ZS-374-95 ~ N on do cD N WHEREAS, Ralph and Terri Thomas, dba Hidden Treasure ~ N o ti Adventures, ("Applicant") did file an application with the Eagle ~ ~ County Department of Community Development on or about September ~ ~ 15, 1995, for a Special Use Permit for a Recreational Facility a w within the Resource Zone District in the unincorporated area of --'•• m ti Eagle County described as follows: ~ b ~b A parcel of land being the Left Bower, Hidden Treasure, ~ ~ Right Bower and Receiver Lodes, located in the Fulford ~'-' Mining District, Township 6 South, Range 83 West of the 6th ~ Principle Meridian, County of Eagle, State of Colorado ~,o rn and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, ~ ~ comments of public officials and agencies, the recommendation of 0 the Planning Commission, and comments from all interested ~ parties, the Board of County Commissioners of the County of Eagle, State of Colorado ("the Board"), finds as follows: ao c~ 1. That proper publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board. z 0 y 2. That the proposed special use conforms to the require- ments of Section 2.09 of the Eagle County Land Use Regulations, which are incorporated herein as if set forth ~~ with particularity. .~ 3. That the proposed special use will be compatible with ~", existing uses in the area. ~ 4. That the following have been considered: The potential effect of the use on the character of the neighborhood, adequacy of :ss to and from the area, propriateness of the physical arrangement of the use on the proposed site, consistency with the Master Plan, and adequacy of the environmental impact report. 5. That for the above-stated and other reasons, the proposed special use is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application of Ralph and Terri Thomas, dba Hidden Treasure Adventures, Eagle County File Number ZS-374-95, for a Special Use Permit for a Recreational Facility within the Resource Zone District described herein, be approved, subject to the conditions as set forth herein. THAT, the following conditions shall be placed upon this approval and that violation of any condition shall be the basis for revocation of the Special Use Permit: 1. The land described shall be limited to the use of this recreational facility on a minimum area of 36 acres which shall be allowed a maximum of one yurt. The yurt shall be limited to a maximum of eight beds. The location of the yurt shall remain consistent with the building permit site plan as provided by the applicant to the Eagle County Building Division for permit number MI-10182. 2. The yurt may not be used for commercial purposes until such time as a final inspection has been completed and approved by the Eagle County Building Official and until such time as the United States Forest Service access easement is granted. 3. Access shall be limited to non-motorized vehicles except for vehicular use by the owners to resupply the yurt and as necessary to provide maintenance to the facility. 4. No animals under the care or control of human beings shall be permitted on this property. 5. Peripheral fencing shall be as recommended by the Colorado Division of Wildlife. 6. Any outside storage of trash or garbage shall be in bear- proof containers which meet North American Bear Society, CDOW or U.S. National Park Service specifications. 7. There shall 1 io dumps or underground d osal of refuse on the site. 8. The feeding, baiting, salting or other means of attracting wildlife to the property is prohibited. 9. The applicants hereby waive the right to any future wildlife damage claims against the Division of Wildlife, State of Colorado. 10. All disturbed areas shall be reseeded or replanted with certified weed-free seed of native plant species originally present in the sub-alpine environment. Neither ornamental nor non-native species of plants shall be permitted on the site. 11. The applicants shall submit semi-annual reports to the Department of Community Development (Attached). 12. An annual inspection will be conducted by the Community Development Department to assure compliance with all conditions, and to evaluate the impacts of this development. The evaluation of impacts will include visual inspection (photos to be kept on file) to assure conformance with Section 2.07.07 of the ECLUR, Commercial and Industrial Performance Standards. The annual inspection will also include investigation of the criteria listed in Section 2.10.04 of the ECLUR, Environmental Impact Reports. If a problem is found to exist among that criteria, the applicant could be required to submit an Environmental Impact Report for further review and possible mitigation of the impact. 13. All material representations made by the Applicant in the applications and public meetings shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions. THAT, the annual inspection performed by the Department of Community Development shall cause the instigation of revocation proceedings if compliance with these conditions and evaluations are not met nor able to be resolved by the staff. THAT, the Board of County Commissioners directs the Department of Community Development to provide a copy of this Resolution to the Applicant. THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the citizens of Eagle County.
