HomeMy WebLinkAboutR91-009 approving IGA creating emergency telephone authorityCommissioner (o G1 moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 91 -__!?_ A RESOLUTION APPROVING THE INTERGOVERNMENTAL AGREEMENT CREATING THE EAGLE COUNTY EMERGENCY TELEPHONE SERVICE AUTHORITY IN ORDER TO ESTABLISH AND OPERATE AN EMERGENCY TELEPHONE SERVICE SYSTEM WITHIN EAGLE COUNTY; AUTHORIZING THE IMPOSITION OF AN EMERGENCY TELEPHONE CHARGE UPON TELEPHONE EXCHANGE ACCESS FACILITIES WITHIN EAGLE COUNTY; AND AUTHORIZING SERVICE SUPPLIERS TO COLLECT EMERGENCY TELEPHONE CHARGES. WHEREAS, the Resolution is intended to approve an Intergovernmental Agreement for E911 service between the Board of County Commissioners of the County of Eagle and certain other Eagle County governmental entities; and WHEREAS, on or before January 14, 1991, said Intergovernmental Agreement was executed by the parties to it; and WHEREAS, in the interest of protecting and preserving public safety and welfare, it is desirable that the citizens of Eagle County, Colorado be provided with emergency telephone service (hereinafter "E911) to aid in the timely provision of emergency service; and WHEREAS, the Emergency Telephone Service Act, C.R.S. 29 -11 -101, (hereinafter the "Act "), authorizes governmental entities to impose a charge upon each exchange access facility (telephone service subscriber line) to pay for the installation costs and the directly related costs of the continued operation of E911; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS- SIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO, AS FOLLOWS: 1. The Chairman of the Board of County Commissioners is authorized to execute the Intergovernmental Agreement creating the Eagle County Emergency Telephone Service Authority in order to establish and maintain an E911 service system in Grand County. 2. Pursuant to the Act, there may be imposed upon all telephone access facilities within Eagle County (except as are already assessed a charge for participation in the Aspen /Pitkin County E -911) an emergency telephone charge in an amount not to exceed Seventy Cents ($0.70) per month. Upon recommendation of the Eagle County Emergency Telephone Service Authority, the Board may, by Resolution, raise or lower the emergency telephone charge, but in no event shall such charge exceed Seventy Cents ($0.70) per month. 3. Telephone service suppliers providing telephone service in Eagle County are hereby authorized to collect an emergency telephone charge imposed by this Resolution in accordance with 29 -11 -101, et. seg., in the amount if Fifty -Five ($0.55) per month. No such charge shall be imposed upon more than one hundred exchange access facilities or their equivalent per customer billing. Such charge shall not be imposed upon any state or local governmental entity. 4. This Resolution shall be in effect immediately. 5. The following Eagle County residents are hereby appointed as the governing body of the Eagle County Emergency Telephone Service Authority, who shall serve the terms stated hereunder, pursuant to the direction of the above - referenced Intergovernmental Agreement: Randy Garman, Authority President (East of Wolcott) January 14, 1991, to and including January 13, 1994. James Thomason, Authority Secretary (East of Wolcott) January 14, 1991, to and including January 13, 1993. Mary Hoza (West of Wolcott) January 14, 1991, to and including January 13, 1993. Dick Rodgers (West of Wolcott) January 14, 1991, to and including January 13, 1994. Ron Smith (At Large) January 14, 1991, to and including January 13, 1992. The Governing Board of the Authority shall serve at the pleasure and as the Agent of the Board of County Commissioners of Eagle County. 6. The County Manager shall contact the County's liability carrier and procure a letter from the carrier that Governing Board is covered under the County's liability insurance policy.
