HomeMy WebLinkAboutR91-014 vacation of Squaw Creek Road•Y•'Y L:V JV SOHNNETTE PHILLIPS , AGLE COUNTY CLERK, COLORAD 0.00 0.00 �� __aa lCya Commissioner moved adoption of # the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 91 - - /!5� VACATION OF A PUBLIC RIGHT -OF -WAY SQUAW CREEK ROAD, COUNTY OF EAGLE, STATE OF COLORADO WHEREAS, pursuant to § 43 -2 -301, et sec., C.R.S., and § 2.22 of the Eagle County Land Use Regulations, 1982, as amended, the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter the 'Board "), has the power and authority to vacate any public right -of -way or easement located entirely within the County of Eagle, State of Colorado; and WHEREAS, the portion of the public right -of -way hereby sought to be vacated was originally granted to the County by a Right -of -Way Deed dated November 9, 1931, recorded in Book 116 at Page 105; and WHEREAS, the portion of Squaw Creek Road hereby sought to be vacated is bounded by private property owned by Jack Beals; and WHEREAS, the County desires to abandon and vacate said portion of the right -of- way to Jack Beals, as the present road is not located in the existing and used right -of- way; and WHEREAS, the existing Squaw Creek Roadway is dedicated to the County as a public right -of -way by separate action; and WHEREAS, notice of the public hearings before the Colorado and Eagle Valley Planning Commission and the County to consider the proposed vacation of the subject public right -of -way was duly published in the Eagle Valley Enterprise, and all affected governmental agencies, adjacent property owners and public and private utilities were notified of the proposed vacation; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the County finds that the subject right -of -way is located entirely within the County of Eagle and is not within the limits of any city or town, and, further, that said portion of the right -of -way is no longer necessary as part of the County road system. THAT, vacation of that portion of Squaw Creek Road as described in attached Exhibit A is granted. -1- c,- 6- THAT, upon the recording of this Resolution, the attached Exhibit, and all corresponding quit claim deeds, the County hereby divests, relinquishes and vacates any and all rights it may have in the public right -of -way, as described in the attached Exhibit A, which is incorporated by reference herein. THAT, aforesaid vacation of a portion of said right -of -way described in Exhibit A shall not be construed as affecting in any way whatsoever any and all existing recorded easements necessary for utilities or other public services, nor the remainder of said right - of -way for Squaw Creek Road. THAT, the Board finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the citizens of the County of Eagle, State of Colorado.
