**CONDITIONS:
1. All installation must comply with all requirements of the County Individual Sewage
Disposal System Regulations, adopted pursuant to authority granted in 25-10-104,
C.R.S. 1973, as amended.
2. This permit is valid only for connection to structures which have fully complied
with County zoning and building requirements. Connection to or use with any
dwelling or structure not approved by the building and zoning departments shall
automatically be a violation of a requirement of,the permit and cause for both
legal action and revocation of the permit.
3. Section III, 3.21 requires any person who constructs, alters, or installs an
individual sewage disposal system to be licensed according to the Regulations.
FINAL APPROVAL OF SYSTEM: No system shall be deemed to be in compliance with the Eagle
County Individual Sewage Disposal System Regulations until the installed system is
approved prior to covering any part.

sewage disposal system installed on Lot 3, Block 1, Peachblow
subdivision. However, we cannot complete our file until an
accurate "as built" site plan is submitted for the installed
individual sewage disposal system. The original site plan that
you submitted is not accurate.

Dear Mr. Higens,
All loan inspections are completed under the authority of
the Eagle County Building Resolution, Section 3.09.03, A (7),
adopted by the Eagle County Commissioners on October 8, 1985.
An on -site inspection of the sewage disposal system on
May 15, 19-87 revealed.that the septic system appears to be
functioning properly. This individual sewage disposal system
was permitted and installed in accordance with State and County
Regulations. Final approval for Individual Sewage Disposal
Permit Number 581 was granted on June 36, 1986.

Dear Mr. Higens:
We received your application permit for an Individual Sewage
Disposal System (#970) and your check for $200.00 (receipt
#1813 encl:osed), fee for application and percolation test for
property located on Lot 3, Block 1, Peachblow Subdivision.
You will need to call us when you are ready for the Percolation .
Test. In preparation for this test, you will have to dig three
(3) holes in the area of the proposed drainage field. These three (3)
holes should be at least ten (10) feet a part, be six (6) inches to
a foot in diameter and be two (2) feet deep. The holes should be
pre-soaked with water 24 hours the day before we do the test. The
purpose of this test is to determine the rate of water absorption
into the ground for sizing the septic drain field.
Please notify this office the day before you want this test done so
we can schedule our time accordingly, telephone 328-7311, extension
238, or call our toll free number, 927-3823.

9. An abstract of title to the Property, certified to date, or a current commitment for title insurance policy in an
amount equal to the purchase price, at Seller's option and expense, shall be furnished to Purchaser on or before !

12. Except as stated in paragraphs 11 and 13, if title is not merchantable and written notice of defect(s) is given by
Purchaser or Purchaser's agent to Seller or Seller's agent on or before date of closing, Seller shall use reasonable
effort to correct said defect(s) prior to date of closing. If Seller is unable to correct said defect(s) on or before date of
closing, at Seller's option and upon written notice to Purchaser or Purchaser's agent on or before date of closing, the
date of closing shall be extended thirty days for the purpose of correcting said defect(s). Except as stated in paragraph
13, if title is not rendered merchantable as provided in this paragraph 12, at Purchaser's option, this contract shall be
void and of no effect and each party hereto shall be released from all obligations hereunder and all payments and
things of value received hereunder shall be returned to Purchaser.
13. Any encumbrance required to be paid may be paid at the time of settlement from the proceeds of this
transaction or from any other source._ Provided, however, at the option of either party, if the total indebtedness
secured by liens on the Property exceeds the purchase price, this contract shall be void and of no effect and each party
hereto shall be released from all obligations hereunder and all payments and things of value received hereunder shall
be returned to Purchaser.
14. General taxes for the year of closing, based on the most recent levy and the most recent assessment, prepaid
rents; water rents; sewer rents, FHA mortgage insurance premiums and interest on encumbrances, if any, and

16. In the event the Property is substantially- damaged by fire, flood or other casualty between the date of this
contract and the date of delivery of deed, Purchaser may elect to terminate this contract; in which case all payments
and things of value received hereunder shall be returned to Purchaser.
17. Time is of the essence hereof. If any note or check received as earnest money hereunder or any other payment
due hereunder is not paid, honored or tendered when due, or if any other obligation hereunder is not performed as
herein provided, there shall be the following remedies:
(a) IF PURCHASER IS IN DEFAULT, then all payments and things of value received hereunder shall be
forfeited by Purchaser and retained on behalf of Seller and both parties shall thereafter be released from all
obligations hereunder. It is agreed that such payments and things of value are LIQUIDATED DAMAGES and
(except as provided in subparagraph (0) are the SELLER'S SOLE AND ONLY REMEDY for the Purchaser's
failure to perform the obligations of this contract. Seller expressly waives the remedies of specific performance
and additional damages.
(b) IF SELLER IS IN DEFAULT, (1) Purchaser may elect to treat this contract as terminated, in which case
all payments and things of value received hereunder shall be returned to Purchaser and Purchaser may recover
such damages as may be proper, or (2) Purchaser may elect to treat this contract as being in full force and effect
and Purchaser shall have the right to an action for specific performance or damages, or both:'
(c) Anything to.the contrary herein notwithstanding, in the event of any litigation arising out of this
contract, the court may award to the prevailing party all reasonable costs and expense; including attorneys' fees.
18. Purchaser and Seller agree that, in the event of any controversy regarding the earnest money held by broker,
unless mutual written instruction is received by broker, broker shall not be required to take any action but may await
any proceeding, or at broker's option and discretion, may interplead any moneys or things of value into court and may
recover court costs and reasonable attorneys' fees.

19. Additional provisions: this contract is expressly contingent upon purchasers obtait
+,approval for a building permit to move a 1440 square foot modular home owned by th(
;,onto subject property. Purchasers shall immediately upon acceptance of this contra:
I1shall apply for such permit. Purchasers shall also immediately submit to Miller
INichols, 310 Ward Parkway, Kansas City, MO 64112 plans and specifications for his
approval. In the event approval for such building permit and/or plans is den'
within 60 days of acceptance of this contract, then either party may declare i
contract null and void and all ernest monies receipted for shall be returned
to purchasers. If however the building permit is denied solely because Eagle
i County classifies the modular home as a "mobile" home then -purchasers agree tc
promptly arrange .for the purchase of a modular home which would meet the count
requirements for a "modular" home. In that event this. contract shall be couti
gent upon purchasers obtaining satisfactory financing for the modular home.
Purchasers further agree to promptly apply for such financing for the home ane
agree to provide the lender with any and all information it may reasonably
�) require. If such financing is not approved within 60 days of acceptance then
either party may declare this contract null and void and all monies receipted
for shall be returned to purchasers.
This contract is also contingent upon the parties agreeing upon the location c
the easements referred to in paragraph 4 and entering into a satisfactory ".wel
maintenance agreemeflt." If these points can not be agreed upon within 30 days
of.acceptance then this contract may be declared null and void and all monies
receipted for shall be returned to purchasers.
20. If this proposal is accepted by Seller in writing and Purchaser receives notice of such acceptance on or before

inure/to the benefit of the heirs, successors and assigns of such parties, except as stated in paragraph 7.
