History according to Robert Woods and after reviewing our records The aforementioned residence was originally constructed in 1963. The residence is served by two separate septic systems; one system receives wastewater from a kitchen and bathroom associated with a single bedroom while the other septic system located on the other side of the house receives wastewater from bathroom plumbing near two other bedrooms. It is not known why the residence is served this way but it clearly pre-dates our current ISDS regulations. This makes their system(s) pre-existing, non-conforming. The significance of this is that according to 4.03.08 of our Eagle County Land Use Regulations (ECLUR) ……”upon failure or need of repair or alteration, pre-existing, non-conforming systems must be brought up to current regulation of a two-compartment septic tank and the required square footage of absorption area.” In 2003, the current owner obtained a building permit (#15177) to extensively remodel the residence from the foundation up, meaning that no changes were proposed to be made to the existing septic system(s). Our building permit records indicate that the owner provided evidence that two tanks exist that are of sufficient capacity to serve the residence by sending pumping records from B&R Septic showing a 1,000 gallon tank existed on one side of the house while a 1,200 tank existed on the other. Building records reported one tank to be 1,250 gallons which doesn’t match the [1,200 gallon] capacity shown on the pumping receipt. In 2011, one of the tanks collapsed and the owner contracted with Avalanche Excavating to obtain a permit to replace the tank. According to the owner, the collapsed tank serves the kitchen and bathroom associated with one bedroom. The installer, Steve Burns, recommended a 1,000 ROTH plastic composite tank. The issue is whether the entire system(s) need to be brought up to current standards. To the degree that both systems are pre-existing, non-conforming, only one of them has failed. The owner has been advised that we will issue a repair/emergency use permit that will allow replacement of the collapsed tank. However, since we don’t know the square footage of the absorption area, either a new soil treatment unit must be installed or an engineer must certify that that the existing absorption area is adequate. Therefore, the emergency use permit will be issued for 30 days and may be extended for good cause shown until such time as the owner either brings the system up to current code. The other system is also pre-existing and non-conforming but has not failed and is not in need of repair or alteration. Therefore, the other system can remain in place until such time as failure, repair or alteration takes place. November 30th 2011 Project No. 1886 Robert Woods 11299 Frying Pan Road Basalt, CO 81652 Installation Observations, Permit #11-6436 11299 Frying Pan Road, Woods Residence Eagle County, Colorado Robert, ALL SERVICE septic, LLC performed installation observat ions in September and on October 5th 2011 for the subject property. The installation included a 1000-gallon, two-compartment ROTH plastic septic tank with an effluent filter on the outlet, followed by a 500 gallon Infiltrator septic tank with a pump. The drain field consisted of one drywell that was 20ft x 20ft and 10ft in depth equaling a total area of 1200 SF. Perforated laterals were installed in the drywell to distribute effluent. Concrete sand was placed in the bottom of the drywell to aid in treatment processes. The OWS was generally installed according to specifications. This observation is not a guarantee of workmanship and/or parts and materials. ALL SERVICE septic, LLC should be notified if changes are made to the OWS. LIMITS: The observations were based on our site visits and information submitted by client. If conditions are different from conditions described in this letter, ALL SERVICE septic, LLC should be notified. All additional OWS construction must be according to the county regulations. The installer should have documented and demonstrated knowledge of the requirements and regulations of the county in which they are working. Please call with questions.
