This fee is authorized by Eagle County Individual Sewage Disposal System Regulations adopted and effective March 27, 1980. For minor repairs of less than $100.00 for maintenance of the individual sewage disposal system, no fee shall be required. A percolation test fee of $125 shall be charged for all new leach fields on repair permits. Percolation testing may be waived at the discretion of the Environmental Health Officer on certain repair cases where prompt action must be taken to prevent a health hazard. This malfunctioning leachfield must be repaired or replaced within 60 days receipt of this notice. You must apply for a repair permit within 30 days receipt of this notice. I have enclosed an application for a repair permit and a typical diagram of a dry well. Strict water conservation measures must be implemented until the system is repaired and the septic tank should be pumped to provide for storage capacity. The following repair specifications are recommended: * Install a dry well between the existing septic tank and the existing leachfield. Diameter of excavation = 10 feet Depth below inlet = 8 feet Provide an overflow connection into the existing leachfield. * The existing leachfield will be evaluated this spring to determine if repairs are feasible. As you know, your sewage disposal system has malfunctioned, i.e.; effluent from the leach field has surfaced on the ground. However, during my inspection on March 7, 1989, I did not see effluent surfacing at that time. Continued water conservation will help to minimize the surfacing of :.effluent..from-: the„ leach field. The deadline for repair remains March 31, 1989. However, if this repair order presents a hardship to you, you must have the septic tank pumped as soon as possible. The repair deadline can be extended as long as storage capacity remains in the septic tank and effluent is not surfacing on the ground. A pumped septic tank will provide temporary storage while arrangements are made for repair of the leach field. Please provide this office with proof.of septic tank pumping, i.e.; a copy of the receipt for septic tank pumping. Enclosed is.:a copy of licensed pumpers for your consideration. Merr Re: Status of Septic System/connected to 109 Cedar Court, Gypsum, Colorado On January 2, 1990 this office received a complaint regarding surfacing sewage allegedly coming from the septic system located in the easement adjacent to 109 Cedar Ct. Several attempts were made to notify the responsible party, Mr. Aldo Noriega, of the apparent problem. Contact was finally made with his wife, Judy, on January 8, 1990 and she informed me Mr. Noriega would be back on January 11, 1990 and would contact me to set up a site visit. The complaintant was informed of this schedule. Mr. Noriega contacted me on January 11, 1990 and asked me to meet him on site at 3:00 p.m. Upon my arrival he explained the septic system design to me including the work he had done in October which was expected to remedy the situation. (see file). There was an accumulation of ice coming from an area about 15 feet from the nearest trench of his system. The ice appeared to be fairly clear and a small flow of liquid was noted coming from the side of the hill. The temperatures over the last several days reached the 50 degree range. The problem is compounded by the presence of a pig pen partially located on the easement for the septic leachfield. The pigs have eliminated the vegetation with the exception of a few cedar trees, thus significantly reducing the ability of any leaching effluent to be absorbed by plants. Mr. Noriega and I discussed many scenarios which could be causing the seepage as well as preliminary measures which could be taken until more investigation could be done once weather permitted. One of the measures to be taken is to block the flow to the farthest trench forcing the effluent into the newly constructed seepage pit. Another measure which will be taken is to re -survey the pipes to assure they are level or slightly sloping toward the seepage pit. Mr. Noriega informed me that he would keep me informed of these modifications. I am still not convinced that the liquid surfacing is due to a failing septic. It may be from surface drainage going below ground momentarily and surfacing out the side of the hill. It may, however, be coming from the leachfield following a channel of least resistance through the trenches and out near the hill. As the geology exhibits many large boulders, perhaps there is insufficient soil in that area to properly absorb effluents. There are many possibilities and Mr. Noriega is wanting to correct the problem if it is his problem. I informed the complaintant on January 12, 1990 of the progress. MEMORANDUM TO: ISDS File No. 683 FROM: Raymond P. Merry, R.1c Environmental Health DATE: March 29, 1990 RE: Complaint of grading on septic easement at Lot 1, Ceder Court, Gypsum, Colorado On March 26, 1990, I was asked by Mr. Noriega to inspect the property on which his septic leach field easement is located. Mr. Noriega said that his neighbor, Trent Eichler, who owns the property on which the easement is situated, did a substantial amount of grading on Friday, March 23, 1990. The reason Mr. Noriega was so upset was because he is afraid his septic absorption system will fail. I took four photographs which attempt to show the grading which was done. Mr. Eichler has a pig pen which is apparently situated partially within the area designated for Mr. Noriega to use as a leach field easement. The fence was apparently installed a couple of years ago and the grading, which was recently done, extends further into the rear of the lot. The horizontal depth of the excavation toward the rear of the pig pen area is approximately 8 - 10' and the horizontal distance between the newly installed seepage pit and the side wall of the excavation appears to be less than 101. In Section 4.04.02 of the ISDS Regulations, it states "The minimum horizontal distance required from cut banks and fill areas to individual sewage disposal system components discharging effluent into or onto the surrounding soil shall be four times the height of the bank, measured from the top edge of the bank." (See attached diagram.) The recently excavated area significantly reduces the area specified for absorption and increases the potential for Mr. Noriega's system to fail. I informed Mr. Noriega that should his system fail, he would be required to fix it as he is responsible for the proper operation of his system. He was also informed that, in my opinion, the situation regarding his neighbor's activities are civil in nature. RM/mk 4.04.02 MINIMUM HORIZONTAL DISTANCES BETWEEN COMPONENTS OF A SYSTEM AND PHYSICAL FEATURES 1) Minimum horizontal distances from the various components of a system to pertinent terrain features, including streams, lakes, water -- courses, springs, wells, subsoil drains, cisterns, water lines, suction lines, gulches, dwellings, other occupied buildings and property lines, shall be in accordance with the following "Table of Minimum Horizontal Distances in Feet Between Components of a Sewage Disposal System Installed After November 15, 1973, and Pertinent Physical Features." 2) New wells, springs or potable water supply suction lines and all other constructed units listed in the "Table" shall be installed or located in accordance with the minimum distance requirements provided in the "Table" on the following page. 3) The minimum horizontal distance required from cut banks and fill areas to individual sewage disposal system components discharging effluent into or onto the surrounding soil shall be four (4) times the height of the bank, measured from the top edge of the bank.
