HomeMy WebLinkAboutR22-095 Adopting a New Eagle County Environmental Health Fee Schedule DocuSign Envelope ID:El DBBBEB-010A-41 F7-A044-4C36E66B4D57 Commissioner Chandler-Henry moved adoption of the following Resolution: EAGLE COUNTY BOARD OF HEALTH COUNTY OF EAGLE, STATE OF COLORADO, RESOLUTION NO.2022 - 095 RESOLUTION ADOPTING A NEW FEE SCHEDULE APPLICABLE TO ENVIRONMENTAL SERVICES OF EAGLE COUNTY PUBLIC HEALTH AND ENVIRONMENT, EFFECTIVE JANUARY 1,2023 WHEREAS,the Eagle County Board of Health, which is comprised of the Board of County Commissioners of Eagle County, Colorado (hereinafter the "Board"), is authorized,pursuant to state enabling legislation including, but not limited to, C.R.S. Sections 25-1-508(5)(j), 25-4- 1607, 25-10-107 and 25-10-109, to plan for and protect the public health and environment as it relates to the use of on-site wastewater treatment systems and the operation of food service establishments in the County of Eagle, State of Colorado, for the purpose of promoting the health, safety, convenience, order, prosperity, and welfare of the present and future inhabitants of the County of Eagle (the "County'); and WHEREAS,pursuant thereto,and pursuant to the provisions of C.R.S. Sections 25-1-508(5)(j), 25-4- 1607, 25-10-107 and 25-10-109,the County is authorized to charge fees for such services; and WHEREAS, in order to better cover the cost of providing environmental services performed by Eagle County and Eagle County Public Health and Environment,the Board desires to adopt a revised fee schedule, set forth in Exhibit 'A', attached hereto and incorporated herein by reference("Fee Schedule"), effective January 1, 2023; and WHEREAS,to the greatest extent practicable,the fees for environmental services listed in Exhibit 'A' align with the cost of providing these services, and in no event exceed the cost of providing such services. NOW,THEREFORE,BE IT RESOLVED BY THE EAGLE COUNTY BOARD OF HEALTH: THAT,pursuant to the authority granted by law,the Board herein adopts the Fee Schedule,attached hereto as Exhibit 'A', effective January 1, 2023. THAT,this Resolution is necessary for the public health, safety, and welfare of the County of Eagle, State of Colorado.
