There are a wide range of perc rates (5, 5.7, 8.7, 10.6, 10.7, 14, 14.7, 21, 40.4) in the six lots due to a variety of soils and their deposit characteristics. All six lots had a test pit dug in April of 1999. Lot #5 of Mr. Feldmann's was extremely rocky 12" to 48" deep and had a perc rate of 8.7 mpi at a depth of 66". Mr. Feldmann dug another test pit in October of 1999, 70 feet to the northeast of the April pit. There were no noticeable rocks in the October pit. The soils were a light brown silty loam covered with a darker topsoil. The perc holes averaged 10.58 mpi and 10.73 mpi. Due to the variability of the soils in this Lot #5 and the sensitivity of the surrounding Eagle River drainage, the following procedures shall be required for superior installation: 1. Excavate the entire Infiltrator area to a point 4 feet horizontal beyond the edge of the chambers shown on the plan dated February 16, 2000. 2. Subexcavate 3' below the final level of the chambers. Remove any rocky soils or rocks bigger than 4" and replace with suitable native soil. 3. Scarify, wet and compact the bottom of the 3' subexcavation. 4. Replace the soil in 8" lifts and compact to 85+% to achieve consistent percolation rates and distribution. Fill and compact to the bottom of the chamber grade. 5. Dig three Perc test holes 12" deep, soak and test the perc rate according to the standard procedure. The predevelopment perc rate averaged 10.6 mpi. The actual design rate shall be greater than or equal to 20 mpi to achieve the higher standard of septage water cleaning, as researched by Mr. Mike Gamba, P.E., the Town Engineering consultant. The slower perc rate of 20+mpi will better protect our river system 6. Recalculate and add more Infiltrators if the rate is greater than 20 mpi. 7. Complete the Infiltrator installation according to the manufacturer's recommendations. Merry Eagle County Environmental Health Department 500 Broadway, Box 850 Eagle, Colorado 81631-0850 (970) 328-8755 Reference: Glaze-Curreri Subdivision Exemption, Gypsum, Colorado Septic "Suitability" Dear Mr. Merry: I am submitting this information to you for your opinion on the suitability of septic use in the Glaze-Curreri Subdivision per the Town of Gypsum Subdivision Regulations. The regulation on page 88-3, in paragraph 17.24.090 SEWAGE FACILITIES states that: "Where individual disposal systems are proposed for each lot, the use of individual systems must be approved by the local public health agency, who shall give written opinion concerning the suitability of the proposed subdivision for individual systems, before they will be considered for approval by the Town Council. (Ord. 9 series 1993 S2)" My study of the area has concluded that the proposed septic systems must be designed on a case -by -case basis before a building permit is issued since each house location and size within the building envelop will be different. The subdivision was studied on November 16th and 17th, 1998 for the use of septic systems. Three percolation holes were dug near "good home sites" for random samples. The soil conditions varied from silty and sandy loam to occasional fist -sized red sandstone rocks. The perc rates varied from 3.25 to 5.0 minutes per inch. The soil can be compacted and conditioned to slow the perc rates for better filtration in this Eagle River frontage area. Each of the six lots has enough room for a minimum of three (only two required) leach field systems. The Eagle County and Colorado State health regulations shall be met for all septic systems including: 1. the maximum seasonal level of the groundwater table or bedrock shall be four feet or greater below the absorption system, 2. the soil percolation rate shall be between 5 and 60 minutes per inch, 3. the ground slope shall be less than 30 percent, 4. the tank and absorption systems shall be greater than: a. 25 feet from the existing 8" Town water main, b. 10 feet from all property lines, c. 20 feet from occupied buildings, d. 50 feet from the Eagle River (300' is the closest building envelop shown), e. 25 feet form dry gulches, f. 100 feet from a spring or well, 5. all septic systems within the Glaze-Curreri Subdivision shall be designed by a registered professional engineer for approval by the Eagle County Health Department. I would be happy to meet with you or one of your technicians on site to examine this property. For the sake of saving time and duplicating efforts, if you agree with all of the above stated observations, please sign below. Box 179 500 Broadway Eagle, Colorado 81631-0179 I'm responding to your April 8, 1999 letter in which you ask for my opinion about whether the Glaze-Curreri Subdivision proposal has enough space to construct two complete septic leach field systems on each lot and if soil conditions are compatible to on -site disposal systems. The area required for an Individual Sewage Disposal System (ISDS) is calculated by using two pieces of information, the estimated quantity of waste water being generated from a structure and the type of soils present within an absorption area. The applicant's engineer, Jerry C. Law, P.E. sent a site plan and a report with limited soils information, dated April 2, 1999. In fhat report* 1VIr. Law --demonstrates the need to Have ISD'S_ systems_ designed by'a Registered. Professional Engmeer licensed i he State rate's being greater thanfive -minutes per.incht Mr. Law states in his report that there is enough area for three leach fields on each lot. This statement likely assumed a modest sized home of three to four bedrooms in order to determine the waste water flow number. Waste water flow calculations from a home are based on the dwelling's occupancy potential (number of bedrooms). I would recommend that your land use decision include a condition regarding maximum waste water flow or maximum number of bedrooms per dwelling unit based on the engineer's recommendation. The soils evaluation which was conducted by Mr. Law consisted of three percolation test holes and revealed soil types which are not conducive to waste water treatment. This issue is best handled during site -specific engineering and ISDS permitting to only allow systems which will discharge waste water quality expected to not significantly degrade ground or surface waters. Additional site information, especially subsurface soil conditions to at least eight feet under ground, will be required during the permitting process to gain an understanding of the soil horizons which may be confining or water bearing and systems can be engineered to mitigate these conditions. The 4 feet of separation was adopted by Eagle County after an "expert" at a conference showed convincing evidence that adequate treatment of the leach field fluids was still achieved. 2. The table on page 214 of the EPA Design Manual was used to calculate a more conservative leach field area based on a "gallons per day application rate" for the soil type rather than the traditional percolation rate. As of February 25, 2008, County records reveal that the file for this permit remains incomplete, and that the required information to finalize your system has not been submitted. On June 25, 2007, a letter was sent to Jerry Law, who is the listed engineer for this project, advising him that the file was still open, and he would need to submit an Engineer's Certification Letter and the As -Built Drawings in order to complete your file. As of today's date no attempt has been made by Mr. Law to submit this information, and currently both you building and ISDS permits have expired which places you in violation of the Eagle County Land Use Regulations It is imperative that the requested information be submitted to the Eagle County Environment Department by March 15, 2008, in order to avoid further enforcement action, and to close your case.
