HomeMy WebLinkAboutR22-098 Declining Participation in the Famli Program DocuSign Envelope ID:A01 CED52-71 E8-4ECC-90BB-F61 FD25A5EDC Commissioner scherr moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2022 - 098 RESOLUTION DECLINING PARTICIPATION IN THE FAMLI PROGRAM WHEREAS, the Board of County Commissioners (the "Board") has the authority under Colorado law, including, but not limited to C.R.S. § 30-11-103 and § 30-11-107 to make decisions regarding the County budget, personnel benefits, and employment policies of the County; and WHEREAS, in 2021, the Colorado General Assembly enacted legislation known as the Paid Family and Medical Leave Insurance Act, codified at C.R.S. § 8-13.3-501, et seq., the provisions of which will become operative in 2023 (the "FAMLI Program"); and WHEREAS, a local government may decline participation in the FAMLI Program by formally notifying the Division of Family and Medical Leave Insurance in writing and providing the date of the vote and the local government's decision to decline participation in the FAMLI Program; and WHEREAS,the Board has reviewed and considered the advantages and disadvantages of participation in the FAMLI Program in connection with current employment benefits, including paid leave time, already provided to Eagle County employees; and WHEREAS, even if Eagle County declines participation in the FAMLI Program, any county employee may nonetheless elect coverage and individual participation by enrolling and paying their individual premiums directly to the State; and WHEREAS, in accordance with the authority stated above, the Board hereby takes the following action. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, transmission of this Resolution to the Colorado Division of Family and Medical Leave Insurance shall constitute written notice of Eagle County Government's decision, as an employer, to opt out of the FAMLI Program. THAT, the Board intends this opt-out to include all Eagle County Government operations, Eagle County entities and Eagle County enterprises, including but not limited to Eagle County Public Health, the Eagle County Airport and the Eagle County Housing and Development Authority. DocuSign Envelope ID:A01 CED52-71 E8-4ECC-9.0BB-F61 FD25A5EDC THAT, the Board directs staff, as applicable, to provide all county employees with notice of this decision and information regarding the FAMLI Program within thirty(30) days of the date of this Resolution, and as required by Colorado Statute and Colorado Code of Regulations. THAT, this Resolution will be effective as of the date of its adoption and until otherwise amended by action of the Board. THAT,Eagle County will reconsider whether to participate or opt out of the FAMLI program every eight (8)years, or as otherwise required by law.
