This letter is to assure you that the Eagle County
Building and Planning Department will issue you a building
permit for seventeen units according to the plans dated May
26, 1981 once either a written commitment is received from
Pure Cycle stating that they will provide you with their
units or you receive another acceptable form of water and
sewer service.
This approval is good for a 90 day period from the date
of this letter.

Excerpt from minutes of January 27, 1981
Mr. Edeen advised the final item on the agenda was a continued hearing of the application for a
Pure Cycle sewage disposal system by Billy Dittmar. This matter was first heard by the Board
on December 30, 1980. The Planning Staff had reviewed the site and written a letter to Mr.
Dittmar indicating that under the zoning if he complys with all other County regulations there
could be up to 17 units based on slope and square footage.
This item was tabled on December 30, 1981 as the Board wanted more information on whether the
3/4" water tap would be adequate. Also this was tabled on the basis that this adjoined the
Town of Basalt and the Basalt Sanitation District. The Board wanted letters from them indicating
whether they could provide service to the property.
Lee Herkel, representing the Town of Basalt and the Basalt Sanitation District, summarized the
letters stating the Town and the Sanitation District would not serve outside users unless they
were annexed into the District.
Chairman Grant advised as the Board of Health they cannot make any land use decisions. As far
as he is concerned if the sewage has to be recycled for drinking water the County has a problem.
Mr. Edeen advised the immediate problem is Mr. Dittmar has made an application for an individual
sewage disposal system under the provisions of the County regulations. According to State
statute this type system must be reviewed by the Board of Health.
Mr. Edeen advised the Staff's recommendation is based on information he has obtained from the
State and other Counties. He presented a letter from the Water Quality Control Division.
Based on information acquired the Staff would recommend approval of the application. He
advised this application is for a sewage disposal system and not a water supply. The Board
has no authority to review this as an individual water supply.
Commissioner Troxel moved the Board of Health approve the application of Mr. Dittmar as per
recommendations by the Staff. The Board is complying with State regulations in regards to the
Pure Cycle experimental sewage disposal system.
In discussion of his motion Commissioner Troxel advised it is not a land use decision of the
Board at this time.
Commissioner Williams seconded the motion and the Chairman declared the vote unanimous.
Commissioner Williams advised the direction to the Staff is the motion was voted on unanimously
as the Board of Health only in regards to the experimental system for sewage disposal. It
does not speak to any other land use decisions and/or circumstances regarding the building
permit or water supply.

PURECYCLE APPROVED IN NEW MEXICO AND ARIZONA
Boulder, Colorado - Mark S. Palmer, Regional Sales Manager with PureCycle
Corporation, announced today that it has recently received approval by
authorities in the states of New Mexico and Arizona to install its Water
Recycling System.
In addition to the approval in the state of Arizona the Company .received an
order valued at approximately $250,000.00 for twenty-four (24) units with
deliveries beginning in May of 1981. PureCycle Corporation intends to open a
Service Center in Arizona and has begun an intensified marketing program there.
PureCycle Corporation manufactures a water recycling system which will purify
and recycle all domestic wastewater to high quality drinking water.

The proposed townhome clusters should be founded
with spread footings placed on the underlying
stiff sandy clay or granular subsoils and designed
for a maxi mun soil pressure of 3,000 psf with ..
design details and precautions as discussed in the
report.
SCOPE
This report presents the results of a soil and foundation investigation
for the proposed tacmhome development to be located on Lot 13, Eppley
Subdivision, Basalt, Eagle County, Colorado. The report presents the
recommended type foundation, allowable bearing pressure, general subsoil
conditions together with other soil related design and construction
details.
The proposed development will consist of two multi -family, three
story structures with lower basement and garage levels excavated into
the hillside. Construction will be typically concrete masonary unit
supporting wood floor and roof systems. Proposed building locations are
shown on Figure 1. Maximiun mit depths for buildings 1 and 2 are expected
to be about 20 feet and 10 feet, respectively. Final retained height will
be about 10 feet maximum.
SITE CONDITIONS
At the time of our field work, the site was covered with grass,
weeds, scattered sage, and some pinon. and deciduous trees. The ground
surface is sm-ewhat irregular and generally slopes down to the southeast.

The grade is gentle to moderate sloping within the northern portion and
moderately steep to steep sloping in the south and east portions. A
relatively flat pasture is located directly northwest of the building area.
Maximum elevation differential across the lot is on the order of 70
feet and across the building area on the order of 30 feet. Several old
irrigation ditches, presently dry, and large boulders to about 10
feet in diameter, are located within the flatter portion of the site.
A single story wood frame residence adjacent the northeast site boundary
appears in good condition from a subsoil viewpoint.
SUBSOIL CONDITIONS
Subsoil conditions were investigated by excavating 4 exploratory
pits at the approximate locations shown on Figure 1. Graphic logs of
the subsoil profiles are shown on Figure 2. As indicated by the logs,
the subsoil profile is irregular. In general, the pits showed a 1 to 1
1/2 foot topsoil layer, 1 to 2 1/2 feet of porous and calcareous silty
clay overlying a dense, silty to clayey gravel, cobble and boulder mixed
deposit. At Pit 1, a stiff to very stiff silty sandy clay with occasional
subangular boulders to ± 3 feet diameter was encountered to the maximum
pit depth, 9 feet. At Pit 2, the coarse granular subsoils were excavated
directly below the topsoil. The gravels , cobbles, and boulders were
described as subangular to angular and ranged to ± 5 feet maximum size.
They appeared to be mainly basalt derived. Practical backhoe refusal due
to large material size was encountered in Pits 1, 3, and 4.
Results of consolidation tests performed on the fine-grained soils
are shown on Figures 3, 4 and 5. Figures 4 and 5 indicate the upper porous
and calcareous silty clay to possess a high settlement potential

whereas Figure 3 indicates the underlying stiff, silty,,clay at_Pit
1 to have a low settlement potential under loading and wetting. Gradation
test results on.the minus 5 inch size fraction of the granular subsoils
are shown on Figure 6.
Moisture content was described as being dry to slightly moist and
no free water was encountered at the time of pit excavations.
FOUNDATION RDCaMMENIDATIONS
The upper topsoil and low density clays possess high settlement
potential and are not suitable for foundation support. Considering the
proposed construction and the general subsoil conditions, we recommend
the buildings be founded on spread footings placed on the underlying very
stiff clays or granular soils. The following design and construction details
_ should be observed:
(1) Footings should be placed on the natural stiff, sandy clay and/or
the dense granular subsoils below all topsoil and low density clays
and designed for an allowable bearing capacity of 3,000 psf. Under -
existing low moisture, initial settle-ent should be relatively minor.
Additional differential settlement of about 1/2 to 3/4 inch should
be anticipated if the subsoils were to become wet.
(2) Minimum footing width should be taken as 16 inches for bearing walls
and 2 feet for columns.
(3) Continuous foundation walls should be adequately reinforced to span
local anomalies. Basement walls acting as retaining structures
should be designed to resist an equivalent lateral earth pressure
of 45 psf per foot of depth. Back -fill should consist of granular soils
free of oversized material compacted to at least 900 of standard
Proctor density. The backfill surface should be graded to drain away

from the structure.
(4) All topsoil, low density upper clays, disturbed material and any
local soft pockets of soil found at the base of the foundation
excavation should be removed and the excavation extended to the
lower very stiff clays or granular soils. Boulders should be
carefully removed to minimize disturbance. A representative of
the soils engineer should observe the excavation to verify proper
bearing material.
(5) All footings should be provided with adequate soil cover above the
bearing elevation for frost protection.
GROUND FLOORS
The on -site soils, other than topsoil, are suitable to support
lightly loaded floor slabs. The low density upper clays are sensitive
to moisture fluctuations and there is a risk_ of some settlement. In
slab -on -grade floor areas, we recommend all topsoil and disturbed soil be
removed and the exposed subgrade be scarified, moistened and compacted
to at least 90% of standard Proctor density. The on -site sandy clay and
granular soils free of oversized material should be suitable for use as
structural fill. Compaction of backfill should be at least 95% of
standard Proctor density at a moisture content near optimun.
To reduce the effects of some differential movement, slabs should
be separated from bearing hers with a positive expansion joint and
adequately reinforced. A miniman 4 inch layer of gravel should be
provided immediately beneath concrete slabs -on -grade to help distribute
the loadings.

The upper natural subsoils are susceptible to consolidation upon
changes in moisture content. It is important that good surface drainage
be maintained both during construction and for the life of the building.
The following details should be observed:
(1) Excessive wetting or drying of the foundation excavation should be
avoided during construction.
(2) Miscellaneous backfill around the structure should be moistened and
compacted to at least 900 of standard Proctor density.
(3) The ground surface surrounding the exterior of the building should
be sloped to drain away from the structure in all directions. Vwe
rend a minimum slope of 6 inches in the first 10 feet. poof
downspouts and drains should discharge well beyond the limits of
all backfill.
This report has been prepared in accordance with generally accepted
soil and foundation engineering practices in this area for the use by
the client for design purposes. The conclusions and recommendations
submitted in this report are based upon the data obtained from the test
pits excavated at the locations indicated on the test pit plan. The
nature and extent of variations between the test pits may not become
evident until excavation is performed. If, during construction, soil
and ground water conditions appear to be different from those described
herein, this office should be advised at once so that re-evaluation of

excavations and foundation bearing strata by a soil engineer.

Dear Sirs,
This is an application for a permit to install 17
individual systems which recycle treated waste water for potable
purposes, to serve 17 apartments at Lot 13 Epply Subdivision.
This site plan is to serve ONLY for the purpose of obtaining
a permit to install individual sewerage systems and will be
intergrated at a later time to "the plot plan" for the purpose
of obtaining a building permit.
The systems proposed to be installed are governed
under the Eagle County Individual Sewage Disposal Regulations
adopted February 1980 and especially delt with under Section 9,
Subsection .8-C-1 & 2 pertaining to "Systems Which Recycle
Treated Wastewater for Potable Purposes", it states:
1. No system shall be permitted which will recycle
wastewater for potable purposes except a system
which shall consistently meet all of the sanitation
and maximum contaminant level requirements of rules,
regulations, and standards of the Colorado Department
of Health and of the Eagle County Borad of Health.
2. The recycling systems are experimental, and, as such,
require a back-up feasibility plan for alternate
water and sewage disposal in the event of failure
of the recycling system.
To satisfy 9.8 - C - 1
The systems to be used are manufactured and .serviced by
PureCycle, Inc. All data concerning those systems are on file in
the Eagle County Environmental Health Office. An additional copy
is included with this application. Those systems are certified and
approved to conform to the rules, regulations and standards of the
Colorado Department of Health.and are currently in use throughout
the southwest USA.
To satisfy 9.8 - C - 2
Back up Feasibility Plan.
The systems basic components are 2 tanks holding 1,500
gallons each. Both of these tanks are excessable at any time. One
tank serves to contain fresh water and the other waste water. It is
proposed to use those 2 tanks as holding tanks upon equipment failure
and service them as required.

Additional Fresh Water Availability.
The property is served at the present time by a 3/4"
water line using water from the Basalt City Water System. It
is proposed to use such water as an additional backup system in
case of failure.
I would like to ask the Eagle County Board of Health
to evaluate the proposed project on its merits.of Health Regula-
tions ONLY and to approve the installation of 17 individual Pure -
Cycle Systems.

WHEREAS, the Board of Trustees of the Town of Basalt
and the Board of Directors of the Basalt Sanitation District
recognize that good and adequate water and sewer services are•
essential to the health, safety and welfare of the Basalt com-
munity; and
WHEREAS, the parties hereto declare and find that one
body should not obligate itself to provide services to an area
of the community unless the other body also obligates itself to
provide services to that area; and
WHEREAS, the Town of Basalt has been and will be peti-
tioned to annex certain lands within the boundaries of the Town
and the Basa-lt Sanitation District has been and will be petitioner
to include certain lands within the boundaries of its district;
NOW MEREFORE the Board of Trustees of the Town of
Basalt and the Board of Directors of the Basalt Sanitation Dis-

I understand that Billy Dittmar has applied for a building permit
from Eagle County for his parcel adjacent to Basalt near the town's
water tanks. I assume that the permit includes the use of a Pure
Cycle system.
I have spoken with several people from the Pure Cycle main office in
Boulder. They apparently have no plans to open a service office
in the Roaring Fork Valley, which would be required before they
would sell any of their units to Mr. Dittmar. There is also a
minimum eighteen month delivery time on these units. Therefore, it
appears that no building occupancy would be possible on the
Dittmar property for some time.
ISdon't feel that anyone will benefit from the county's approval
of "paper"development projects, which this one would most likely
become. Thereareother obvious problems associated with the site
including inadequate access, limited fire protection, and incon-
sistent land use with the adjacent existing uses. Therefore, I
would like to suggest that you require a service contract for the
Pure Cycle systems prior to issuance of a building permit.
The Basalt Comprehensive Plan is so far indicating that the town's
growth may include Mr. Dittmar's parcel.

I hope so, because your department and the County of Eagle is about
to get one.
"PureCycle" is the trade name of a domestic water and scw'age recycling
system marketed by the PureCycle Corporation, Post office Box 671, Boulder,
Co 80306. I 1-2.ve personally made inquiries of the PureCycle Corporation
regarding the certification of their product and the limits of its use,
ho:aever, as of this date I have received no information. I'm a little
suspicious about this so I have writteiz the Colorado Department of health
and I am writing you.
There is a four acre plot of land adjacent to the city limits of the
Town of Lasalt, Colorado, within the jurisdiction of the County of Eagle.
The owner of this property ;ranted to build an apartment complex of seventeen
units there, 'out upon approaching the torn for annexation was turned down
by the Town Board, the Town 1,11ater District, and the Torn Srnitation District
on the grounds that the density proposed was in conflict with densities already
established in adjoining city jurisdictions. Subsequently, the owner,
Billy Dittmar, approached the county for a building permit and, through an
admitted oversight, the county issued the permit. Now all that T'-;Tr. Ditt:rar
lacked was the water supply and sewage disposal facilities denied him by the
to,an water and server districts. Being a resourceful man, he found the so-
lution to this in the PureCycle.
I mentioned above that I have asked the FureCycle Corporatior_ for its
credentials and have received no response to the question. I did, however,
receive sales literature indicating th-ot the device was sufficient and
appropriate for single family -residences. Single family residences are
not, of course, seventeen unit dondominium or apartment complexes.

In response to your request for comments regarding the above subject, I
have the following:
The Environmental Health Department approved ISDS Permit #516 upon
the conditions that (1) PureCycle service center is located in the
Eagle, Garfield, or Pitkin County areas , and (2) that the potable
water portion be tested once per month for safety, bacteria, and
toxic chemicals. Must follow the design as set forth in the permit
application.
Condition (1) is given because the Individual Sewage Disposal System
Regulations for Eagle County, adopted February 1980 and effective
March 27, 1980, state:
"SECTION XI: MANUFACTURED UNITS UTILIZING MECHANICAL APPARATUS
FOR TREATMENT OF SEWAGE
11.1 No such unit utilizing mechanical apparatus and which is
designed for discharge either upon the ground or beneath
the ground surface or which may adversely affect Eagle
County waters shall be permitted unless (1) the system
is installed within a geographicarea wherein a public,
quasi -public, or private entity, or political subdivision
is continually responsible for the efficient operation
and maintenance of said unit, or r2) the operator of
the system insures such an efficient operation of all
mechanical and electrical component parts provided prior
to and during continuing use."
Condition (2) is given because potable water is --a requirement for any
dwelling intended for use with human occupation.

PURECYCLE NAMES WARREN VAN GENDEREN PRESIDENT
Boulder, Colorado - The Board of Directors of PureCvcle Corporation announced
today that Warren Van Genderen will succeed Stanley R. Swanson as President
and Chief Executive Officer.
Mr. Van Genderen has a mechanical engineering degree from Massachussetts
Institute of Technology and an M.B.A. degree from Harvard University. In
recent years, he has been active in starting, financing, and managing small
businesses.

This supersedes our letter of December 10, 1980 addressed to
Pure Cycle.
It is the intent of this Department to approve the current
design of the Pure Cycle system for use as an individual
sewage disposal system in the State of 'Colorado.
For this reason, the following 4 minimum horizontal distances
are waived for the current Pure Cycle system: (see page 22 of
ISDS Guidelines dated May 16, 1979)
1. Potable water supply line to building sewer.
2. Potable water supply line to septic tanks,
treatment plants, dosing tanks or effluent lines,
3. Potable water supply`cistern.to building sewer.
4. Potable water supply cistern to septic tank,
treatment plants, dosing tanks, or effluent lines.
