RESOLUTION NO. 91 - 84
IN RE THE MATTER OF
THE APPLICATION OF MID - VALLEY ASSOCIATES
FOR PRELIMINARY PLAN OF THE EL JEBEL JUNCTION
PLANNED UNIT DEVELOPMENT
FILE NO: - PD- 283 -91 -P
WHEREAS, on or about March 1, 1991, the County of Eagle,
State of Colorado, accepted for filing an application submitted
by Mid - Valley Associates and Knight Planning Services (herein-
after "Applicant ") for approval of the P.U.D Preliminary Plan of
the El Jebel Junction Planned Unit Development, File No. PD -283-
91-P; and
g a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado, on
November 5, 1991; and
based on the evidence, testimony, exhibits, study
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, the recommendation of
the Roaring Fork Valley Planning Commission, and comments from
all interested parties, the Board of County Commissioners of the
County of Eagle, State of Colorado, finds as follows:
1. THAT proper publication and public notice was provided
as required by law for the hearing before the Planning
Commission and the Board of County Commissioners.
2. THAT an environmental impact statement was submitted
and reviewed pursuant to Section 2.10.05 of the Eagle
County Land Use Regulations. All necessary material is
contained within the report or other documentation
submitted with the application.
3. THAT on April 30, 1990, the Board of County Commis-
sioners approved the Sketch Plan with fourteen condi-
tions, and that information required by the Board of
County Commissioners at Sketch Plan Approval is
applicable.
4. THAT a P.U.D. Control Document has been submitted as a
function of the P.U.D. zone change request.

In addition, the following criteria is used for P.U.D.
evaluation pursuant to Section 2.06.13(3) of the Eagle
County Land Use Regulations:
a. Open Space (25o Minimum) - The proposal depicts
28.7% open space for the entire site which in-
cludes buffer areas, linear parks, a Village
Green, and the lake area. However, consideration
should be given to the fact that the lake, the
R.O.W. slope for Highway 82, and the area west of
Willits Lane is not necessarily "useable" open
space and therefore could be deleted from open
space calculations. In addition, a portion of
open space designated along Highway 82 will be
lost to highway construction.
b. Residential Density - As previously discussed, the
residential development intensity as proposed will
create an urban design as opposed to the small -
town character desired in the sub -area plan.
C. Commercial Density - The need for the amount of
Commercial space being proposed is not supported
by market analysis.
d. Architecture - Guidelines are incorporated into
the P.U.D. Guide.
e. Mixed Uses - This is a mixed use application that
will provide commercial, recreational and residen-
tial land uses allowing for interaction of its
residents.
f. Minimum Area - The proposal is greater than five
acres in size.
g. Open Space Maintenance - The homeowners and
merchant owners associations will be responsible
for maintenance of all amenities.
h. Employee Housing - Discussion regarding employee
housing indicates the intent to provide "afford-
able" housing.
5. THAT an application for zone district amendment has
been submitted to change to zoning from the existing
Resource District to Planned Unit Development.
6. THAT the proposal is inconsistent with the Eagle County
Master Plan.

THAT the proposal is inconsistent with the E1 Jebel
Sub -Area Master Plan.
THAT the area in question possesses geological, physi-
cal and other environmental conditions which are not
compatible with the characteristics of the use
requested, including but not limited to the fact that T!V
winter range of both deer and elk will be affected by
this development. Linear parks are proposed to act as
wildlife corridors through the project, however, the
feasibility of actual wildlife usage is questioned
given the development intensity.
THAT the advantages of the use requested do not out-
weigh the disadvantages.
10. THAT the area for which the rezoning is requested has
not changed and is not changing to such a degree that
it is in the public interest to encourage a new use or
density in the area. Furthermore, the proposed rezon-
ing is not necessary in order to provide land for a
demonstrated community need. Need for this project was
not adequately demonstrated.
11. THAT for the above stated reasons, the proposed
rezoning is not in the best interest of the health,
safety, convenience, order, prosperity, and welfare of
the citizens of Eagle County, Colorado.
MIEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT the application for preliminary plan approval and
for zone district amendment submitted by Mid- Valley Associates
and Knight Planning Services for a Preliminary Plan of the E1
Jebel Junction Planned Unit Development for the following
described parcel of land be and is hereby denied:
Southeast of Willits Lane /Highway 82
Intersection in El Jebel
