ETTE PHILLIPS EAGLE COUNTY3CLERK, PG COLORADO 0.0 D00 v. vv v-vv Commissioner U� moved adoption Of the following Re olntion: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 91- APPROVAL OF THE PERMIT TO CONSTRUCT THE REGIONAL SOLIDS PROCESSING FACILITY IN ACCORDANCE WITH SECTIONS 6.04, MAJOR EXTENSION OF AN EXISTING DOMESTIC SEWAGE TREATMENT SYSTEMS i� r WHEREAS, the Squaw Creek Wastewater Treatment Plant ( "WWTP") is located on the 3.14 acre site that is proposed for the "Regional Solids Processing Facility ( "RSPF"), thus RSPF will be an integral part of WWTP operations and will not appear as a separate facility; and WHEREAS, this site was originally permitted for the WWTP in 1980, Special Use Permit, File No. Zs- 115 -80 and then again in 1985 for expansion of the Squaw Creek Waste Water Treatment Plant, Resolution No. 85 -27; and WHEREAS, this is not a new domestic sewage treatment system, however, the sludge management facility at the existing Squaw Creek WWTP will result in the proper utilization of the existing WWTP's in the development and source development area. NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO, MAKES THE FOLLOWING FINDINGS: THAT, the proposed development does not conflict with the approved Eagle County piaster Flan and the Edwards Sub -Area Plan nor any Federal or State land use or water plans; and THAT, the proposed development will not adversely affect water rights of upstream or downstream users; and THAT, the existing domestic sewage treatment facilities are currently overloaded and must be expanded in order to properly stabilize the sewage sludge; and THAT, the proposed project will not compete with existing sewage services or create duplicate services as the sludge processing will be consolidated to provide more efficient and improved sludge stabilization; and r i r, 3 THAT, this is not a proposal to replace existing treatment systems, however, the operational efficiency and level of treatment- - warrant the addition of sludge processing at the Squaw Creek WWTP; and THAT, the Community development and population trends clearly demonstrate a need for an improved sludge processing facility and the operational information submitted by the applicant indicates a need for the proposed project; and THAT, this project is an integral part of the larger waste water treatment system and will improve the district's ability to meet discharge permit conditions; and THAT, appropriate easements can be obtained for any associated collector system that will serve existing and proposed needs; and THAT, the benefits of the proposed development outweigh the losses of any natural resources or agricultural lands rendered unavailable as a result of the proposed development; and THAT, the new facility will not affect discharges to the Eagle River from either the Vail, Avon or Squaw Creek WWTP facilities as all on site drainage around the sludge load out area will be collected and processed by the Squaw Creek facility; and THAT, the expansion should. not affect the air quality in the area as the facility will be totally enclosed with provisions for odor control; and THAT, no known aquatic habitats, marshlands, wetlands, grou- ndwater recharge areas, steeply sloping or unstable terrain, forest and woodlands, critical wildlife habitats, big game migratory routes, calving grounds, migratory ponds, nesting areas, the habitats of rare and endangered species or public out -door recreation areas will be impacted by this project; and MA _T, the proposed development will not create an undue financial burden on existing or future residents within the development area; and THAT, the construction of structures, building, and improve- ments associated with the proposed development will not significantly impact existing or proposed communities within the development area and source development area if the staff conditions are implemented and odor control is installed as needed. O O S y NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, THE PERMIT TO CONSTRUCT THE "REGIONAL SOLIDS PROCESSING FACILITY" IN ACCORDANCE WITH THE EAGLE COUNTY LAND USE REGULATIONS, SECTION 6.04, "MAJOR EXTENSIONS OF EXISTING DOMESTIC SEWAGE TREATMENT SYSTEMS" SHALL BE APPROVED PROVIDED THE FOLLOWING CONDITIONS ARE MET: 1. If significant changes or alternatives are proposed to the solids processing facility, a rehearing before the Eagle County Permit Authority may be required based on the recommendation of Community Development. 2. Surface runoff control and sediment retention fencing shall be erected to minimize non -point source impacts to wetlands and the Eagle River. 3. All construction staging areas shall be designed to contain incidental and accidental fuel and lubricant spills. 4. An Eagle County Road Cut Permit will be required prior to construction in the County Right of Way. 5. A landscaping plan shall be submitted with the Building Permit Application and installed prior to the issuance of a TCO.
