RESOLUTION NO. 94-
A RESOLUTION PROHIBITING THE DISCHARGE OF FI REARMS
WITHIN SUBDIVISIONS
LOCATED WITHIN UNINCORPORATED EAGLE COUNTY
WHEREAS, § 30 -15 -301 et sue C.R.S., authorizes the Board of
County Commissioners, County of Eagle, State of Colorado, herein-
after referred to as the "Board ", to adopt a resolution making it
illegal for any person to discharge any firearm, in the unincorpo-
rated areas of Eagle County which has an average population density
of not less than one hundred persons per square mile in the area
designated, except by a duly authorized, law enforcement officer
acting in the line of duty; and
WHEREAS, the Board finds that the discharging of firearms
within subdivisions located within the unincorporated territory of
Eagle County constitutes a menace to the public property, health,
welfare, peace, and safety; and
WHEREAS, the Board hereby designates subdivisions located
within the unincorporated areas of Eagle County as territory where
it shall be illegal to discharge firearms, except by a duly autho-
rized law enforcement officer acting in the line of duty; and
WHEREAS, pursuant to § 30 -15- 302(2), C.R.S. the Eagle County
Board of Commissioners held a public hearing on June 6, 1994, to
consider public comments on the proposed resolution; and
WHEREAS, having reviewed all of the evidence, testimony, and
statements submitted at the public hearing, the Board hereby
determines that the proposed resolution is necessary for the
protection of the public health, safety, welfare and best interest
of the County of Eagle, State of Colorado.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the discharge of firearms within subdivisions located
within unincorporated Eagle County is unlawful, except by a duly
authorized law enforcement officer acting in the line of duty.

THAT, nothing in this resolution shall prevent the discharge
of any firearm in shooting galleries or in any private grounds or
residence under circumstances when such firearm can be discharged
in such a manner as not to endanger persons or property and also in
such a manner as to prevent the projectile from any such firearm
from traversing any grounds or space outside the limits of such
shooting gallery, grounds or residence.
THAT, nothing in this resolution shall be construed to
restrict or otherwise affect any person's constitutional right to
bear arms or his right to the defense of his person, his family or
his property.
THAT, any person violating any provision of this resolution is
guilty of a misdemeanor and, upon 'conviction thereof, shall be
punished by a fine of not more than one hundred dollars.
THAT, is the duty of the sheriff and his undersheriff's and
deputies, to enforce the provisions of this resolution.
THAT, this resolution is necessary for the public health,
safety and welfare of the citizens of Eagle County, Colorado
MOVED, READ AND ADOPTED by the Board of County Commissioners
