ZS-368-95 WHEREAS, Stephen J. Whitehead, ("Applicant") did file an application with the Eagle County Department of Community Development on or about May 15, 1995, for a Special Use Permit for a Contractor's Storage Yard, within a Resource Zone District, in the unincorporated area of Eagle County described as follows: and Lot 1, Neumayr-Brown Subdivision WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments ~f public officials and agencies, the recommendation of the Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado ('"the Board"), finds as follows: 1. That proper publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board. 2. That the proposed special use conforms to the require- ments of Section 2.09 of the Eagle County Land Use Regulations, which are incorporated herein as if set forth with particularity. 3. That the proposed special use will be compatible with existing uses in the area. 4. That the following have been considered: The potential effect of the use on the character of the neighborhood, ,,,~ adequacy of access to and from the area, ~' appropriateness of the physical arrangement of the use on the proposed site, and consistency with the Master y~;, Plan. ~- ~. ~~ 5. Whitehead of Rocky Mountain Concrete Pumninq, File No. ZS-368-95, for a Special Use Permit for a Contractor's Storage Yard within the Resource Zone District described herein, be approved, subject to the conditions as set forth herein. THAT, the following conditions shall be placed upon this approval and that violation of any condition shall be the basis for revocation of the Special Use Permit:- 1. All of the vehicles shall be parked in an alignment similar to that on the site plan. If additional vehicles are acquired, then an additional storage building shall be constructed subject to staff review; 2. Outside storage of non-vehicular equipment, including trailers, is prohibited unless it is completely within a sight obscuring fence or within a building. The outside storage of non-operating vehicles or equipment is prohibited; 3. Maintenance of vehicles or equipment, other than washing, is permitted only within the building(s); 4. The building(s) shall be visually enhanced through planters, false window shutters and painting subject to review by the County Zoning Administrator; 5. A fence that obscures the truck parking from view from the adjacent residential area is required; 6. Engine block heaters for the large trucks stored outside shall be required; 7. No more than 2-16 foot shielded-low pressure sodium lamps of no more than 5000 lumens are permitted. Ground and building mounted architectural lighting is acceptable provided that no lights cast glare on adjacent properties, rights-of-ways or into the night sky. 8. A landscape plan drawn by a qualified landscape designer shall be submitted which shall buffer the proposed use from surrounding residential uses, additional trees to be planted along the western side of the building, and integrate greenspace with the internal use of the property. The plan shall encompass the entire parcel and specify number, size, species, and location of plant materials. A landscaped separation is required along collector and arterial streets. This plan shall be submitted no later than the application for building permit and is subject to review and approval by the County Zoning Administrator. 9. A maximum of one (i) thirty square foot sign is permitted. The sign shall conform with the sign height/setback calculation (2.11.04(1)G)) and the establishment of the clear vision area (2.07.08(5)). The sign shall not be illuminated. A sign permit shall be required. 10. The County Engineer's concerns as outlined in the memo dated June 12, 1995 concerning this application shall 2 be sa factorily addressed prior ~ issuance of a Building Permit. 11. All material representations made by the Applicant in the application and public meeting shall be adhered to~ and considered conditions of approval, unless otherwise amended by other conditions. THAT, this permit shall be subject to periodic review by the Planning Department, and shall be heard by the Board of County Commissioners only if complaints are received and not satisfactorily resolved by the staff. THAT, the Board of County Commissioners directs the Department of Community Development to provide a copy of this Resolution to the Applicant. ' THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the citizens of Eagle County.
