Subject: Percolation Testing, Proposed New Septic Disposal System, 7738 Frying
Pan Road, Eagle County, Colorado.
Dear Mr. Bergs:
As requested, a representative of Hepworth-Pawlak Geotechnical, Inc_ conducted
percolation testing at the subject site to evaluate the feasibility of an infiltration septic
disposal system. The results of our work are presented in this report. The work was
done in accordance with our agreement for professional services co you, dated February

A profile pit and three shallow backhoe pits were excavated at the locations shown on
Fig. 1. Percolation test holes (nominal 12 inch diameter by 12 inch deep) were hand
dug at the bottom of the backhoe pits and soaked with water one day prior to testing.
The holes were covered with rigid foam insulation to protecr against freezing overnight.
The soils exposed in the percolation holes are similar to those exposed in the profile pit
and consist of 1 V2 feet of topsoil overlying silty sand and gravel with cobbles to the pit
depth of S feet. Groundwater was encountered in the profile pit at a depth of 5 feet and
the upper soils were moist to very moist.
Percolatioa tests were performed oa March 7, 2000 by a representative of Hepworth-
Fawlak Geotechnical, Inc. The percolation test results are presented on Table I,
.Percolation rates less than about 1 minute per inch were rrleasared.. The slower rare at
\11'1 test hole P-2 was due to finer soils encountered. The fast percolation rates measured

and the shallow groundwater level will probably require an engineered septic disposal
system. A civil engineer. should be contacted for the design.

percolation rates were based on the last two readings of each test. Test P-2 had a slower

IN RE: Issuance of Floodplain Development Permit for Richard Benes Property
Permit # 2000-009
Dear Mr. Currier:
I received your revised application for the above referenced Floodplain Development Permit on
August 25, 2000. 1 have reviewed your application and the supporting documentation.
In response to this submittal I have the following comments.
l . Although it appears that this residence is in fact located entirely in the flood fringe district
as per your study, the changes made to the site plan have resulted in a structure which is more
compliant with the spirit of the Floodplain Regulations. Specifically, an existing partial basement
will be eliminated, thereby eliminating areas within the structure that will be prone to inundation by
the base flood. Furthermore, since the southern most corner of the existing residence will be
removed the setback from the floodway-flood fringe boundary will increase from 9' to 15'. This
brings the structure into compliance with Section 6.06.20 4)a)1) which stipulates that any residential
building designed for human occupancy shall be constructed, located or improved so that any
external wall shall be not less than 15' from the streamside of the flood fringe district.
2. Section 6.06.20 4)a)2) stipulates that the structure must be at least 1' above the base flood
elevation. As indicated in your application all existing floor levels will be raised as needed to be a
minimum of F above the base flood elevation of 7065.4.
3. In accordance with Section 6.06.29 5) "the Floodplain Management Administrator may
waive any part but not all of the submission requirements imposed by Section 6.06.25 of these
Floodplain Regulations upon petition of the applicant that a portion of the submission requirements
is inapplicable to the development for which the permit is sought, and/or full compliance with the
submission requirements would be unreasonably burdensome for the applicant and that the proposed
development will have an insubstantial impact on the surrounding area. Such a waiver may be
granted, after due consideration by the Floodplain Management Administrator, upon a written
determination that the information to be submitted is sufficient for the Floodplain Management
Administrator to arrive at a permit decision in full compliance with the law and these Floodplain

Regulations and that the proposed development will have an insubstantial impact on the surrounding
area." In accordance with this section of the regulations, I am waiving the requirement of Section
6.06.04 of the Eagle County Land Use Regulations that stipulates that "in no instance shall the
floodway-flood fringe boundary be closer than 25' to the natural stream bank." This requirement is
not demanded by the NFIP and in order for you to comply with this section, the existing home would
have to be relocated off its current foundation. Clearly, the remodeled structure will be far more
equipped to deal with any potential flooding due to the many improvements you are making to the
structure.
Therefore, I am approving your application for a Floodplain Development Permit for the Benes
property. Enclosed please find one copy of Eagle County Floodplain Development Permit #2000-

On May 21, 2001, High Country Engineering personnel observed the construction of the 1SDS for
77331~rying Pan Road, Basalt within. Eagle County, Colorado, One 20()0-ballon septic tank, one
l000-gallon concrete dosing tank cha►nber without appurtenances and an absorption hound had
been installed, but no bacrkfilling had taken place. Pump specifications were verified and the
contractor was directed to drill additional holes on the bottom of the distribution laterals.
Otherwise, the installation of the system was in conformance with the intent of the design dated
May 10, 2001. If you have any questions, or need additional information, please contact us.
