BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 91 -- �1/
IN RE THE PERMIT FOR EXTENSION OF
THE GYPSUM WATER SUPPLY TO THE AIRPORT
IN ACCORDANCE WITH SECTIONS
6.04, MAJOR EXTENSION OF AN EXISTING DOMESTIC WATER SYSTEM
AND
6.05, EFFICIENT UTILIZATION OF A MUNICIPAL WATER PROJECT
WHEREAS, on September 9, 1991, the Eagle County Board of
Commissioners, acting as the Permit Authority, approved Vail Valley
Consolidated Water District's permit for extension of the Gypsum
Water Supply ( "Project "); and
WHEREAS, the existing airport water system does not have the
capacity or water quality to provide long term water to the
airport; and
WHEREAS, the existing airport water supply system is operating
at nearly 100% of capacity and is not capable of being upgraded to
accommodate long term demand, including but not limited to fire
protection; and
WHEREAS, the Eagle County Master Plan, Public Services,
recommends that "Public Services should be provided in a cost -
effective manner with long -term implications and environmental
impacts considered "; and
WHEREAS, the Master Plan discourages the proliferation of new
or small districts when service is available from existing
suppliers; and
WHEREAS, the community development and population trends
clearly demonstrate the need for an improved water supply for the
development area; and
WHEREAS, the proposed project will not significantly degrade
existing natural scenic characteristics, create blight, nor cause
nuisance factors such as noise or odors; and

WHEREAS, the direct impact due to construction of building and
improvements associated with this project will not significantly
impact existing and proposed communities within the development
area and source development area; and
WHEREAS, the project is the least costly alternative and
provides significant benefits to the general health, safety and
welfare to the citizenry of Eagle County.
NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF THE
COUNTY OF EAGLE, STATE OF COLORADO, MAKES THE FOLLOWING FINDINGS:
THAT, based on a review of the application submitted, the
Airport Planned Unit Development and the Airport Master Plan Update
and Environmental Review and based on the testimony given, the
anticipated growth that may occur as a result of the extension of
the Gypsum water supply can be accommodated within the
development area and source development area.
THAT, the Gypsum water supply provides a long term cost
effective water supply.
THAT, based on the evidence submitted, there does not
appear to be any conflicts with other applicable Regional, State
or Federal land use water plans.
THAT, the application submitted and testimony presented
indicate that the Gypsum water system is capable of providing a
long term legal and dependable water supply that does not adversely
affect either the surface or subsurface water rights of upstream
or downstream users.
THAT, the Town of Gypsum water supply is capable of
providing adequate water supplies as required by the Colorado
Department of Health.
THAT, the agricultural lands that will be removed from
irrigation due to airport development are marginal and the public
benefits of a long term legal and safe water supply will outweigh
the losses of agricultural lands.
THAT, the evidence submitted does not indicate any sig-
nificant impacts to water quality that would violate standards
designated by the Colorado Water Quality Control Commission.
THAT, the evidence submitted does not indicate any signi-
ficant air quality impacts associated with this project.
THAT, no known aquatic habitats, marshlands, wetlands,
groundwater recharge areas, steeply sloping or unstable terrain,
forest and woodlands, critical wildlife habitats, big game
migratory routes, calving grounds, migratory ponds, nesting areas,
the habitats of rare and endangered species or public out -door
recreation areas will be impacted by this project.
THAT, there is one prehistoric site (5ea956) identified
within the area that should be avoided. If it is not possible to
avoid this area then the site will be tested to determine its
eligibly for the National Register.
THAT, the project will create a financial obligation to
the taxpayers of Eagle County but it is not considered an "undue
financial burden."
THAT, the only significant natural hazard that has been
identified is the potential for unstable geologic conditions and
operational breakdown which can be mitigated by site specific
engineering.
THAT, the proposed project will not contaminate surface
water resources.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Vail Valley Consolidated Water District's permit for
extension of the Gypsum Water Supply be approved with the following
conditions:
1. A landscape plan (including irrigation with non -
treated water) and water conservation plan be developed and
implemented for the airport PUD.
2. The best available technology will be used to control
fugitive dust during construction.
3. The storage tank will be located and be of a color
that minimizes visual impact. The recommendations of a Registered
Professional Engineer will be reviewed and approved by the Director
of Community Development prior to construction.
4. The Eagle County Engineering Department will be
consulted concerning the placement of sleeves under Cooley Mesa
Road and Spring Creek Road prior to construction.

5. That a contract is executed between the Town of
Gypsum and the Vail Valley Consolidated Water District that
contains the terms for provision of water by the Town to the
District.
