COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION N0.96-~
A RESOLUTION PROVIDING FOR THE SUBMISSION TO THE
REGISTERED QUALIFIED ELECTORS OF EAGLE COUNTY,
COLORADO, OF A QUESTION OF AUTHORIZING THE
IMPOSITION OF AN ADDITIONAL PROPERTY TAX MILL
LEVY OF UP TO 1.5 MILLS FOR A THREE YEAR PERIOD FOR
THE PURPOSE OF PROVIDING A COUNTY WIDE
EMERGENCY MEDICAL, LAW ENFORCEMENT AND FIRE
EMERGENCY SERVICES RADIO COMMiJNICATION SYSTEM.
SAID QUESTION TO BE SUBMITTED AT THE ELECTION TO
BE HELD NOVEMBER 5, 1996; PRESCRIBING THE FORM OF
BALLOT QUESTION FOR SUBMISSION AT SAID ELECTION;
PROVIDING FOR CERTIFICATION OF THE ELECTION
QUESTION TO THE COUNTY CLERK AND RECORDER; AND
OTHERWISE PROVIDING FOR THE CONDUCT THEREOF.
WHEREAS, the County of Eagle is a growing county in need of enhanced county service,
one service the County needs, and which would benefit all citizens of the County, is a new
emergency communications network; and
WHEREAS, such a network would allow public safety agencies across the County, including
municipalities and fire districts, to communicate with one another via one radio communication
network, thereby eliminating the communication difficulties currently experienced amongst the
public safety agencies; and
WHEREAS, the County would like to raise $4,350,000.00, in addition to funds already
budgeted, for this new emergency communications network; and
WHEREAS, the amount of resources and revenues available to the County is insufficient to
finance the costs required to establish and operate such a network; and
WHEREAS, based on this need and lack of finances to establish and operate such a network,
the Board of County Commissioners finds that it is in the best interest of the County to request the
electors, voting in the next General Election, to authorize the imposition of an additional property
tax mill levy of up to 1.5 mills for a period of three years, commencing January 1, 1997 and
continuing through December 31, 1999 for the purpose of providing a county wide emergency
communications network; and
WHEREAS, the Board of County Commissioners finds that such requested authorization is
permitted under Article X, Section 20 of the Colorado Constitution; and
WHEREAS, the proposal for a mill levy increase may be submitted at the election to be held
on November 5, 1996; and
WHEREAS, this election shall be conducted by the Eagle County Clerk and Recorder in
accordance with the "Uniform Election Code of 1992", Articles 1 to 13 of Title 1, C.R.S.; and
WHEREAS, the additional revenue attributable to the increased sales tax levy, if approved
by the electors of the County, would be credited and pledged to a special revenue account and used
only for the purposes described above.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
Section 1. Certification of Question to Clerk and Recorder for Election. The following
question shall be presented at the election to be held on Tuesday, November 5, 1996. That said
election shall be held in accord with the provisions of Colorado State Statute. Such notices as are
required by Article X, Section 20 of the Colorado Constitution shall be provided by the Clerk and
Recorder.

Section 2. Form of Ballot Ouestion. At the Election there shall be submitted to a vote of the
registered qualified electors of the County the following question:

SHALL EAGLE COUNTY TAXES BE INCREASED UP TO $1,450,000
ANNUALLY FOR THREE YEARS COMMENCING JANUARY 1, 1997 AND
CONTINUING THROUGH DECEMBER 31,1999 BY THE IMPOSITION OF AN
ADDITIONAL PROPERTY TAX MILL LEVY OF UP TO 1.5 MILLS IN EACH
YEAR OF THE THREE-YEAR PERIOD FOR THE PURPOSE OF PROVIDING
A COUNTY-WIDE EMERGENCY MEDICAL, LAW ENFORCEMENT AND
FIRE EMERGENCY SERVICES COMMUNICATION SYSTEM, AND SHALL
EAGLE COUNTY BE ENTITLED TO COLLECT, RETAIN AND SPEND THE
FULL REVENUES FROM SUCH TAX INCREASE WITHOUT LIMITATION OR
CONDITION AND WITHOUT LIMITING THE COLLECTION OR SPENDING
OF ANY OTHER REVENUES OR FUNDS BY EAGLE COUNTY UNDER
ARTICLE X SECTION 20 OF THE COLORADO CONSTITUTION OR ANY
OTHER LAW?
ANY MONIES COLLECTED PURSUANT TO AUTHORIZATION BY THIS
BALLOT MEASURE SHALL BE DEPOSITED IN A SPECIAL REVENUE
ACCOUNT AND USED ONLY FOR THE PURPOSES DESCRIBED ABOVE.

Section 4. Setting the Title. Pursuant to the provisions of §1-40-106(2) C.R.S., the
County Clerk and the Boazd of County Commissioners sitting as the title boazd shall set the ballot
title of this measure by resolution prior to September 11, 1996.
Section 5. SeverabilitX. If any part, section, pazagraph, clause or provision of this
Resolution shall be adjudged to be invalid or unenforceable, the invalidity or unenforceability of
such section, pazagraph, clause, or provision shall not affect the remaining sections, pazagraphs,
clauses or provisions of this Resolution, it being the intention that the various parts hereof aze
severable.
