirements for all uses associated with the
resort are as follows:
Domestic: Domestic use for single fami.z residence
is computed on the basis of 3.5 persons per single
family residence, 80 gallons of water per person per
day usage and a 10 percent consumptive use from
septic leach field sewage disposal. The consumptive
use for the two residences would be 0.0528 acre feet
per year (not including the lawn). Lawn consumptive
use for 6,000 sq. feet of lawn computed at .17 acre
feet per year.
Recreational vehicles: Recreational vehicles are
temporary residences. The use from a recreational
vehicle is calculated at 100 gallons per day for a 120
day period. Al use is considered 100 percent
consumptive. The consumptive use for a recreational
vehicle occupying a spot for the entire 120 day period
would be 0.0037 acre feet per year. With 6 R.V. spots
proposed the total consumptive use associated herein
would be .0232 acre feet per year.
Cabins: Usage from the news cabins is based upon 3
persons per cabin, 80 gallons per person day usage
and a 10 percent consumptive use from septic and
leach field disposal. Cabin use is temporary and
based upon 120 day use period. Assuming all cabins
are occupied for the full 1 20 day period the
consumptive use associated herein would be .18 acre
feet near.

Dear Jeff:
In response to your request for a delay in the fulfillment of the
requirements of a Special Use Permit, Staff has determined that
the level of cooperation that you have demonstrated up to now
represents a good faith effort to comply with the Eagle County
Land Use Regulations. Therefore, we have agreed to postpone your
required submittal of an application for a Special Use Permit for
Rancho Del Rio until October 1, 1993.
You should understand that this Special Use Permit application is
in response to a violation of the Zoning Regulations and that you
will be required to submit an application on that date. Failure
to do so may subject you to appropriate legal action. You may
also wish to contact the Community Development Department prior
to October 1 in order to ensure a complete submittal.
Please also understand that the two pending building permit
applications will still need to be pursued. Do not consider the
building applications to be postponed as well. It is my
understanding that there are outstanding water and wastewater
issues that need to be addressed through the State. Understand
that the County is.within its power to prevent you from using the
structures if these building, water and wastewater issues remain
unresolved.
Once those building, water and sewage disposal matters have been
resolved and permits have been issued, final Certificates of
Occupancy will not be issued until the Special Use Permit has
been approved by the Board of County Commissioners.
Consequently, it would seem that while you have received a

postponement in fulfilling the requirements of a Special Use
Permit, you still have several matters that continue to need
timely resolution.

This letter is in response to your telephone conversation on September 20,
1993, with Julie Swanda.
The Bureau of Reclamation (Reclamation) is presently developing new contract
policy for all future water service contracts and unable at this time to
execute a long-term Green Mountain Reservoir water service contract. Once we
receive approval on new contract policy, we will begin executing long-term
water service contracts for Green Mountain Reservoir. In the interim, we are
able to offer you a 1-year temporary water service contract for the requested
1 acre-foot of municipal/domestic water.
Please let us know if you are interested in entering into a 1-year temporary
water service contract. We anticipate approval of our new contract policy by
January 1994, at which time we will resume executing long-term water contracts
for water service from Green Mountain Reservoir.

Dear Ms. BuschWeak,
1. As discussed with Jeffast week, Jeff contacted
Jim Chubrillo (Colorado Department of Health) regarding the
use of the photo lab at Rancho Del Rio. Apparently, the
chemicals are recycled and the "hard minerals" are removed.
It was Jeff's understanding that Mr. Chubrillo and the photo
lab (Colorado Whitewater Photography) had come to an
agreement regarding disposal of chemicals at the site. I
have tried to contact Jim Chubrillo to confirm, but have not
been able to reach him.
I also contacted Fred Haslee and Mike Poeckes at Upper
Eagle Valley Sanitation District regarding treatment of
photo lab chemicals. Another option would be to dump the
photo chemicals into a holding tank or the porta potties,
which are dumped at treatment plants. Mike did not think
that any Federal regulations would impact the photo lab,
since it probably processes under 1600 sf of product per
day. They are fairly sure that the chemicals could be
dumped at one of their treatment plants. They would like a
chemical analysis of the waste to verify the contents, which
could be done by ACZ Laboratories in Steamboat Springs.
2. As I read the Colorado Department of Health regulations
for campgrounds and recreation area, individual water
services can be provided to camper areas as long as all
wastes are contained in a sewage holding tank in a self
contained camping vehicle. Therefore, both water and
electric services are proposed to the camper areas. A large
holding tank is proposed to provide means for the campers to
empty their individual holding tanks, if the need arises.

Please find enclosed, the Eagle County Department of Health's application for site approval of a septic
system, three (3) applications, for three (3) systems and plans for the proposed Rancho Del Rio facility.
Existing Conditions - -
Currently, a 2 bedroom mobile home, an office (at the store), a 1 bedroom residence next to the store,
and a shower/bathhouse facility are connected to a sewer system which treats sewage by means of a
1000 gallon septic tank and 30'x 30' absorption bed. The shower/bathhouse facility is "private", and is
primarily for the use of persons renting the cabins on the site, which have no water or sewer facilities.
A 1 bedroom residence (closest to the Colorado River) with water and sewer facilities currently disposes
sewage to a separate system of unknown origin.
Two to four "Porta-Potties" are located near the river beach area and are for the use of the general
public using the Rancho Del Rio area for boating and recreational purposes.
The cabins are all 1 bedroom, typically have a single bed, and are primarily rented out on a monthly
basis as.a rooming house. No kitchen facilities exist for the cabins.
Apparently, sometime around April 1, 1995, when the existing septic tank was pumped, it partially
collapsed. It is a fiberglass tank. As a result of the collapse, some solids from the tank may have
entered and partially clogged the existing gravel absorption bed. Jeff thinks the system isn't working the
way it used to.
Proposed Development
-Five of the existing eight (8) cabins are to remain as -is; without water or sewer services.
Persons renting these units will use the "private" shower/bathhouse.
-One of the existing cabins (cabin #8) is to be removed.
-Two of the existing cabins (#6 and #7) are to be replaced with new 1 bedroom cabins with
water and sewer services, (1 bathroom and kitchen sink).
-Three new one (1) bedroom cabins (98, #10 and #11) are to be constructed with water and
sewer facilities.
-The photo lab is gone and not proposed to be used anymore.
-The recreational vehicle camp sites are not proposed to be used, and have been deleted from
the plans and calculations. It is possible that a holding tank may be desired as a service to
recreational vehicles; however, criteria for its placement should be coordinated with Eagle
County prior to its installation.
-The public toilets (Porta-Potties) are to remain. A sign posted in the bathhouse clearly states
the restroom, showers and washing machine are for paying customers only, and not for
public use.
-A new Porta-pottie is to be located on the north side of the site, so that a portable toilet is
more accessible than the existing portable toilets near the boat ramp area.
-KK's Barbecue is to begin operations at the site. Her food service consists of pre -prepared
items (pickles, potato chips, etc.) and barbecued food. All of the food is served on napkins
or paper plates; no dishes are used which require washing. Sausages and other foods are pre-
cooked, to minimize grilling time. These pots and pans for pre-cooking require washing. A
grease trap of adequate size should be added to the grey -water line -or discharge from sinks that
will be used to wash dishes.
-Apparently, one of the showers is the bathhouse is to be converted to a kitchen area for KK's
Barbecue.
Proposed Septic System
The septic system is proposed to be divided into 3 systems.
The existing 30' X 30' absorption bed and 1000 gallon septic tank are to be abandoned and replaced
with a new septic system which will service the mobile home, bathhouse, KK's Barbecue, and the
residence/office. The existing (failed) septic tank is to be replaced with a 1500 gallon tank.
The remaining sewage generated from the site is proposed to be split into two separate absorption beds.
Horizontal setbacks have been checked to confirm that setbacks from one field do not overlap a setback
from another absorption area.

Percolation Tests -
Percolation tests were performed at all three proposed absorption areas. Although all percolation tests
resulted in percolation rates of around 8 minutes per inch, a much more conservative value (slower)
percolation rate was used for designing absorption areas. If the well and water system is metered, water
use could be confirmed. -
Soil Profile Holes
The cutbanks along the Eagle River were observed to determine depth to bedrock, ground water
elevation, etc. No springs were visible in the area, and no flood irrigating or irrigations ditches exist
near the site. A soil profile will be dug and observed prior to construction.
The soil appears to consist of silty sands, with an occasional 6" to 1' diameter rocks.
System Setbacks
Considerable time has been spent "designing" each system to have 1000 gpd or less directed to it so that
horizontal setbacks to wells, streams, gulches, other system, etc. will be minimized, so that each system
can be assumed to be independent of the other. As a result, the existing office and store are to connect
to the bathhouse septic system, and the mobile home will connect to the new septic system #2.
The setback on system #3 is 40' more than the standard setbacks (or 8 ft. per 100 gpd. over 1000 gpd.)
-Spring and Wells
System #1 and #2 must be at least 200' apart from eachother.
System #1 and #2 must be at least 240' from System #3.
-Lake-Water Course, Stream
Systems #1 and #2 must be at least (50 + 54) = 104 feet apart from each other, and 54
feet from a lake, water course or stream; System #3 must be at least (50 + 40) = 90'
from a stream.
-Dry Gulch
Systems # 1 and #2 must be at least (25 + 25) = 50 feet apart from each other standard
setbacks to buildings, etc.; System #3 must be 65' from dry gulches.
Plus the other standard setbacks to buildings, etc.
Surface Drainage
An interceptor ditch exists to the east of the site, to direct runoff away from the site, including the
buildings and septic systems. The southernmost absorption area may require improving an existing
drainage swale to direct runoff past the absorption area. In most cases, if runoff impacts the site, it will
also likelycause damage to buildings, which indicates the owner would have good reason to maintain
drainage swales to protect building and therefore septic systems.
Abandon Existing Systems
We would appreciate comments/recommendations from Eagle County regarding the requirements to
abandon the existing septic system west of the residence, and north of the bathhouse.
We are proposing to fill the existing septic tanks with sand or dirt, and abandon (or leave along) any
absorption areas or leach beds, etc.

Contributing Uses
The existing office (residence and store), existing mobile home, existing bathhouse, private with toilet,
and washers/dryers for laundry. The bathhouse is a "private" facility which is used by the occupants of
cabins #1 through #5, which have no bath/toilet facilities. KK's Barbecue kitchen area is to be added to
the bathrooms.
The cabins have 1 bedroom, and one bed per cabin and are used primarily as rooming houses rented on
a month to month basis, and rarely have more than one person per cabin. Boarders are typically gone
during the day. The cabins are rented for 6 months/year (May through October) and "Porta-Potties" are
available nearby for general public use.

I would recommend that the well be metered, and water use

be mush less than anticipated.

4. A soil profile hole will be dug, and observed prior to
construction.

7. A solid holding tank or wetwell is proposed to be installed"
for the camping sites, which will be pumped periodically by
the same company pumping the port -a -potties. Calculations
are attached to size the holding tank.

setback requirements to the existing well, to the Colorado River,
and between themselves. Horizontal setbacks have been checked to
confirm that setbacks from one field do not overlap a setback
from another absorption area.

The Environmental Health Division would like to notify you to
make a formal request to extend your Individual Sewage Disposal
System(ISDS) Permit #1372-94 into the 1995 construction year.
The Environmental Health Division discontinued percolation tests
on November 15, 1994 and final inspections on December 2, 1994
due to climatic conditions.
ISDS permits are active for 120 days after the date of issue if
no Building Permit has been issued for the same property. If a
Building Permit has been issued for the same property the ISDS
will expire at the same time as the building permit.
If you still plan to apply for a Building Permit this year or in
the early months of 1995 you will need to have a percolation test
conducted before your Building Permit will be released. You will
have to contact a Registered Professional Engineering(RPE) firm
to conduct your percolation test.
If you have had your permit issued and have not had your final
inspection completed, but plan on constructing the system in the
next few weeks, please give our office a call and we will
evaluate your permit on a case by case situation.

Four percolation tests were performed on System #3, and the site where the bathhouse absorption
trenches are proposed. Two percolation holes, (TP2&3) percolated at 16 minutes per inch, TP4
percolated at 14 minutes per inch and TP 1 had a very slow percolation rate. After the tests were
completed, the backhoe operator was asked to dig down 5' near TP1, (the slowest percolation hole)
and I noticed a small clay band by TPI which appeared to be an isolated location. TP2 is only 5'
west of TPI, and TP2 percolated fine. To avoid this clay pocket, I recommended moving both
trenches 3' west and extending both trenches by 1 infiltrator unit (6') from 106' to 112', to make up
for absorptive area lost due to the small clay pocket.
On May 8, 1995, Clark Ewing, the contractor building the system asked if 3 trenches 75' long instead
of two 112' long could be constructed. The 3 trench layout is wider than two trenches, so that Jeff
Gibson will have to move the existing storage shed which is located north of the bathhouse. A
distribution box is needed for a 3 trench system; I asked that the distribution box invert be no more
than 0.1' above the pipe invert of the infiltrators, to allow for overflow to/from infiltrator trenches.
