Clare of Assisi3 %~ s ~~~ Commissioner owed adoption of th following Resolution: BOARD OF COUNTY COI~iISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLIITION NO. 96-~~ APPROVAL OF THE PLANNED UNIT DEVELOPMENT SKETCH PLAN FOR ,~T. CLARE of ASSISI PARISH FILE NO.ZS-343-95-5 WHEREAS, on or about October 10, 1995, the County of Eagle, State of Colorado, accepted for filing an application submitted by Peter Jamar Associates, Inc. For the Colorado State Land Board and The St. Clare of Assisi Parish and the Archdiocese of Denver, hereinafter ("Applicant") for approval of the Planned Unit Development Sketch Plan for St. Clare of Assisi Parish, File No. ZS-343-95-5; and, WHEREAS, the Applicant requested the approval of a Planned Unit Development (PUD) Sketch Plan which would allow for the development as follows: *Church, Fellowship Hall, *Early Learning Center *Elementary School *Rectory *Campus Maintenance *Housing(20 units) TOTAL and, Administration 581982 B-685 P-978 01/17/96 12:27P PG 1 OF 5 Sara J. REC DOC 0.00 l"'} ~-, WHEREAS, notice of the Sketch Plan was given to all proper agencies and departments as required by the Eagle County Land Use Regulations, Section 2.17.02(1); and, WHEREAS, at its public hearing held on December 20. 1995, the Planning Commission, based upon its findings, recommended approval of the proposed PUD Sketch Plan, with certain conditions; and, WHEREAS, at its regular hearing of vTani~ary 2 1996, the Eagle County Board of Commissioners (hereinafter "Board"), considered the PUD Sketch Plan, associated plans, and the statements and concerns of the Applicant, the Eagle County Community Development and Engineering staff, and other interested persons. BASED ON THE EVIDENCE BEFORE IT, and with the modifications imposed by the conditions hereinafter described, THE BOARD FINDS AS FOLLOWS: In accordance with Section 2.17.02(3), Sketch Plan Review, a) The St. Clare of Assisi PUD is in general conformance with the Master Plan, Edwards Sub-Area Plan, Open Space Plan, policies, guidelines, zoning and other applicable regulations as described above; In addition, a 1041 permit for extension of water and sewer service is required and will be considered in conjunction with the Preliminary Plan application. b) The land is suitable for subdivision with the conditions as recommended by staff; c) Comments and recommendations from the agencies listed in Section 2.17.02(1) have been considered; d) The parcel of land proposed for subdivision has access to the state highway system, however, road improvements must be made to be capable of servicing the development. 2 2.06.13(5) Planned Unit Development Sketch Plan Review, 1. Resulting development will be consistent with the Master Plan objectives; 2. The area around the development can be planned to be in substantial harmony with the proposed PUD; 3. The adjacent and nearby communities will not be detrimentally affected by the proposed PUD; 4. The PUD can be completed within a reasonable period of time, which shall be determined prior to final approval of the PUD; 5. The proposed industrial development has been justified; not applicable 6. The streets can be improved to be adequate to support the anticipated traffic and the development will not overload the streets outside the planned area; 7. Proposed utility and drainage facilities can be improved to be adequate for the population densities and type of development proposed; 8. An employee housing plan was submitted and acceptable to the Board of County Commissioners. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application for approval of the Planned Unit Development Sketch Plan for St. Clare of Assisi be and is hereby granted, subject ~ compliance with the following conditions: 1. The Squaw Creek and riparian corridor setbacks are to be reviewed on site with representatives of the applicant, Eagle County and the Colorado Division of Wildlife prior to submittal of the Preliminary Plan. 3 2. A Preliminary Plan shall include an analysis to determine the possibility for using the on-site irrigation ditch for landscape irrigation. 3. A wildlife plan is to be submitted with the Preliminary Plan. 4. To the extent practical, the maintenance building shall be incorporated into a landscaped berm or one of the development PODS. 5. The on-site sewage disposal shall be further evaluated as part of the 1041 and preliminary plan review. THAT, the Sketch Plan submitted under this application and hereby approved, does not constitute a "site specific development plan" as that phrase is defined and used in C.R.S. Section 24-68-101, et seq. Sketch Plan approval is expressly conditioned on the County's authority to impose further restrictions or limitations on the PUD which are necessitated by impacts which are not yet recognized or which are more severe than realized under the review given at the hearings on the Sketch Plan. THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
