HomeMy WebLinkAboutR91-096 redemption of certificates for tracts a,b,c,e,f,g and J Glen LyonT. commissioner (2 q 54" � Z) A) moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 91 - If9 CONCERNING REDEMPTION OF CERTIFICATES OF PURCHASE FOR TRACTS A, B, C, E, F, G, and J, GLEN LYON SUBDIVISION WHEREAS, in 1978, Gore Creek Associates (hereinafter "Subdivider), by its plat filed February 22, 1978, dedicated "for public use" Tracts B, C, D, E, F, G, H, J, and K of the Glen Lyon Subdivision; and WHEREAS, Subdivider has asserted its intention that Tracts B, C, D, E, F, G, H, J and K would transfer to the ownership of the Town of Vail, within whose boundaries the Subdivision lies, by virtue of said plat dedication; and WHEREAS, real property taxes have been levied against the Tracts for tax years 1978 through 1987, except for Tracts D and K; and WHEREAS, Subdivider's remaining interest, if any, in Tracts A, B, C, E, F, G, and J, (hereinafter "the Tracts ") was conveyed to the Town of Vail by Quit Claim Deed recorded March 17, 1988, at which time the Tracts were removed from the assessment rolls pursuant to C.R.S. 39 -3 -105. Tract H remains in the name of the Subdivider; and WHEREAS, the taxes assessed against the Tracts, as well as Tract H, have remained unpaid for tax years 1982 through 1987, and have been sold at tax sale; and WHEREAS, the holders of certain of the certificates of purchase have applied to the Treasurer for Treasurer's Deeds; and WHEREAS, after discussion with the Subdivider and with the Town of Vail, the Board of County Commissioners of Eagle County, Colorado (hereinafter "the Board ") , finds that the Tracts have been used by the general public since 1978, and that the Tracts have not provided any special benefit to any private individual since that time, and that the Tracts have been public property for all intents and purposes since 1978, and should not have been included on the assessment rolls; C WHEREAS, the Board and the Town of Vail determine that it is in the best public interest to redeem the certificates of purchase for the Tracts (excluding Tract H which remains in the ownership of Subdivider), the Board to pay one -half and the Town to pay one - half of the interest due the certificate holders at the usual rate paid to certificate holders upon redemption. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board shall reimburse the purchasers of the tax liens sold for tax years 1982 through 1987.
