*CONDITIONS:
1. All .installation must comply with all requirements of the County Individual Sewage Disposal Regulations,
adopted pursuant to authority granted in 25-10-104, CRS 1973 amended 25-1-614, CRS 1973
2. This permit is valid only for connection to structures which have fully complied with County Zoning and
building requirements. Connection to or use with any dwelling or structures not approved by the building
and Zoning office shall automatically be a violation of a requirement of the permit and cause for both
legal action and revocation of the permit.
3. Section III, 3.24 requires any person who constructs, alters, or installs an individual sewage disposal
system in a manner which involves a knowing and material variation from the terms or specifications con-
tained in the application of permit commits a Class I, Petty Offense ($500.00 fine - 6 months in jail or

RE: IMPROPER SEPTIC DISCHARGE UPON a parcel of land situated
in Tract No. 90 & 91 of Section 18, Township 5 South,
Range 85 West of the Sixth Principal Meridian, lying
Westerly of the Westerly right-of-way line of a County
Road as constructed and in place.
While on inspection in the Cottonwood Pass Road area near Gypsum
on August 25, 1980, I noticed that the individual sewage disposal system had
never been installed properly on the above -referenced parcel of land.
. My inspection revealed that sewage was running on the surface of the
ground and into an existing irrigation ditch. The septic tank was uncovered,
unconnected to the sewer line, and not finally installed.
Raw septic tank effluent discharging into an agricultural irrigation
ditch, which is a tributary of State waters, is a public and environmental
health hazard and considered a source of pollution to State waters. This
is in direct violation of Eagle County Individual Sewage Disposal System
Regulations, Section 3.1 which states: "...The owners of any structure
where people live, work, or congregate shall insure that
the structure contains adequate, convenient, sanitary
toilet and sewage disposal systems in good working order.
Under no condition.shall sewage effluent be permitted to
be discharged upon the surface of the ground, or into
waters of the State..."
NOTICE IS HEREBY GIVEN THAT
the discharge into the irrigation ditch and onto the ground
surface must be halted WITHIN 24 HOURS RECEIPT OF THIS NOTICE. As the
house is presently occupied, this can -be effected by connecting the mobile
home sewer line pipe to the septic tank that is on location.
WITHIN TEN (10) DAYS' RECEIPT OF THIS NOTICE, the enclosed Individual
Sewage Disposal System Application for Permit must be completed and returned
to this office, along with a site plan and the permit fee of $75, as the
original permit issued July 30, 1973, is expired. You must receive your permit
from the Environmental Health Office, 550 Broadway, Box 850, Eagle, Colorado
81631. No percolation test fees will be required.
The new system must be completely installed and finally approved
by this department WITHIN THIRTY (30) DAYS' RECEIPT OF THIS NOTICE.

The individual sewage disposal system.permit was originally
issued you in 1973 and the system was not installed at that time.
On August 25, 1980, a Notice of Violation was issued you, for
Improper Septic Discharge, by the Environmental Health Department.
To date, you have continued to discharge sewage into the irriga-
tion dicth and onto the ground surface. This, as was stated in
the Notice of Violation, is a violation of Eagle County Individual
Sewage Disposal System Regulations, Section 3.1, which states
"...Under no condition shall sewage effluent be permitted to be
discharged upon the surface of the ground, or into waters of the
State..."
Raw septic tank effluent discharging into an agricultural
irrigation ditch which is a tributary of State waters is
considered a source of pollution to State waters besides being
a public and environmental health hazard.
