HomeMy WebLinkAboutR96-102 denying the frst amendment to service plan for Squaw Creek and Cordillera Metro Districts' ~ a ~~~~ ~~~rO~ .°` Commissioner moved adoption of the following R solution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION DENYING THE FIRST AMENDMENT TO THE SERVICE PLANS OF THE THE SQUAW CREEK AND CORDILLERA METROPOLITAN DISTRICTS Resolution No. 96~ WHEREAS, the Board of County Commissioners of the County of Eagle is vested with administering the affairs of Eagle County, Colorado, pursuant to state statutes; and WHEREAS, pursuant to the provisions of Sections 32-1- 202(1) and 32-1-204(1), C.R.S., the Board of County Commis- sioners of Eagle County, Colorado scheduled a public hearing on the First Amendment to the Service Plans of the Squaw Creek and Cordillera Metropolitan Districts (hereinafter "First Amendment") to be held at 500 Broadway, Eagle, Colorado, Tuesday, March 26, 1996; and WHEREAS, Notice of the Hearing was duly published in the ~,g1P Valley Enterprise a newspaper of general circulation within the County, on February 29, 1996, as required by law, and Notice was forwarded to the Petitioners and to the governing body of each municipality and special district which levied an ~ valorem tax within the next preceding tax year and which has boundaries with a radius of three (3) miles of the proposed Districts; and WHEREAS, the Eagle County Planning Commission studied and considered the First Amendment at its meeting of March 6, 1996, at which time said Commission recommended denial of the Service Plans, which recommendation was subsequently presented to the Board of County Commissioners at its hearing on this matter, as required by Section 32-1-204(2), C.R.S.; and 597176 Sara J . ~-7U1 !+'ish Y-1813 U7/3U/96 U2: U6Y 1'G 1 U~' 4 kE( er ~;a~le County Clerk ~c H,ecorder , llUC U.UU i~? C~ Ni WHEREAS, this Board has fully considered the First Amendment to the Service Plans and all testimony and other evidence presented to it in this matter relating to the Service Plans, including the unfavorable recommendation of the Eagle County Planning Commission. WHEREAS, it appears that the First Amendment to the Service Plans should be denied. THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSION- ERS OF EAGLE COUNTY, COLORADO: ~Prt;on 1. That the Board of County Commissioners of Eagle County, Colorado does hereby determine that all of the require- ments of Title 32, Article 1, Part 2, Colorado Revised Statutes, as amended, relating to the filing of the First Amendment have been fulfilled and that Notice of the Hearing was given in the time and manner required by law. ~Prr_ion 2. That the Board of County Commissioners of Eagle County, Colorado, does hereby find and determine that: (a) There is not sufficient existing and projected need for ~, organized service in the area to be served by the ~ proposed First Amendment; LZ (b) Adequate service is, and will be, available to the area through the County or other existing municipal or quasi-municipal corporations, including existing special districts within a reasonable time or on a comparable basis; (c) The proposal is not in substantial compliance with a master plan adopted pursuant to section 30-28-108, C.R.S.; and (d) The creation of the First Amendment will not be in the best interests of the area proposed to be served. That a certified copy of this Resolution be filed in the records of Eagle County and submitted to the Petitioners. THAT, the board hereby finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the residents of the County of Eagle, State of Colorado.
