Box 1628 Eagle, CO, 81631 RE: Lot 3, Ladybelle View Subdivision, 0475 Mosher Lane Mr. Vaughn: At the November 6, 1990 meeting of the Eagle County Development Review Team, the following comments were made: 1. You were notified on September 25, 1990 that the amended final plat submitted By James L. Mosher cannot be further processed unless the application is transferred into your name as the new owner. Since we did not hear from you or Mr. Mosher to that.effect, the final plat for Ladybelle View Subdivision, recorded on June 27, 1988, is still the official enforceable document; 2. By virtue of the above comment, you are in violation of the following plat notes: A. Specific geotechnical investigations are required to be performed by each Lot owner to determine subsurface conditions of -a proposed building site prior to design of buildings and foundations and prior to issuance of a building permit by Eagle County or other entity of jurisdiction (Plat Note # 1); B. No residential buildings, garages, or customary accessory uses shall be located outside of the "building envelopes" as indicated on the Plat of any Lot without specific approval of the Eagle County Board of County. Commissioners (Plat Note # 6). Pursuant to Section 1.15.01 of the Eagle County Land Use Regulations, you are hereby given written notice to correct the above listed violations within thirty (30) days after receipt of this notice. (Such a permit was applied for but not issued.) B. Certificate of Occupancy, U.B.C. Section 307.(a). No building or structure shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the building official has issued a Certificate of Occupancy therefore as provided herein. Pursuant to Section 1.15.04 of the Eagle County Land Use Regulations, it shall be unlawful to erect, ....any.... building in the designated area without first obtaining a building permit from the.County Building Official.... Any violation of the County Building Code shall be deemed a nuisance. By virtue of this communication and pursuant to Section 4.03.24 of the Eagle County Land Use Regulations, you are hereby being provided reasonable notice that you are not in substantial compliance with Chapter 4 of the Eagle County Land Use Regulations regarding Individual Sewage Disposal Systems. Please note on your permit # 1009 that a final inspection of your septic system in necessary prior to the use of the system. This permit is valid only for connection to structures which have fully complied with county zoning and building requirements. Connection to or use with any dwelling of structure not approved by the zoning and building departments shall automatically be a violation of a requirement of the permit and cause for both legal action and revocation of the permit. He DATE: July 13, 1994 RE: File #SU-239-94-AF-Ladybelle View, Lot I'm forwarding this memorandum to address the issue of the septic easement located on this lot which the applicant wishes to remove. It is my understanding that geologic concerns identified during the subdivision process led to the creation of building envelopes located in such a fashion as to avoid these areas. Specifically, the building envelopes were placed toward the front of each lot raising concerns regarding enough area left for a gravity flow septic system as the lots slope gradually toward Mosher Lane. This led to the creation of a sewer line easement across Mosher Lane and a septic leach field easement located on Lot 1, apparently for use by Lot 3. In 1990, problems apparently developed on Lot 3 when the lot was sold. I recall that a mobile home was placed on Lot 3 without a building permit, outside the platted building envelope. This mobile home remains in the same location on Lot 3 today, several hundred feet away from Mosher Lane. ISDS #1009 serves this two bedroom trailer with the absorption area located about 100' downhill from the dwelling. According to the hand -drawn site plan in the ISDS file, it appears as if there remains enough area on Lot 3 to replace or add to the existing septic system, without having to use the platted easement on Lot 1.
