RESOLUTION NO. 94 - 35
RESOLUTION GRANTING A SPECIAL PERMIT FOR
TEMPORARY HOUSING FOR
George Roberts, Eagle Hills, Phase II,
FILE NO. T -19 -94
WHEREAS, the Board of County Commissioners of the County of
Eagle, State of Colorado (hereinafter the "Board "), is authorized to
grant temporary housing permits, pursuant to Chapter II, Section
2.07.09 of the Eagle County Land Use Regulations; and
WHEREAS, George Roberts (hereinafter the "Applicant ") applied to
the Eagle County Department of Community Development for a Temporary
Housing Permit on March 15, 1994, within the Rural Residential Zone
District; and
WHEREAS, based on the evidence, testimony, exhibits, study of the
Master Plan for the unincorporated areas of Eagle County, comments of
the Eagle County Department of Community Development, comments of
public officials and agencies, the recommendation of the Planning
Commission, and comments from all interested parties, the Board of
County Commissioners of the County of Eagle, State of Colorado ( "the
Board "), finds as follows:
1. That proper publication and public notice was provided as
required by law for the hearings before the Planning
Commission and the Board.
2. That the proposed use of the temporary housing permit
conforms to the requirements of, Section 2.07.09 of the Eagle
County Land Use Regulations.
3. That the proposed special use will be compatible with
existing uses in the area.
4. That for the above - stated and other reasons, the proposed
zoning is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby approves a special permit for Temporary
Housing for George Roberts, provided the following conditions are met:
1. The Temporary Housing Permit shall expire six (6) months
from the date of this Resolution.
the construction site and inhabitants on that site shall be
owners of the lot or construction employees.
3. Temporary Certificates of occupancy for the
construction project shall be withheld until the existing
kitchen unit is removed and the site is restored to the
satisfaction of the Eagle County Building, Health and
Planning Officials.
4. The connection between the existing residence and
the proposed addition must be connected by a
common foundation, must be walled, heated and
considered habitable space as per Sec. 2.05.51 of
the E.C.L.U.R.
THAT, should Applicant not comply with any or all of the
conditions, the Temporary Housing Permit shall be revoked.
THAT, the Board of County Commissioners directs the Department of
Community Development to provide a copy of this Resolution to the
Applicant.
THAT, the Board hereby finds, determines and declares that this
Resolution is necessary for the health, safety and welfare of the
citizens of Eagle County.
