CONDITIONS:
1. All installations must comply with all requirements of the Eagle County Individual Sewage Disposal System
Regulations, adopted pursuant to authority granted in 25-10-104, C.R.S. 1973, as amended.
2. This permit is valid only for connection to structures which have fully complied with County zoning and building
requirements. Connection to or use with any dwelling or structure not approved by the zoning and building
departments shall automatically be a violation of a requirement of the permit andcause for both legal action and
revocation of the permit.
3. Section III, 3.21 requires any person who constructs, alters or installs an Individual Sewage Disposal System to
be licensed according to the regulations.

Dear Mr. Konicek,
The Environmental Health Division received a complaint that the septic
system on the property owned by you at Lot 68, 4948 Bellyache Ridge
Rd., Bellyache Ridge Subdivision, has failed. The owner of the
adjacent lot, Lot 69, claims that moisture in the crawl space of her
dwelling is effluent from your septic system.
The proximity of your septic system to Lot 69 and the general
topography is consistent with this complaint. Because the moisture is
not being captured by the french drains around the dwelling, the
source of the moisture is not from surface or near surface flow. The
owner of Lot 69 had a Registered Professional Engineer inspect the
property and he has opined that the moisture could be from your septic
system. Tests performed on the moisture contained high numbers of the
same bacteria that are found in sewage.
Eagle County Environmental Health Division would like to have your
permission to dye test your septic system as another means of
determining the proper functioning of your system. This procedure
would involve a representative of the Division incorporating a dye
tablet in an inside toilet or directly in the septic tank, provided
access is available to the manholes.
Please respond, in writing, to this request and to schedule an
appointment, no later than 10 days after the receipt of this
correspondence.

A recent survey of lot 69 Bellyache Ridge subdivision by J & K
Engineering and Survey firm of Eagle revealed that a portion of
your individual sewage disposal system Seepage field is located
on the adjoining lot number 69. We pulled and reviewed the
original application and design for your lot. The site plan
shows the location to the East of your dwelling. The plan shows
a rectangular septic field to be located approximately 20' from
your East property line.
Chapter IV of Eagle County's land use Regulations covering the
installation of Individual sewage disposal systems section
4.04.02 (2) states "...units listed in the "Table" shall be
installed or located in accordance with the minimum distance
requirements provided in the "Table" on the following page."
The Table has been included for your information. The minimum
distance between property lines and absorption trenches, and
Seepage beds is 101.
This letter shall serve as official notice to bring -your sewage
disposal Seepage bed into the setback requirements of Eagle
County's Individual Sewage Disposal Regulations. This Violation
of Eagle County's Individual Sewage Disposal Regulations must be
corrected within 30 days of receipt of this notice.
It is unfortunate that this error was not discovered sooner. If
it had been discovered correction would have been required at
that time.

Dear Holly,
All loan inspections are completed under the authority of the
Eagle County Building Resolution, Section 3.09.03-A(7), adopted
by the Eagle County Commissioners on October 8, 1985.
An onsite inspection of the sewage disposal system on April 17,
1987 revealed that the system appears to be functioning properly
with no apparent problems. This septic system was finalized on
December 14, 1979 under ISDS Permit #422.
Potable water is supplied by the Bellyache Ridge Community Water
Supply. This water system is inspected by the State on a
regular basis.
Enclosed is an invoice for $25.00, the fee for this loan
inspection.

IMPROVEMENT SURVEY PLAT, and that it is not to be relied upon for the
establishment of fence, building, or other future improvement lines.
I further certify that the improvements on the above described parcel
on this date, April 17, 1987, e t utility connections, are
entirely within the boundaries of the as shown, that
there are no encroachments upon the described premises by
improvements on any adjoining premises, except as indicated, and that
there is no APPARENT evidence or sign of any easement crossing or
