Box 179 Eagle, CO 81631 RE: 0140 Sam Grange Ct., Hoffman Residence, ISDS HCE File # 93004.01 Dear Tanya: On July 15, 1993, HCE personnel observed the visible constructionof the individual sewage disposal system located at 0140 Sam Grange Court, in Eagle County, Colorado. The top of the septic tank which was of precast concrete, was visible.. The absorption field was constructed, but not covered with soil, and the tops of the infiltrator units were visible. As you know, the initial design was an Infiltrator bed based on a percolation rate of 40 minutes per inch. However, Eagle County Regulations require a trench configuration if the percolation rate is over 30 minutes/inch. So the design was revised and resubmitted. Unfortunately, contractor used the initial design plans and built a bed system. Neither you, nor Ray Merry were available at that time, so we began to review our original percolation test and design information'. It was noted that we had conservatively based our design on the worst percolation test and not the average of the three tests. The average of the tests yields a percolation rate less than 30 minutes per inch. Thus, using that criteria, the bed configuration would be allowable. This particular ISDS has not yet been permitted for construction. 4.03.29, Eagle County Land Use Regulations states: "Any person who commits any of the following acts or violates any of the provisions of this article commits a Class I Petty Offense and defined in Section 18-1-107, C.R.S. 1973 as amended: 1. Constructs, alters, installs, or permits the use of any individual sewage disposal system without first having applied for and received a permit as provided in these Regulations. 2. Constructs, alters, or installs an individual sewage disposal system in a manner which involves a knowing and material variation from the terms or specifications contained in the application or permit. 4. Conducts a business as a Systems Contractor without having obtained the license provided for in these regulations..." Neglecting the above three points, resulted in installation of an inadequately designed system. Therefor, this ISDS will not be finaled by this division, and will be considered a non -conforming system. Consider this your only warning. Any further violations will be turned over to the attorney's office for civil and/or criminal proceedings. k v I will expect your response within the next 10 working days.
