WHEREAS, Alpine Christian Academy/Basalt Bible Church
("'Applicant") did file an application with the Eagle County
Department of Community Development on or about July 1, 1996 for
expansion of a private educational facility (school) within the
Resource zone district, in the unincorporated area of Eagle
County described as follows:
`~1 A parcel of land located in Tract 52, Section 11, T.8 S., R.
`~~ 87 W., Sixth P.M., County of Eagle, State of Colorado,
~~ approximately 1.5 miles south of E1 Jebel on the east side
of Highway 82 at 20449 Highway 82.
WHEREAS, the special use permit request was considered at a
public meeting by the Roaring Fork Valley Planning Commission on
--- ~ August 8, 1996 and by the Eagle County Board of County
Commissioners on August 20, 1996; and
WHEREAS, based on the evidence, testimony, exhibits, study
of the Master Plan for the unincorporated areas of Eagle County,
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, the recommendation of
the Eagle County Planning Commission, and comments from all
interested parties, the Board of County Commissioners of the
County of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was provided
as required by law for the hearings before the Planning
Commission and the Board of County Commissioners;
2. That the proposed special use conforms to the

requirements of Section 2.09, Special Uses of the Eagle
County Land Use Regulations;
3. That the proposed special use will be compatible with
the existing uses in the area;
4. That the following have been considered: The potential
effect of the use on the character of the neighborhood,
adequacy of access to and from the area,
appropriateness of the physical arrangement of the use
on the proposed site, and consistency with the Master
Plan;
5. That for the above-stated and other reasons, the
proposed special use is in the best interest of the
health, safety, morals, convenience, order, prosperity
and welfare of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT the application of Alpine Christian Academy/Basalt
Bible Church, File No. ZS-390-96, for a Special Use Permit for a
private educational facility (school) within the Resource Zone
District and as described herein, be approved, subject to the
conditions as set forth herein and the conditions in Resolution
94-183 authorizing the original special use permit that remain
applicable and are incorporated herein.
THAT the following conditions shall be placed upon this
approval and that violation of any condition shall be the basis
for revocation of the Special Use Permit:
1. Any future structures for the school must be constructed
in the location of the caretakers unit. The proposed,
detached multi-purpose room proposed for replacement of the
caretakers unit shall not exceed the square footage
footprint of the existing Sunday School building, shall be
one story only, shall not provide additional classroom space
so as to increase enrollment above 150 students, and shall
match the architectural theme of the main school building.
2. The modular classroom building shall match the main
school building and landscaping shall be planted as follows:
ten 1~" caliper deciduous trees and five 8 foot high
coniferous trees prior to Certificate of Occupancy and an
equal amount within one year.
3. Provide parking for 46 vehicle spaces. The parking lot
will be kept in a compacted, dust free condition and dust
controlling agents applied as often as necessary. Magnesium
chloride is acceptable.
4. The source (i.e. bulb) of any lighting installed on the
outside of the building must be shielded to shine downward
and away from any adjacent residential structures.
5. Proposed signs require a sign permit. The temporary
sign permit is no longer valid. A permanent sign permit must
be applied for as part of the building permit submittal.
6. If this specific special use is discontinued, any
replacement use must either be a use-by-right or receive
approval for a special use in the Resource zone.
7. Enrollment shall be limited to 150 students.
8. Part of the required landscaping will be installed on
the sides of the modular structure that face Sagewood
Townhouses and located to screen the modular building from
Sagewood Townhouses.
9. The modular building roof shingle color shall match the
shingle color on the existing school building.
10. The applicant will install a fence along the property
line between the two story school building and the adjacent
property to the west and also between the modular building
and the same adjacent property. Said fence will be up to 8'
tall and shall be of a natural brown color and will feature
some variation in planes rather than a solid, straight wall.
THAT this permit shall be subject to periodic review by the
Planning Department, and shall be heard by the Board of County
Commissioners only if complaints are received and not
satisfactorily resolved by the staff.

THAT the Board of County Commissioners directs the Director
of the Department of Community Development to provide a copy of
this Resolution to the applicant.
THAT the Board of County Commissioners finds, determines and
declares that this Resolution is necessary for the health, safety
and welfare of the citizens of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its meeting held
the 15th day of October, 1996, nunc pro tunc to the 20th day of
August, 1996.
